Chris Matthews actually came out for a pardon for Lewis "Scooter" Libby, but he had a catch, "Send him to Iraq." On tonight’s Hardball the MSNBC host, during a discussion about whether Bush should pardon Libby, threw out the following wacky proposal on the June 21 edition of his show:
Chris Matthews proposed to former Cheney aide Ron Christie and former Assistant Attorney General Robert Raben: "I got an idea, I got a solution. Pardon him but send him to Iraq in uniform and put him on the front. Send him to the front. He supported the war, send him to fight it! Hey look a lot of guys have to go fight that war, didn't do anything wrong....In the old days the judges would take a working class kid who got into a scrape with the law and say, 'Junior want to go jail or do you want to go join the Army?' They should say the same thing to Scooter Libby. 'Want to join the Army?'"

1. We begin with a government investigator/special prosecutor (Grand Inquisitor?) who already knows before his investigation begins, the identity of the person who allegedly committed the crime. How? Because that person, Richard Armitage, informed the Justice Dept that it was he who mentioned Plame's name and CIA connection to Robert Novak.
2. Novak confirmed under oath at the grand jury that Armitage was his source.
3. The elements of proving that law had been broken are (a) the CIA employee is in a covert status, or has been in the last 5 years, and (b) the 'leaker' was aware that the employee was covert at the time of the divulgence. The prosecutor never established (a) and (b), and never charged anyone with breaking that law, including the man who essentially confessed to it.
4. Knowing Libby was not the 'leaker' and that a crime was not committed, the special prosecutor attempts to catch anyone connected in the case in a perjury trap. He snares Libby, who is tried and convicted of perjury and obstructing justice (Remember, the special prosecutor had all the answers to his investigation before it began, but somehow, Libby obstructed the investigation).
5. At sentencing, the special prosecutor asks for a severe confinement for Libby because the gravity of the investigation --- the possible 'outing' of a covert CIA agent --- demands severe punishment. So, Libby gets sentenced to 30 months in confinement and a heavy fine, for perjury in a case where the prosecutor already had all his information before Libby uttered his first word before the grand jury, and the prosecutor knew that a crime had not been committed. In other words, is logic is that the law protecting the ID of covert CIA agents was NOT broken, but had it been broken, then Libby's perjury would've obstructed the investigation, so therefore, Libby's fate must be tied to a serious crime that didn't occur.
Now, if that doesn't smack of Stalin-style justice, I'm an unindicted co-conspirator.

Now, although I understand your statement, it is dramatically flawed. My husband will continue to serve until he is about 60 and he will be deployed just like the rest of them, age has less to do with your physical ability than you think. King Leonidas was no spring chicken. Also, someone who has 24 years in the military is a whole lot more valuable than a 20 year old fresh out of AIT.
What I would like to see, is a whole other media who investigates the lives of the media. Why is Tim Russert more believable than Libby? Maybe if we drag some of the crap out of their closets, people will start seeing them for the liars they really are.
