Levin Declares 'No Constitutional Authority' for Expanded Obama Administration Takeover Powers

Has the federal government exceeded, or is it on the verge of exceeding its constitutional authority with the recent series of events connected to rescuing an ailing banking system?

Although Rep. Michele Bachmann, R-Minn., was ridiculed for raising that question in a congressional hearing on March 24, conservative talk show host, constitutional lawyer and legal commentator Mark Levin, told Fox News Channel's "Your World with Neil Cavuto" on March 24 that government was indeed exceeding the constitution. According to Levin, there is nothing in the Constitution that would allow the Obama administration to expand the government's ability to seize non-banking financial institutions as Treasury Secretary Timothy Geithner has proposed.

"It's unbelievable," Levin said. "There is no constitutional authority for this. I thought the American people like capitalism. I mean look, we luxuriated in this society as a result of the market system."

Levin, former chief of staff for Attorney General Edwin Meese currently has the bestselling book on Amazon.com, "Liberty and Tyranny: A Conservative Manifesto." He remarked the public was expected to put their trust in a Treasury head that has made some questionable decisions about his own personal finances. 

"Now we have a guy that couldn't remember to pay his social security taxes, couldn't remember to pay his Medicare taxes, even though he was subsidized to pay them, told to pay them," Levin said. "He's smarter than everybody else in all these industries, and now we have another czar."

The appointing of czars, he said, has been a trend according to that doesn't comply with the powers set forth in the founding document,

"We have an administration full of czars, full of people who don't comply with the constitution. The question today is, ‘What is your authority, Mr. Secretary, to do this?'" Levin said. "I would like to know what's the president's authority to do this?"

The Obama administration and its proponents say that a lack of government involvement in financial sector is what caused the current woes of the economy, specifically the banking system. Levin insisted it was just the opposite - that the banking system was never a "free market" and that's how it got to this point.

"The problem is, we didn't have a free market in the banking system," he explained. "The banking system is the most regulated system next to the automobile industry. So there is no free market in the banking system. It is heavily regulated. We know about all these toxic loans thanks to Uncle Sam - pushing them as fast as they could, bundling them, encouraging the free market to respond with all kinds of packages and then they pretend it's something wrong with the free market."

Levin labeled advocates of the Obama agenda as "statist," explaining that it is part of their desire to control every aspect of certain segments of the U.S. economy.

"That's the way the statist operates and that's what I explain here," Levin said. "There are no limits on our government today. They've close to nationalize the automobile industry. Frankly, they basically nationalized the steel industry. They control the labor unions in giving them the authority that they give them. They control the products that are produced. They control what comes out of the chimney. They control what goes into the chimney. Now they want to control executive pay and they're not going to limit it to bailed out companies."

I was thinking

 A little pet peeve of mine is being called an Independent,or even a Libertarian. I do not agree with many Independents on a variety of subjects, so it bothers me sometimes to be group together with them. I was thinking of checking to see if I can write in a Party, anyone know about this?
Anyway, If I am able, I am going to call myself a Constitution, as in the Party of Constitution's, using the plural, and the singular only.

 This party mission will be to uphold and defend the Constitution of the USA. Their will Not be any Dem Constitution's or Repub Constitutions,,,,only Constitutional Dems or Repubs. You cannot use that term if you do not fight to uphold and defend it. Requiring your Party leaders to uphold the Constitution of the USA will make what is happening today less likely, maybe impossible.

Earlier today I linked Bachman's questions to Geithner and Bernanke during yesterday's subcommittee hearings.  It's a youtube clip in which she extracts an emphatic renunciation from both of them concerning a global currency.

I may have it backwards, but she said on Hannity's show that in one hearing, the first of two I believe, they renounced such an idea, but then in another hearing Geithner said he was 'open' to the idea.

In any case, Geithner, being the habitual liar that he is, I believe that the Obamanation is indeed interested in such an idea as Bachman suggested.

but one thing about him, he knows his stuff. The man is super sharp, and I agree with him 100% on this being a position held by those who consider themselves "statist." As Levin said tonight on his radio show, we are now at war.

Statists and Marxists like Obama versus the rest of us who actually believe in freedom, individual and corporate. Who believe what the Founding Fathers did in creating America. Who believe in free-market capitalism.

The statists/Marxists have turned the law and their power in Congress against Americans, including even those who voted for Obama.

Given the advocacy/adversary media's traitorous actions and given the unrestrained power-lust-driven actions of the Demockacrats/Dementocrats, who can argue with Levin?

BTW: That war is not just societal, it's economic, it's cultural, it's religious--it's full-out against our entire history.

But as Levin said, and something with which I agree, millions will arise against these statists/Marxists.

Even Michele Bachmann spoke of revolution today while speaking by telephone to Sean Hannity on his radio show this afternoon.

The statists/Marxists have initiated the Second American Revolution.

Whether it's peaceful or not remains to be seen.

But the backlash has begun. And it will not cease.

Revolution or secession?

Hannity seems to believe that, lets say, a significant numberof people that voted for Obama were somehow duped and are only now realizing their error. However, I think that while there may be some coming to this realization, I'm betting that the majority of them are content with their choice and the potential benefits, real or imagined, of being a ward of the State.

So, contrary to his argument that we can somehow reason with these loons about the impending danger to the Republic, I think that a Revolution or secession en masse are the only realistic options left.

Radio show a couple of weeks ago, that we should give the left half of the Country. Any way they want to split it they can pick any 25 states they want, because we would reown it in no time. He may be a liberal, but I have always sensed it is more of the "classical" variety than the "modern" variety.

There is a HUGE difference between the two, which is lost on many today.

Jer and I may disagree on much, but I have yet to see him post anything here at NB that even presumes to wish for the demise of our country. I cannot say the same for many I have encountered here over the last three years.

Besides, Jer usually usually asks very good questions. Sadly, many here don't bother to take the time to answer them without giving him a ration of sh*t in the process.

Look, you are well aware of what was going on in the 90's:  A relentless Clinton-hating Republican congress was launching a new investigation every time he or Hillary sneezed.  If there had been material, credible evidence of IRS abuse by Clinton, it would have been made a prominent element of the subsequent impeachment proceedings, and, frankly would have been far more likely to have produced a conviction than did the Lewinsky related charges.

Not necessarily in defense of Mark Levin since I don't know that much about him but how does one equate mediocrity to someone who is a successful writer of books and lecturer when so many people were contorting themselves into pretzel logic to equate a successful autobiographer and inexperienced politician with no real accomplishments into one of the greatest presidential candidates of all time. Now these same people are continuing to ‘bend the graph’ in order to project the actions, not to be confused with accomplishments, of President Obama into greatness.
It seems to me that the bar for greatness is low enough that someone with a long career of successful accomplishments would easy hurdle the bar set by so many today.

There's no Constitutional Authority to declare god as part of government, but that doesn't stop Levin from trying to take ownership of the nation by invoking such subjective idealism onto it.

Levin does not understand liberty and freedom if he is making invocations that the nation must follow deep religious philosophy to the exclusion of any one else's "beliefs". 

You're inherently NOT FREE when you are bound to a dogma, indoctrination or any other source outside yourself which creates limits.

You can argue, "Well what about the Constitution and the bounds of that?"  - the Constitution seeks FREEDOM not the limiting of CHOICE of the individual human being.  Changes to the Constitution with regard to women's right to vote and slavery are...CREATING FREEDOM

I am no advocate for religion in anything but there is a huge difference between the acknowledgement of religious tenets being infused into the government and supporting the use of religion as a part of government.
There is a difference between the acknowledgement of religion as part of the founding of our nation and the acceptance that we must be ruled by God.
There is also a difference between someone saying that they believe we would all be better off if we followed a preferred god and that person saying governing rules should change in order to follow said god. While I won’t speak for Mark Levin most religious conservatives speak to the acknowledgement of religion in the founding of our nation and its laws. They also speak as believers in their faith and its ability to make the world better but never have I heard one say that the laws of the nation should be changed to advocate for God.

There is a difference between personal freedom and societal freedom. Personal freedom allows you to govern yourself. Societal freedom allows you to govern yourself within the boundaries of acceptable societal norms. If you personal choice is to opt to follow a religion you are free to do so and no less free regardless of the restrictions placed on you by the religion – You made the choice to follow that religion. This is not true in all nations and to a certain degree you could say the family and peer pressure makes this difficult in the US but that would be admitting that it is societal pressure not personal choice that is influencing your decisions. If you make the decision to not follow a religion that is also a choice but you still have not left the society and are still bound by the acceptable societal norms.
