Since Title 42 went into effect on March, 2020, Univision has aired countless reports condemning the ‘illegal and racist’ Trump-era policy, see here and here. Yet now that SCOTUS temporarily halted its termination - scheduled for December 21st by the Biden Administration –anchor Elyangélica González, from the network's morning news edition, needed an immigration lawyer to explain how the policy works.
“The Supreme Court will allow Title 42 to remain in place while it decides a lawsuit by Republican states. President Biden promises to respect the ruling, but we all wonder what will happen now to those migrants that have already crossed the border, or are waiting on the Mexican side to apply for asylum,” Gonzalez opened the report before introducing lawyer Alex Gálvez, making it seem like the Supreme Court's decision changes an immigration policy that has been in place for the last 21 months.

Is this a policy that will indeed be effective?

Of course, in the coming days we will see the impact of the policy at the border.
Amazingly, Gálvez happily played along with the ruse. “If they (the migrants) were processed and allowed to stay and file an asylum case before an immigration judge, they have nothing to worry about. They have already been prosecuted, and the Supreme Court's ruling will no longer affect them. Now, for those migrants who are in Mexico, unfortunately, the Supreme Court's ruling shuts off their chance to appear before immigration officials to fight their case in an immigration court. Unfortunately, they are going to remain in Mexico until there is a Supreme Court ruling.”
In all honesty, do both González and Gálvez believe that the migrants will remain in Mexico until there is Supreme Court ruling? Of course not, as González admits that asylum applications have "reached record numbers: 1,600,000." This WITH Title 42 in effect.
And, while the Univision anchor claimed that "Of course, in the coming days we will see the impact of the policy at the border," there is nothing new to see beside the suffering of thousands upon thousands of migrants, falsely enticed by misinformation in the name of political agendas at the Latino corporate press.

That's why now we're going to talk with immigration attorney Alex Galvez, live from Los Angeles, California. How are you? Welcome.
ALEX GÁLVEZ: Good morning everybody.
GONZALEZ: Attorney, let's start with this question precisely. What about those who have just crossed into the United States and those who were waiting in Mexico to do so?
GÁLVEZ: First of all, for those immigrants who managed to enter, but were not caught by immigration, they will face a summons because of the Supreme Court ruling. They're inside the United States, but remember, there are plenty of places in the first 100 miles where immigration is conducting reviews. And if they fall into the hands of immigration they can still be returned to Mexico under Title 42 or Title 8. Now, it does not mean that simply because they entered they are already free. Now, if they were processed and let in so they could file the asylum case before an immigration judge, they don't have to worry. “If they (the migrants) were processed and allowed to stay and file an asylum case before an immigration judge, they have nothing to worry about. GONZALEZ: Now, in a way this limits asylum claims, lawyer, which according to the latest figures reach record numbers: 1,600,000. Is this a measure that is indeed going to have good results in that regard?
GÁLVEZ: If it's going to have a good result because it's going to limit immigrants, they're going to be processed and they're going to be allowed to enter to ask for asylum. In addition, it limits the administration of being able to carry out one of the processes at the border of sending more officers where this title 42 is already solved, if they do not let it remain in effect. But, unfortunately, for immigrants they are asking if the United States has asylum laws, why they are not respecting those laws, why we have to stay at the border, and why they are not willing to listen to life and death situations. The Supreme Court said it will hear the case in the next term which is in February, early in February. And the ruling may come in the summer, but those are months and for immigrants at the border who are facing crime, life or death situations, it is very difficult.
GONZÁLEZ: Yes, time is against us. Precisely because of what I explained, this decision is not final.
GÁLVEZ: It's not definitive, it's a temporary ruling. They say they're going to open the arguments, that the president and the administration are going to make their argument, and also Republicans, Republican states and Republican prosecutors are going to make the case for Title 42. But something interesting: One of the Supreme Court justices, Gorsuch, said that they cannot use a law that was implemented only to stop the spread of covid and use it to regulate the immigration issue at the border. That responsibility is Congress, and that's why the president said we have a problem. Title 42 not in the resolution. We need Congress to pass reform or amend immigration laws to address the humanitarian crisis at the border.
GONZALEZ: And you know, the people who are in favor of this ruling think that this would not fairly contain, that massive crossing across the border. We will see of course in the coming days what is the impact that the measure has there on the edge.
