Since the Dobbs decision overturned Roe, the Biden administration has been trying to think of ways to force abortions on states that don’t want them. A federal judge just shot down one such effort in Texas, according to the Washington Times.
Biden’s Health and Human Services Dept., “citing the Emergency Medical Treatment and Labor Act — ordered emergency room doctors to perform abortions when necessary.” The move drew legal suits from Pro-Life Obstetricians and Gynecologists and the Christian Medical and Dental Associations, represented by Alliance Defending Freedom.
According to the Times:
Judge James Wesley Hendrix, a Trump appointee, noted in his 67-page order that Texas already allows abortions in life-threatening conditions or for the removal of an ectopic pregnancy. He also said HHS issued the guidance without following federal law, requiring a period of time for notice and public comment.
In a resounding slap, the judge said “That Guidance goes well beyond EMTALA’s text, which protects both mothers and unborn children, is silent as to abortion, and preempts state law only when the two directly conflict.” Accordingly, he issued an injunction blocking the HHS order in Texas while the litigation is pending.
A few more Lonestar babies will be protected from the abortion industrial complex. At least for a little while.
