Duke Rape Case: Cable News Networks Air Pornography in the Afternoon

I was driving to the gym with my thirteen-year-old daughter on Friday, and as I searched for some conservative news talk on the radio, I came across the press conference concerning the Duke lacrosse rape case. Out of curiosity, I left it on, and heard one of the attorneys graphically describe sexual acts that would have made Linda Lovelace blush. Realizing my daughter was in the car, I quickly turned the radio off.

According to a number of sources on the Internet, as well as transcripts now available, several cable news networks broadcast this press conference live for all of America to hear the pornography. According to NBC’s Brian Williams: “Three cable news networks took the defense attorney's news conference live, and the language, dealing with sex acts and body parts, was unbelievable. I couldn't help but think of the daytime TV audience during what one of the attorneys almost comically went on to describe as ‘this wonderful season of the year.’"

So, for the record, we counted the number of times each sex act and body part was mentioned, according to CNN's transcript of its 3pm hour. "Penis" was the most common word, with 14 utterances. Click continued for the rest...

Wow! Good thing the FCC went-after Howard Stern with huge fines & made an example of him by chasing him off to Sirius! I'm sure glad my taxes get spent every year on an important government agency like the FCC, it just warms my heart how unbiased & impartial they are. In fact, I'd think the government should spend even more to solve this problem, but -- oh yeah -- Noel hit my favorite button.

Ditto on the Christmas cheer (I suggest a patriotic dose of real George Washington eggnog, actually, and Myers rum along with premium milk/cream works best!). Just curious, but is the word "rape" not among the objectionable words for kids also? (And what's so-damn-wrong with "mouth" anyway?) I sure don't discuss the subject with kids I know when I'm around 'em, but I'm neither a parent or an expert. Also, do you know if there's a chance we can maybe see recent comments again instead of the masthead, which tends not to change? Thanks if possible.

Thanks for that Eggnog recipe. I'm really going to try it. I've never had fresh nog, and quite imagine it tastes different than what one buys in the store.

Myers rum? Puuuuhleeze. Might as well use crick water. Try some Cruzan's Black Strap or (at a minimum) Gosling's Black Seal. Although not as (ahem) hearty as rum was way back then, they are close cousins to what George had on hand. Aside from that, did you see what they list as one serving? Sheesh, 20 oz. of that concoction and you will gain two pounds while falling down the steps.

Considering the distilling

Considering the distilling methods, I think Myers' raw rummy strength & Jamaican origin gives the most authentic flavor, Gosling's is probably higher quality than they could get (and it costs too much for this, concentrate quality-costs on the dairy ingredients & good quality fresh eggs, since they're going to be consumed raw!) but that's my favorite 151. The real PITA is going out & actually finding rye, but it's needed to be authentic, don't go substituting scotch or JD or some random brew. And the rest of you can't get Gustafson milk, which sucks for you. Also, be warned, the stuff gets FAR better as it ages, making it a very dangerous concoction...And you're right, calorie-wise its a meal in a glass. Also, that recipe's not kidding when they say "drop by drop," at first you're in danger of cooking your eggs with your rum.

BTW, the best rum on the planet is IMO the Ron Zacapa Centenario, and compared to snooty-priced scotches of any sort it's a great deal at about $30 or so a bottle. It's way too good for using in eggnog though, it needs to be enjoyed on the rocks with a tiny splash of soda & a good cigar. Ron Zacapa tastes even better than the best "unobtainable" Cuban rums.

This place is fabulous.  I've never tried their mail order...but if it matches the rest of their customer service, I'd recommend it to any and all for the best fresh seafood to be had....anywhere (well, unless one hauls it out of the ocean oneself).

Adults sometimes show great nievitey. If your child goes to public school where children hear all the profanity the human  ear can precieve. If you went to school you should already know this. Keeping a child isolated from these terms is an exercize in futility. The truth is there are no dirty words. Only people make words profane! Making a big deal of it only cements the phrase in the childs mind.

FCC Standards

According to the FCC hearing this week on CSPAN this is considered protected speech since it is during a news conference. Having watched it from beginning to end, I will tell you that CourtTV kept putting up ADULT CONTENT warnings on the screen.

On the otherhand, for Mr. Cheshire to have made his point, which he did very well, he needed to use the terms repeatedly. He was reading from transcripts prepared about statements the accuser had made. The shock was that now she supposedly could not remember anyone using a penis. Mr. Cheshire was rightly enraged. His was a righteous anger and so were all of the commentators on CourtTV.

I think your anger should be directed at Mr. Nifong, whose actions were the cause of this news conference.

Actually, did you see that C-SPAN clip earlier in the week concerning vulgarity on television? Kind of hypocritical, no?

As for what happened yesterday, I very much understand what the defense was doing. The question is whether once the content was made apparent, might it have been better for the cable networks to break away from the live coverage in order to edit it and create a less vulgar presentation later? I'm not sure what the answer is, but raise it for discussion. Make sense?  ns

Court case

I did happen to watch the court case on C-SPAN and this instance falls under the "news" category. Remember them talking about if Nicole Richie said in on the Emmys it was offensive, but if they played it that night on the news, it was a protected category.

One of the protections against "pornography" is that it have "redeeming social value." The statements by Cheshire had "redeeming social value." It showed what an idiot Nifong was and how weak the case was. And it was important that people realize the point he was making. The commentator on CourtTV (a former prosecutor) thought it was the best presentation by a defense attorney she had heard in years. Had they cleaned it up, it would not have made the point he was trying to make

Anecdotalology

As am I Noel.......here comes the but part.  First I will apologize in advance for the length but you should find the story interesting.  Now, let's give credit where credit is due. It just so happens that one of my daughters (seventeen at the time) about ten years ago was invited to spend an overnighter at a female friends parent's house.  The parents were away for that weekend.  A small party ensued.  Sometime around midnight all the guests were asked to leave and did. My daughter and her friend retired to separate bedrooms.

Around two o'clock in the morning one of the guests decided to return univited. He slid under the partially opened garage door and entered the house through an unlocked door which led to the garage.  He made his way up the stairs and into the room my daughter was sleeping in.  She awoke to the intruder straddling her while choking her with his hands. She managed somehow to fight back and the noise awoke her friend who ran to the room and saw the assault.  She screamed and the intruder jumped up and ran out.  My wife and I got the call from the police and paramedics around three o'clock that morning.

Later that morning the intruder was arrested by the police and plead not guilty before the magistrate. Our lives for the next six months were disrupted by visits to the DA, avoiding the press (turns out the intruder's grandfather happened to be on the city council of the city in which the incident occurred) and other hassles associated with going to court.  The court date came and we were not surprised to see the young intruder's parents had obtained Joe Cheshire as council for the defense.

Now it was fairly obvious to even the lamest lib in the court room that the intruder was guilty - abundant physical evidence (the intruder's handprint in my daughter's blood on the wall, etc) and two eye-witnesses (including my daughter). So the only defense Joe could offer was to impeach the character of the witnesses - my daughter and her friend. I had to sit there and listen to this crap.  Imagine everything you heard before turning off your car radio the other day and then imagine it is in a courtroom and all the sexual references are being directed at "your" daughter.  There was no radio knob to turn Joe off. 

Bottom line - Some might just say Joe was doing his job but in fact, Joe Cheshire is a sleaze just like Nifong.  Just as it was not necessary to attempt to impugn my daughter's character on the stand to the degree which was applied, it was not necessary for Joe to bring up the sensational details in the press conference you referenced to such a degree.  It is just Joe's "style".

Interesting enough Joe has a daughter and I asked him in post-verdict comments how he would feel if he got that call at three in the morning.  How he would feel if someone was trying to free the assaulter of his daughter by attempting to destroy his daughter's character in court.  First time I have ever seen Joe with nothing to say.

Noel, you are quite correct in your assessment of Joe Cheshire and Mike Nifong.  There is a time and place for everything - but not in Joe and Mike's world. They are all too aware that our culture drinks at the fountain of sleaze and is more than willing to give the world what the world desires (for personal profit of course).  Joe did not care about my daughter, does not care about your daughter and apparently does not even care about his own daughter.  Much like the rest of our "progressive" culture, Joe only cares about Joe.  It should come as no suprise that both Mike and Joe are Democrats.

So when our moral superior trolls come on here pontificating about the supposed conservative culture of corruption who is really at fault?  The conservatives that at least desire living a virtuous life (though we all fall at times), the Joe Cheshires and Mike Nifongs of the world that for personal gain, take advantage of a culture apparently in need of their daily fix of sleaze from the media or the "progressive" culture that breeds, nurtures and encourages sleaze?

We talk so much about the "reason for the season" but do we live it?  Oh sure, the slaughter of the innocents in Bethlehem get's our attention but what about the birth of Virtue, Righteousnous and Humbleness?  Our "progressive" culture not only accepts but champions our modern day slaughter of the innocents as some sort of "right".  Virtue, righteousness, humility?  No, that is met with humiliation.  We get the "Merry" part.  It's just that pesky "Christ"mas part.  Noel's daughter, like all daughters deserves to have their innocence protected as long as possible.  Obviously we can't depend on self-serving attorneys, the sleaze-sells media or the "progressive" village to do the job.  Sometimes fathers are not allowed a radio knob to silence the assault.  At times like that it is worthwhile to remember the "reason" and the "season" are omnipresent, if our culture, much like two thousand years ago, would only find room for Him.

Thanks Noel.  Sorry to get back to you so late.  I had to run up to the Church for rehearsal (I know, I know, playing Christmas music on a Fender Strat - what can I say, it's part of my penance :) ) for midnight Mass.

No I haven't considered that (op-ed) Noel.  The problem I have is that this time I find myself rooting for Joe (actually the 3 Duke students or justice if you will).  Also, I understand that Joe was merely up against the wall trying to defend the indefensible in my daughter's case.  As I further stated in my courtroom remarks, there was really no need for the case to proceed if the young man had just owned up in the beginning to what he had done.  Granted, Joe did not have to take the case but if he had not another attorney would have and the defense (trashing the witnesses) would have been the same - it's all they had.

I guess my beef is more with the "perp" than with the attorneys.  However, it is troubling that Cheshire has no problem defending a would-be raper and then turning around and defending someone wrongly accused of rape.

That said, if you know someone that could find this anecdotal treatment of some value, I have no problem with a like-minded person using the story.  Sadly, it is all true and a matter of court record.  However, I would prefer that this story be used by parents to help instruct their children of what can happen in similar circumstances.  Maybe if the girls had not invited male guests over in the first place that night, maybe if they had remember to lock the garage door, etc.

As for myself, I avoid the media like the plague.  As far as I am concerned, talking to the media is like cavorting with the enemy.  I had no desire to speak to the media at the time and I don't today - concerning anything, op-ed or not.

More importantly, I'll definitely pass along your hug to Rach.  She has gotten a lot of them after that dark night.....  Thanks, Noel.  I still stand by my comment about a year ago that your daughter has got to be one of the luckiest children in the world to have a Dad like you.  Seems like I read somewhere that the most important person in a young female teenager's life is her Dad. Simple little things like driving her to the gym are such a big deal to daughters.  I never really realized it when Rach was that age but we were reminiscing last night and I was amazed at the seemingly little things that were/are important to her that I considered insignificant (just doing my job as Dad) at the time.  Obviously, these seemingly little things mean the world to them.  Whose your daddy? BTW - Rach fully recovered, went on to graduate with honors from UNC, is the newly appointed CEO of our succesful little S-Corp and is now engaged to be married.  Nothing like a happy ending on Christmas eve :)

I agree and my anger is directed at Nifong.  This guy should be brought up on charges.  And the fact that this case is baseless should have had ALL the charges dropped.

Three innocent men have had their lives besmirched by lies from a stripper who they refuse to name.  Now that she has retracted her story, it is HIGH TIME that her name and picture be made available to us. 

She and the Prosecutor have ruined these young men's lives; their character has been impugned and they are entitled to damages, but they will forever be linked to this and it will always stain them.

Justice has not been served until her name and picture is made public, and she and Nifong face charges.

This case will be historically recorded as a most egriguous miscarriage of justice. Prosecutorial misconduct in the clinical sense. Absolute incompetence.

If there needs to be a precedent for establishing legal provisions for taking government to court for civil or criminal malfeasance, no case could provide greater illumination.

I didn't see much of the news conference, heard bits and pieces later, but there is no surprise anymore about the graphic detail in anything at all over the air-waves for me....

All I want is Nifong to do some serious time, never be able to practice law again, and the so-called victim to be not far behind him...she has done this before, made false accusations, and to listen to the ambulance chasing media whore Gloria Allred she is just a victim.... yeah right, when pigs fly.

This witch has made it a terrible problem for women who are really raped for years to come, and to think Allred and her equally ugly (inside and out IMHO) daughter are NOW women! As Rush says...Femi-Nazi...they and all their ilk should be horse-whipped, they have aided and abetted in the destruction of this country.

That's funny. Culling the refuse from Media Matters (funded by the "Democracy Alliance" run by ex-Clintonista Rob Stein and one of the big contributors? George Soros) to dispel the myth of "liberal media bias". Notice how our comrade cannot bring up a news reporter or news caster, but only radio/tv talk show hosts/pundits?

This is another good example of why the left just does not get it: the nightly NEWS is not supposed to be a OPINION show. Well, what I think you're missing here -- and I must say that such a mistake is quite commonly made by folks on the left -- is that when I turn on Rush, Mike, Sean, or John, I know that I'm listening to a conservative talk show host. And, guess what -- so does my thirteen-year-old daughter. As such, she understands that this is someone's opinion, and that this person is being paid a considerable sum of money to say potentially inflammatory and intentionally controversial things to attract and entertain an audience. Oddly, my thirteen-year-old daughter gets this. Why don't you and your media outlet of choice?  :-)

Speaking of Media Matters, in another thread, you mentioned that you've never seen anyone successfully refute one of their articles. Why should anyone? After all, if there was a website and organization dedicated to proving that the sun rises in the west and sets in the east, how much time should an intelligent person spend trying to contest such an inanity?

Many liberal members of the media admit that the media is in general biased to the left. Any person of modest intellect and impartiality must certainly come to such a conclusion. Yet, you wish for those of us with an above room temperature intelligence quotient to spend time debating with folks so unbelievably biased that they actually believe and write about Chris Matthews, Wolf Blitzer, Katie Couric, Brian Williams, and Charlie Gibson as being conservatively biased? Excuse me, but I've got more important and beneficial things to do than debate whether one plus one equals two, and, once again, am shocked that anybody would come to this website with a straight face referencing the non sequiturs of that organization.

The reality that seems lost upon much of the cadre left is that liberals sometimes say conservative things. After 9/11, many liberal commentators were talking about what a fabulous job Bush had done after the attacks. This even included Eleanor Clift. Did that make her conservative? When Pat Buchanan speaks ill of Bush, does that make him a liberal? Yet, if Wolf Blitzer says anything positive about the president or a Republican, MM and the goose-stepping left (not a Nazi reference FYI) will bang the tom toms using the incident to prove that Blitzer and CNN are conservative.

Why do you folks like you believe that impartiality in the news means always beating on Republicans and praising Democrats? If an anchor spends 99 percent of his time beating on Republicans while praising Democrats, and one percent vice versa, the braindead left sees this as evidence of conservative bias. BTW - This is the modus operandi of that group you consider to be a media outlet, and you wonder why people like me ignore them?

You know, Dave, I've seen Yankee fans applaud good plays by Red Sox fielders. Maybe the MM folks ought to start a website dedicated to proving that people in the Bronx are closet Saux fans.

Hate to break it to you Noel, but at 13, your daughter is more likely to have been exposed to sex talk and such more than she has political talk. I know, you're probably thinking, "not MY little girl." Of course not, because she'd tell you, right? Wake up, girls and boys have been deceiving their parents about sex for ages, and it seems to happen younger with each generation.

I'm not sure where your story is placing the blame in this instance,
with the conservative station that didn't warn listeners, with the
networks that broadcast the press conference, or with attorney who gave
the press conference. Given that your lead mentions your daughter it seems that you feel insecure about being able to protect your child from the nasty things in the world as she enters her teenage years, which is natural. You turned the channel, which all parents should. Many parents forget that were're responsible for what our kids are exposed to, as difficult as that is. The only alternative is for the government to get involved... although, in this case, none of the words mentioned fall under the FCCs definition of obscenity.  It ultimately comes down to mom and dad.

I gather from Noel's original article that he was searching for some conservative talk when he "came across" the news conference. I don't think he was ON a "conservative station." At least, that's not the impression I got from reading it.

And I can't speak for him as to who he blames. Maybe he feels there should have been a disclaimer, although that would only be effective if one were to hear it at the beginning of the broadcast. I think he more seems to feel that this maybe should have been tape-delayed and edited for general broadcast in the middle of the afternoon, at least on AM radio. As he notes in a reply to me above, a censor removed the word "dick" from a song airing on NBC after midnight a few weeks ago.

And if words like this are NOT considered "obscenity" by the FCC (and I realize they are the "real," clinical terms), maybe they should be... at least during normal, daytime hours. If one can censor the word "dick" after midnight, I see no reason one cannot control the use of the words "penis" or "vagina" in the afternoon.

Unbelievable comes close to my reaction when I heard the dialogue in such network prime-time crime shows as CSI.  I guess the main difference for Williams may be that those shows are scripted to titilate in order to gross big bucks, whereas the Duke rape case news conference was about the details, albeit explicit, of what's turning out to be a case of prosecutorial abuse.

Liberalism

Modern liberalism is such an easy philosophy to practice. Just have no conscience or soul and do whatever "feels good" at the time. Live your life as a selfish adolescent, disrespect your fellow man under the guise of "caring" for him, shun all rules which you consider not in "your" best interest while you ignore the common good. Trouble is, this philosophy leads to a breakdown of society, a ubiquitous cynicism which is demonstrated so well by the liberals who blog here on NB. The latest "news conference" concerning Duke is just an example of how low modern liberalism's disrespect for human dignity has brought us. Christ's message is so different. This is a good time of year to consider it.

How I'd have handled it on the radio

If I had been running the board at my radio station at the time, I might have let one or two references pass, hoping they were isolated. When it became clear that we were going to get a lot of that language, I'd have bailed out of the news conference, explaining why to the audience, and moved on to something else. I have no doubt my management would have backed me on that.

Really . . that Cheshire cat (sorry, couldn't resist) should have toned it down a little bit. Does he think that everybody wants to hear such graphic references? It seems that he could have gotten his point across without all the gory details. Then again, maybe he's bucking for a $500M contract from Sirius too.

"You pays your money and you take your chances." I did NOT find it in any way offensive. Why? Because it was legal reporting on a sexual offense. It has to be that way. It was also not used for the "shock" effect of a shock-jock. It was simply reporting what was already on file with the court. Why all the 'soft hide' I'm insulted! approach? The words "high lighted" are not wrong or filthy. The actions "alleged" are vulgar. Remember Mel Brooks in "High Anxiety." All the Doctors see a kid in the lecture hall and start using, "Wee Wee" and "Balloons" and "Number 1."
This much ado about nothing. Pick a better fight.
