Democratic Politician Promises to 'Rip Apart' Child Rape Victims; MSM Silent

If an elected official in the United States, at any level, promises to "rip apart" six year old rape victims, then describe in vivid detail how their lives would be ruined, one would assume such a statement would lead the news. But it did not.

Following up on D.S. Hubes post on the local media coverage, Massachusetts State Representative James Fagan (D) voiced his opposition to Jessica’s law requiring stiff mandatory sentences to child rapists. As a defense attorney, Fagan promised if such a law were in place and victims assume the stand "I’m gonna rip them apart." Fagan continued "I’m going to make sure that the rest of their life is ruined, that when they’re 8 years old, they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody."

Despite such inflammatory rhetoric, Fox News was the only major news site to cover it. All of the other major news sites, CNN, ABC News, and CBS News, opted instead to cover for Mr. Fagan. The search on MSNBC displayed a brief blurb of the controversy, but no correct link that leads to an article.

Why do the crickets chirp for such a story? Could it be that this state assemblyman is a Democrat? Are they more concerned about protecting Democrats than they are young children? Would this make the headlines if a Republican politician said such a remark?

Former Congressman Mark Foley (R-FL) became a household name, and arguably sealed the Republicans’ fate in 2006, largely because, as the Media Research Center documented, the mainstream media endlessly covered his creepy instant messages to House pages. Although sexually explicit conversations to 16 and 17 year olds is indefensible and warrants extensive coverage, should a pledge to "rip apart"  six year olds deserve at least some attention?

I guess the media only really cares about the "children" we send off to battle in Iraq. But the 6 and 12 year olds getting raped are adult enough to handle this.

I live in a part of the country that has a lot of vigilante history to it. From the stories I have heard, most of the bad guys that had justice handed to them one fist at a time deserved it. It's one of the reasons I like this area. (can't wait until all our lib friends see this post)

Anyway, not too long ago a guy convicted of molesting a child moved into our area. When this guys dirty little secret got out, a few locals paid a visit to him. There was no violence, but they made it clear that if he get's caught anywhere near a child in our county he would end up at the bottom of one of our thousand or so mine shafts in the area. I was not involved, but heard enough from neighbors to believe it.

He moved a few weeks later. Chalk one up for the good guys!

There's another read

on Mr. Fagan's comments.  The post states he opposes the mandatory sentencing law.  Perhaps - based on his defense attorney experience - he is attempting to tell his fellow legislators what the victims can expect to experience if this law is passed and enforced and they must take the stand.

In other words, are they so anxious to create a system that will victimize the victims again?

The "what if?" scenario is NB's stock in trade.  It's included in both the posts and comments on this very topic. 

The way to find out, of course, would be to call Mr. Fagan up and ask him.  Based on the two NB posts, however, no one has bothered to do that yet.

But it would explain why this story hasn't been covered elsewhere.  Maybe...it isn't...a story...

If it were any other night I might have gone off on him myself. There is nothing more cowardly than someone who would condone another coward that is willing to destroy a child so they win their case. If all attorneys felt this way, we would have a lot of dead attorneys on our hands.

As adults, as parents, and even as grandparents it is our duty to protect the children in every way possible. We are responsible to make sure they do not come to physical and/or psychological harm in any way. As I stated a couple of weeks ago... If I have to temporarily ignore our Constitution, or break one of our laws, to protect a child from harm, so be it. My (our) first responsibility is to the children!

You really aren't very bright, are you?  Nobody is condoning a coward.  Mr. Fagan is trying to make the point that a seriously misguided law will do far more harm than good.  Certainly as a card-carrying right wing nut you are intimately familiar with unintended consequences from hasty legislation?

How you jump from that to tearing up the Constitution to protect a child isn't a reach or a stretch - it's flat out stupid.  See, I actually believe in the Constitution and have faith in our system.  It doesn't scare me that we have judges and juries and courts and laws and attorneys - yes, attorneys.  The next time you are in a legal battle go ahead and defend yourself.  Good luck with that!

And if you wish to protect a child phychologically, it's my free advice that you keep him or her off the witness stand in court until they are an adult.

Frank, I think we can all agree that Mr. Fagan has done a great job of making his point. We are just arguing over what the point was that he made. Some people find the tactics of criminal lawyers detestable, while others fail to find them reproachable.

First of all, I think it is reprehensible to make this a political issue.  I'm certainly not surprised by that - particularly since this is, after all, NB.

“It was not my intent to demean or offend any victims,” state Rep. James H. Fagan (D-Taunton) told the Herald. “I understand it was strong language, but it was meant to be a demonstration of what a bad place court can be.”

Fagan, a defense attorney, infuriated victims’ rights groups with his fiery speech on the House floor against Jessica’s Law, which would set a mandatory 20-year sentence for child rapists. Among those outraged by Fagan’s comments is Mark Lunsford, whose daughter Jessica was raped and murdered by a serial perv in Florida, inspiring the law now in place in 42 states.

“He doesn’t owe me an apology, and I don’t want him to think he does. What this guy is saying is true, a defense attorney will rip you apart,” Lunsford said yesterday at the State House, where he urged lawmakers to toughen child protection laws. “He just added insult to injury.”

Lunsford said Fagan’s tirade on the House floor is even more shocking because it’s true.

“The truth is a defense attorney will tear these children apart. That’s his job, but we have more of an obligation to people than to defense attorneys,” he said. “I won’t judge him because I don’t live here, but my grandmother always said to think before you speak.”

And that justifies his statement how? There are other ways of achieving satire or sarcasm without resorting to such tactics, if they can be called tactics.

I don't think Mr. Fagan was striving for satire or sarcasm.  Nor is he falling back on the Ole BlunderRush/Ann Falter defense - "it was just a joke!"  He was trying to make a point to his colleagues before they voted on a bill that would be a huge mistake.  Now, you may not agree with his tactics - but it is only fair to strive to first understand why he said what he said.

Nope, it is not, but I would never allow anyone to do that to my child.  I don't care if it is a judge, an attourney, or a rapist.  I would hunt them down and kill them.  Seriously.  I could care less what my sentence would be. My children are under my authority and protection and I will not allow anyone to rape them literally or figuratively.

The great difficulty in prosecuting rape cases is that most of the time there is no witness - only a victim.  Our legal system generally requires the testimony of more than one individual to convict another individual - I'm sure you've heard of "it's my word against him."  One exception is police officers.  As sworn officers of the court, by law their testimony carries more weight than a citizen's.  That's why motorists lose in traffic courts.

Prosecuting child rapists, therefore, becomes even more problematic.  It is my suggestion that Mr. Fagan was attempting to point out the severe risks - unintended consequences, if you will - of a mandatory sentencing law.  I think what was probably missing from his quoted statements was the beginning "If I were the defense attorney in such a case I'd..."  And then he clearly got carried away.

The important underlying issue, however, is turning these statements into partisan political fodder.  I think it is reprehensible to attempt to make child rape a Republican vs. Democratic issue.

J Frank Wilson has no clue

This is BIG news in Massachusetts.

This congressman was on the air, on the radio with two of the most liberal radio show hosts in the city of boston.

They tore this guy apart and basically called him a slimy nutball when the 20 minute interview was over.

 This Fagan guy was an unapologetic trial lawyer who believes that it is his DUTY as a lawyer to be a disgusting, slimy human being.

one of the interviewers was a trial news reporter and stated there was not ONE case where a trial lawyer haranged an 8 year old rape victim and challenged Fagan to do the same and he COULDN'T do it.  It was a horrible hypothetical in order to make life easier for trial lawyers.

These hypotheticals are common to liberals like:  Outlaw abortion and woman die, even though NOT ONE Case of a late term abortion being needed for the life of the mother.

 Fagan not only refused to apologize but wants judges to be free to let rapists go and commit other rapes rather than enforce mandatory sentences which have been shown to work to keep these people off the streets.

 The reason this hasn't been covered is obvious.  I do think though that in the next couple days this story might start getting around, but not likely.

You miss the point entirely. This is about MANDATORY sentencing. The current system IS BROKEN because child molesters are routinely released early after 'therapy' to victimize children again and again. What do you think the recidivism rate for molesters is? It's higher than any other crime including rape. 10%, 20%, 50%, pick a number.

But according to the Moonbat Value System of Right & Wrong, it's better to have thousands more molestations than one 'innocent' criminal do 20 years.

OK, yes, I get it.  If a Republican had attempted to make a point emphatically by saying that passage of this law would give impetus to defense attorneys to attack the victims on the witness stand, the media would have likely covered it more and included the Republican tag when doing so.   

I'm for the law, don't have a problem with capital punishment for child rapists, and applaud Governor Jindal for what he just did. But good grief, for anyone to not acknowledge or realize that this is the point this guy was trying to make is pathetic, and it's either just blind ideology or pure stupidity.  I would expect to see this at Kos or D.U.

I propose that legislation be passed that when a defense lawyer wins a case for a defendant, and if this defendant  commits another crime (especially if it is a repeat offense), then the defense lawyer should be charged with accessory to the crime.  But that won't happen so at the very least, hit them where it really hurts---a very hefty fine!  In addition, lawyers who use this type of tactic of attacking witnesses and victims should also be penalized and open to lawsuits as well.

Since morals and ethics are being thrown out the window, then accountability needs to be placed by law.

I was scanning through the channels yesterday and Dan Abrams was interviewing that Massachusetts State Representative Fagan.  I watched the interview briefly, since I can’t take much of Abrams or MSNBC. Abrams did appear to take a tough stance with Fagan’s outrageous remarks, and asked Fagan if he was planning to apologize.

Fagan's logic is full of holes

Even assuming that Fagan was trying to be shocking just to make a point (and isn't just evil - which is more likely), his logic is faulty.  It assumes that scumbag lawyers wouldn't go after the kids anyway, even if the molester was only facing 3-5 years instead of 20-30 (or the death penalty).  They would, and do.

Or would Fagan prefer that child rape be legal - just to keep all nasty lawyers away from children seeking justice for the serious harm done to them?

Flagan is a criminal

Flagan is a criminal defense lawyer. He was pandering to the cirminal element, telling them, if they are arrested for child rape, he is their guy to defend them.

In  reality, if a the defense did do such a thing, the jury would not like it one bit. He could almost guarantee the conviction with such antics. I fear to say, guilty or not, his client is going to jail.

This was the point Greta Van Susteren and two other criminal defense attorneys made when they discussed this moron's rantings.  Any defense attorney who "tears apart" a small child on the stand is going to LOSE.  You think a jury would like seeing that?  No way.  The judge wouldn't let it happen and neither would the DDA.  You cannot badger a witness.

All this creep has done is made himself one of the most hated people in America and hopefully, it will be the end his legislative career.

Thoughts about Jessica's Law

Let me state first that I believe child molesters have no right to live, they should take them outback the courthouse and shot.

That being said, will Jessica's Law benefit society as a whole? Yes it will mean longer prison sentences for offenders, but, at what cost to our kids. Unfortunately, there is no system in place to protect our children in court. We hope and pray the prosecutors and judges will maintain some decorum and not allow defense attorney's to prey on them. As stated under our Constitution, the accused has the right to face their accusers.

We constantly see rape victims of legal age assaulted by defense attorneys. They prey on their background, dress, informal relations. They are made to feel less than fourth class citizens. They barely speak out and when they do, they are the ones put on trial.

As for the moron, better know as James Fagan. This sub-human should be shunned by society. His background is to prey on victims to get his paying clients off. While admitted that most defense attorneys would not go the route of Fagan (jurors would be sickened and his client would receive a rather lengthy sentenced) he does believe this way and it shows.

Maybe it's time to review the system and look at ways to protect our children should they have to testify or appear in court. Until then we are screwed.

Once again, Newsbusters is right on.     On your average day, CNN and MSNBC devote hours of coverage to the Massachusetts state house with their endless resources, but they chose to ignore this story.   Liberal commies!  

What is amusing is the bias used in claiming bias about this story.   Everyone leads with "Rip apart" rape victims.   It creates a visual that people like newsbusters want, but doesn't really echo the comment in context.  

I can see what Mr. Fagin is driving at, essentially that a manditory law means that he's going to more vigorously defend his clients since his options for pleas will be less.  And this will potentially be at the kid's expense.   They were stupid comments to make, and not politically correct, but does anyone here doubt that what he said is TRUE?    

The fact that Mr. Fagin's Democrat has nothing to do with this.  Quite simply, the SCLM doesn't have the money or resources to cover everything said in state legislatures.   

 Comparing this to the Mark Foley story is also ridiculous.  Mark Foley served in the UNITED STATES HOUSE OF REPRESENTATIVES, and  was hitting on young people!    But I can understand how it helps you slant your story to portray a media bias that really never existed in the first place.
