Reid's Rush Limbaugh Smear Letter Nears $1 Million Bid (Update: $2.1 Million!)

Unless you have been asleep or out of the country without Internet access for nearly a month, you are quite aware that Senate Majority Leader Harry Reid (D-Nev.) recently sent a letter -- signed by 41 Democrat Senators, no less! -- to the CEO of Clear Channel, one of the leading radio networks in the country.

In said correspondence, Reid et al complained about Rush Limbaugh's comments concerning "phony soldiers."

In an almost epic quid pro quo -- that is for everyone not affiliated with mainstream media outlets ignoring the truly delicious side of this story! -- Limbaugh got the original version of this letter and put it up for auction at the Internet site eBay.

*****Update: Auction ended with bettyc588 -- apparently a real eBayer with an actual transaction history as opposed to some rumors being spread about phony bidders (pun intended!) -- getting the letter for $2,100,100. Also of note: Reid is now taking credit!

And people in their right mind who want to donate to a charitable cause (100% of the bid is going to the Marine Corps Law Enforecement Fund) would do so since Rush is going to MATCH that donation.

Plus, getting to tweak Harry Reid's nose is just an added bonus.

Also consider that the letter may someday have some significant historical value, and could be sold to the Smithsonian.

This is funny on so many levels.  For sure, some wealthy bidder is going to get a big tax deduction for charitable giving while at the same time giving Dingy Harry and 40 more Dummycrat Senators the bird.  This is great!  Harry and Co. will be responsible for a loss to the treasury of around $350,000 (35% of 1 million).

Not true, the bidder is bidding on tangible goods, and it is not considered a tax deductable contribution.  What the SELLER does with the proceeds becomes tax deductable, as does Rush's matching contribution.

For the buyer, they must have the conviction to eat this payment out of pocket.

It's been a while....but, if Rush is selling this from his "foundation"....and I'm sure he has one...it has nothing to do with receipts.

The "fair market value" of this "donation" is what counts. 

The difference between the fair market value, and the purchase price, then becomes deductible to the buyer.

The fair market value of this iconic piece of paper is stationary, printing, and postage.  The rest should count as a rather nice tax deduction for the purchaser...since Rush is "selling" it for the benefit of a certifiable (I assume...ooops!) 501(c)3 organization....the Marine charity.

Unfortunately as a collector's item, the "Fair market value" is being determined by the very bidding process.... unless you know of another more arbitrary method.  Rush did explcitly disclaim on his radio show that the winning bid would NOT be tax deductable.

Kinda unfair? Maybe.... on the other hand it just goes to show that the document actually does hold a significant value to the purchaser, and not just the value of cost-less-writeoff.

In fact I'd be interested to see what the approximate donation value would be if it WERE deductable... because then the $850k would be equivalent to a $1.7M contribution?

I used to work for a NPO.  It goes like this.  We auction off tickets for the "Masters" golf tourney...and airline tickets, and hotel....The fair market value might be $5 grand.  But the successful bidder goes to $20 grand.   $15 thou tax deduction.  Like that.

The fair market value is the intrinsic value of the item.

In all fairness, the letter is worth about a buck twenty.

The fair market value of tickets, hotel stays, etc, are determined by just that, fair market.  The way collectors' items are determined is generally by listings of previous auctions... listings from Sotherby's etc.  As this is the first time this item has gone up for public auction, it will also set the fair market value.

Can you imagine if someone lost a Van Gogh in a fire, and their insurance company told them the "fair market value" was only the cost of canvas and paints to replace it?

Collectables are quite different than merchantable goods.  If I could go to the store and buy the 2nd copy for $1.20, then yes it would be worth $1.20

Written like a first year law student: "Knows enough to be dangerous!" So the tangible letter is worth "1.00" the remaining $999,999 is a deductible contribution to an organization with appropriate tax creditials. Wait till you finish school before giving advice!

Just curious-what exactly is the definition of "fair market value" these days in the collectibles market?

The definition of that term has changed over the years in other realms. It used to be that "fair market value" in real estate, for instance, was defined as the highest price one could get for a certain asset, but that has evolved to "the most probable" price.

As I said in my earlier post, and I used to be IN that business....the value of an "auction" item is it's face value....Tickets to a sporting event, plus airfare, plus hotel accomodations, etc.  That's what you can't deduct.  Anything over the face value is what can be deducted.

Perhaps a "real" accountant could chime in here.

I know that Jay Leno auctioned off that Harley for $850K.....the "market value" was about $40K....so the deduction to the company that bought it was over $800 grand. 

Please, don't ask me how I know that.

But the point is....there's no "intrinsic" value to the Harry Reid letter....it's all sauce to whomever purchases it.....and then they can "donate" it again later.  It's a nice racquet.

The organization to which the funds will end up is a charitable orginization.  The winning bid on the ITEM is not a tax-deductable expense.  This is what was said on the air according to Rush's site:

CAMEROTA:  Steve, you're a tax accountant.

DOOCY:  Yeah.

CAMEROTA:  The person who pays $117,000 for it, they can't deduct it as charity, right? Only Rush can. That's not a charitable deduction by that person?

DOOCY:  No, because it's a donation to the Marines. It's a donation to one of the Marines charities --

CAMEROTA:  That's where the money will go.

At this point the text seems misleading to me, and I could very well be wrong, BUT when the fellow said "no" on the air, it sounded like he was agreeing that "no, it would not be deductable." But in print form it could be taken as a disagreement...

Hopefully he'll clarify, but I've never heard of a collector's item's fair-market worth being set by the paper it's printed on.  Also on Rush's site: "Reid Smear Letter is an investment" implying realizable value will be greater than the bid.

mgerardn, respectfully you apparently do not know anything about the Limbaugh program as it is the most state of the art in the industry. When Mr. Limbaugh gets a call, the caller's number is logged.

The EIB network is "in touch" with enough sources that every phone number and name is then checked through various public sources. So your caller you are defending had his voter registration annexed as it was public, his service is a matter of public record and any other various information can be gleaned legally on all callers.

So when Rush Limbaugh gets a caller, he is 100% certain who is on the line, where they are, what they are telling the screener is matching exactly what the data coming in is.

People need to be informed of what they are accusing Mr. Limbaugh of as when the facts start coming out in how much information is available on callers, then Mr. Limbaugh calling someone a liar........well Mr. Limbaugh has evidence the person is lying.

Letter is worth it

This letter is worth the 850 plus g's it went for. The only name missing is that manipulator Tim Johnson who declined to sign it as he is in a race for his life in 2008.

40 of the biggest traitors, criminals and communists in American history who history will look back upon with scorn is a most historic document. Think of owning something that calls for the suspension of Rush Limbaugh's Constitutional Ammendment rights.

This is timeless and wonderful as now almost 2 million will go to the Military families...........it would be 3 if the Democrats would pony up their share, but strangely millionaire Democrats are closed pocket for our troops again.

I heard the whole conversation on Rush's program, and I heard the story of the actual phony soldier just prior to Rush making his statement. It was/is obvious to clear thinking people what Rush was talking about.

Rush would never say anything bad about our military. Like me, Rush has nothing but respect and admiration for those that serve. Also like me, he hates those liars that claim to be soldiers when the closest they ever got to a battle field was playing a war themed video game.

Very few of us buy the Media Matter version of events because those are patently incorrect.  Rush Limbaugh never said or implied that any soldier who speaks out against the war is a phony soldier.  Yes, I was listening to the program at the time and it was readily apparent what Rush said and intended.  You guys on the left love mincing and parsing words as if that proves anything.  Rush's actions, including personal donations to military causes, exceed any words he could say in the first place.  In the liberal world, however, words are more important than actual actions.  This is why you guys love Al Gore and his global warming crusade, even as he flies around in his fuel-hog jets and meanders from one energy-burning mansion to another.  I'll stick with people of action; you guys can have the talkers.

The concept of the US Senate attempting to condemn or censor a private citizen is newsworthy, is it not?  The concept that a single congressional document has an established value of $850,000 is newsworthy also, is it not?  (more newsworthy than the Grilled Cheese of Mary, I think)

So can someone please tell me why this story has not been reported on any national media outlet?  (Other than Fox, who just had Rush on for an interview)
