The side of biology, gender sanity and commonsense isn't surrendering any time soon to the gender-bending madness of the very confused Biden Administration. Alliance Defending Freedom (ADF) is pursuing multiple lawsuits to challenge the administration’s insistence on turning female sports into a farce.
The U.S. Department of Education and the U.S. Equal Employment Opportunity Commission have fabricated a re-interpretation for Title IX of the Civil Rights Act of 1964 by claiming they must prevent discrimination by allowing sports participation based on “gender identity.” Rather than on gender reality.
Earlier this week, ADF filed a motion seeking permission for the Association of Christian Schools International (ACSI) and three female Arkansas athletes to join in a multi-state lawsuit against the Biden Administration. The Arkansas plaintiffs are public school athletes Anna Scarborough, Cate Ford, and Amelia Ford.
The multi-state lawsuit involves Tennessee, which sued the feds in August. Several states -- including Alabama, Alaska, Arizona, Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota and West Virginia -- have joined in that lawsuit.
ACSI schools include 500,000 U.S. students who compete against public schools receiving federal financial assistance and adhering to the federal transgender mandate. That puts the Christian schools and their female athletes at competitive disadvantages by facing males on girls’ teams.
ADF is also attempting to intervene in a lawsuit against West Virginia on behalf of Lainey Armistead, a member of the women’s soccer team at West Virginia State University. The suit asks a federal district court to allow Armistead to intervene in the legal defense of the state’s Save Women’s Sports Act. The law seeks to prevent the undermining of women’s sports by male competitors, and is currently facing a legal challenge.
Previously, ADF represented three high school girls in a suit against Connecticut’s unfair transgender policy. That case was progressing well during the Trump Administration, but under the Biden Administration it was dismissed.
ADF is not giving up in Connecticut though. Its attorneys are now representing four different female athletes who are standing up to a Connecticut Interscholastic Athletic Conference policy that allows males to compete against girls.
In addition to all these lawsuits, ADF is also defending an Idaho law protecting the integrity of women’s sports. A lower court struck down that law, and ADF appealed to the Ninth Circuit.
It’s simply amazing how many lawsuits have to be filed to convince the misguided Left that people with the XY chromosome are males, not females.
