Let's Play Guess Which Party Rants Against Child Rape Victims With CNN


If you haven't heard about the Massachusetts Democrat representative James Fagan going on a rant against child rape victims yet, its most likely because there was limited media coverage.

Here is what he said:

“Let me tell you why it’s so wrong, It’s so wrong because in these situations . . . that 6-year-old is going to sit in front of me, or somebody far worse than me and I’m going to rip them apart. I’m going to make sure that the rest of their life is ruined. That when they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep. When they’re 19 years old they’ll have nightmares and they’ll never have a relationship with anybody. And that’s not because I’m a nice guy. That’s because when you’re in court, and you’re defending somebody’s liberty, and you’re facing a mandatory sentence of those draconian proportions, you have to do every single thing you can do on behalf of your client. That is your obligation as a trial lawyer.”

By the way, he doesn't regret a single word.

Well, CNN actually covered it, but couldn't seem to figure out which party he belonged to. The best they could come up with was that he was a legislator of some sort.

Consider the difference between testifying while in a secure room with people you trust, watching a monitor and looking at a camera, as opposed to being in a packed courtroom with a raving lawyer 5 feet from you, and the monster who raped you staring while you try to speak.

The law in a lot of states allows closed-circuit testimony. Massachusetts was going to disallow that, therefore, the state "was threatening future victims with increased victimization."

We can infer that he wants the plea bargain in order to do two things - 1.)  lessen any form of punishment on his client to a minimum.  2.)  Increase the volume of traffic he is able to handle.

Being scum, commonly known as a defense lawyer, he is hardly expected to CARE about close circuit television capabilities inthe courtroom in order to lessen the pain of the victim and there is absolutely no evidence that that is the true motives present.  If this were truley the issue, he could simply modify that issue in future legislation.

Nope, he is scum, and there is an entire circle of Dante's Hell awaiting just him.

On his show last week, Dennis Miller called Fagan's office, and was told that the closed-circuit issue was a big part of Fagan's concern. To "modify that issue in future legislation", he'd need to get a majority to go along.

As far as I'm concerned, anyone who abuses a child in any way should be dropped down a deep hole and never see daylight again.

One of the duties of an attorney - defense or prosecution - is to impeach the testimony of a witness if he can. Fagan was giving an example that was not as extreme as you might imagine.

Far too many false claims

There are far too many false claims. An innocent person cannot lose their life over a false claim and so their lawyer has to uncover any lies, especially if a child is "put up to it" to lie for the parent who is "getting even" with a spouse from a broken marriage.

The lawyer's words were rather disrespectful, to say the least, but nonetheless, the rights of the accused are being respected, even when the questioning is hard for the victim to deal with.

As an aside, what many victim's advocates do not not tell you is that while it is true victims re-live the crime on the witness stand, in the long run there is a great deal of healing that takes place when they know the guilty person is the real guilty person and is punished accordingly.

Some recent false claims may have occurred at that religious ranch in Texas, and a few years ago, at a day care center. Fortunately, most investigators and prosecutors uncover false accusations, but not always. That leaves only one line of defense for the innocent, namely their defense lawyer, who will be forced to use a tough line of questioning.

There is absolutely NO evidence that he was referring to the issue of the victim testifying in open court.  NONE!  He was simply saying "Hey, if you do not allow me to plea bargain this down to a an acceptable (To him) level, I can going to eviscerate an innocent on the stand.

And from the recent hisotry of his state, acceptable punishment is time served or "stamping his ID card no desert" as we say in the Army.

I believe in the separation of powers found in the US Constitution.  Specific sentences should be up to the judge or jury as pre- and pro-scribed by law.  Mandatory sentencing - talk about Congressional interference! - remains a very poor idea.  For, among other reasons, it is un-Constitutional.

The current mania for putting more and more people in prison just doesn't seem to be working, now does it?  California built more than a dozen prisons without building a single new college or university.  That seems backwards to me.  We have in prison more of our own citizens than any other Western nation - but we don't seem to be any safer. 

As for capital punishment, there are plenty of bloodthirsty paper vigilantes around NB to keep you company.  I'll pass on joining that mob.

The only change is the speeded up appeals process which is even MORE in keeping with the constitution than the current model in which an attourney is given decades to preapre the most trivial of cases.  Failure of speedy trial as it were.  All the while justice is not served.

Nope, modern technology can allow the defending attourney to make his case to all levels of the appeals process simultaneously and speed the process to regain constitutionality.

Lets face it, nearly all appeals in capital cases are simply rehashes of failed attempts int he past anyway.  And the attourneys set up the trials to allow appealable issues ANYWAY, so lets just get on with it.

As for the "fact" that more persons are incarcerated in the U.S. than in any other nation. IMHO the fact that in this country narciscism, sociopathology and non-conformism seem to be highly regarded and rewarded in this country. Throw in an inflated sense of entitlement, victimology, me firstism, and "How dare anyone tell me what to do" and the incarceration rate is explainable. In other words it may just be a cultural thing and have nothing to do with the amount of punishment.

All of the soldiers at Hood were conforted by the fact that we expected the US Military to swiftly execute him due to the fact that our military court system works with greater dispatch than the civilian sector.

Fast forward twenty years and he is still on death row much to our disgust.  The legal system has let us down.

that the lib blogs like huffington and daily kos would accept conservative comments?  From posts I've seen there, any conservative comment was met with profanity and name calling.

Since you don't appear to be impressed with NB and it's posters, why do you continue to come back?  Is it some attention thing?
