Today the MRC submitted to the Federal Communications Commission a formal reply to the opposition filings of ABC and former commission employees to the MRC’s June 29 petition to deny the early broadcast license renewal of ABC’s 8 owned-and-operated television stations.
ABC’s filing boils down to a squatter’s rights argument: once it occupies the public airwaves, it believes no one can question whether it deserves to stay. But broadcast licenses are not permanent entitlements. They are temporary privileges conditioned on serving the public interest.
Our reply demonstrates that ABC largely avoids the documented evidence of partisan electioneering, misinformation, and programming that minimizes or excuses political violence. The FCC should judge the record, not the rhetoric.
MRC has reviewed nearly 50,0000 hours of ABC programming over 38 years, and has produced hundreds of studies detailing ABC’s record of electioneering, broadcasting of disinformation, and its justification of political violence.
MRC does not ask the Commission to compel ABC to air any message or produce any program; it asks the Commission to find that ABC’s record will no longer be tolerated. ABC has a First Amendment right to express its views through private channels. That is not the issue here. The relevant question is whether ABC has an unconditional right to continue using publicly licensed spectrum despite a record that is inconsistent with the public-interest standard. It does not.
