Reuters: Accuses US of Being Against the Rule of Law

It looks like Reuters is trying to say that the United States stands against the rule of law with their latest piece on a recent ruling from the so-called World Court -- the International Court of Justice (ICJ). The ICJ wants the U.S. to vacate the death penalty sentences of several Mexican nationals that sit on death row in prisons in several states and Reuters is shaking its finger at the nasty Americans that deny the jurisdiction of the self-styled World Court.

Mexico has been agitating with the World Court to force the United States to vacate (or at least revisit) the convictions of 51 Mexican nationals now on death row because they claim that these murderers were not alerted to their right to seek consular assistance before they went into the American court systems.

Naturally, the ICJ happily complied with Mexico's request and demanded that the U.S. comply with the World Court decision. Bush made an unfortunate decision in 2005 to ask the various states to comply with the ICJ, but the issue has since been settled by the Supreme Court of the United States. Fortunately, just this month the SCOTUS said that our courts are not bound by the ICJ rulings.

Of course, Reuters seems to imagine that the U.S. now stands against the rule of law because we have told the ICJ to take a hike. The Reuters report is filled with the stern scolding of a U.S. that "violated" international law and how the U.S. is "in breach of its international obligations."

Under a section helpfully titled "RULE OF LAW," Reuters informs us that all the rules and claims that the ICJ is preeminent are unquestionable.

The ICJ, also known as the World Court, is responsible for handling disputes between U.N. member states. Its rulings -- which often take years -- are binding and not subject to appeal.

Reuters also quotes Gomez-Robledo, Mexican under-secretary for multilateral affairs and human rights, to the effect that the U.S. is working against the "rule of law."

But he appealed to the United States to respect international law. "The rule of law is the foundation stone on which the United States was built," he said.

Let me disabuse both Reuters and the Mexicans that the U.S. is working against the rule of law, here. You see, the United States is not overarchingly bound by the ICJ. We are, however, bound by the Constitution of the United States first, foremost and solely. And, as it turns out, we followed our rule of law by taking the cases of these criminal aliens to the highest court and that court happened to rule against the ICJ.

There you have it, the proper rule of law concept followed to a "T." The ICJ lost. Too bad, so sad.

In his desire to look all cute and cuddly to the Europeans, President Bush overstepped his boundaries by trying to order the various state courts to revisit the sentences of these 51 murdering criminal aliens. The SCOTUS was right, Bush should have stayed out of it.

But there can be no question that the issue has been rightfully and legitimately settled duly following the rule of law. Reuters is wrong to flavor their article as if the U.S. has somehow violated the rule of law, that it is in the wrong for following its own duly constituted laws.

Unsurprisingly, no where in the story can you see Reuters admitting that the U.S. is governed by its own Constitution and the entire story is framed in the language and assumptions that the ICJ is the rightful arbiter of what the U.S. should do with its system of justice.

In any case, the day the U.S. allows itself to be ruled from the Hague and this so-called World Court, we truly will have arrived at a day when we've given up on the rule of law. For at that time we will have allowed ourselves to be ruled by the arbitrary rules of Europeans, rules written specifically to undermine American jurisprudence.

I am sure that the majority of these 51 are slated to be executed here in the state of Texas.

 So, on behalf of all Texans I would just like to say to the ICJ and the Mexican citizens:

How I Envision Hell

I have come to envision Hell as a place that is made up of nothing but courts with leering, looney judges and is run for and by lawyers.

Reuters is the lap-dog of the euro-donkeys and as such they have no use for the US. No wonder they don't like us having our own opinions. I don't recall reading a lot of condemnation at Reuters about the executions in Muslim countries, but then again, it would take a set of stones on their part to face down the fascism of Sharia law and the terrorism of certain imams.

I don't generally spend much time reading Reuters news releases because of the high degree of bias in them, but I should make a point of following their reporting of the Lisbon Treaty, just for kicks. Since the Irish referendum, according to the language of the treaty itself, it's dead - all 27 member states have to ratify it in order for it to take effect. Now it looks like the Czech Republic is going to defeat it as well. And there's trouble in Britain about it too. Of course, Brussels is scheming to figure out a way to make the treaty effective in spite of it failing by it's own criteria. EU justice - of the courts, by the courts, and for the courts.

The Irish Decided To Follow The Rules

Most of the other countries knew that in spite of language in the treaty requiring referenda in all member states, that a referendum would fail, so they only voted through their legislative bodies. It looks, now, as though the Czech Republic legislative body won't even be able to pass it because their top court is likely to find the treaty in opposition to their Constitution.

Medellin Vs Texas

In the case Medellin v. Texas, the court in an opinion by Chief Justice Roberts ruled on somewhat technical grounds that the language was such that it did not make new Federal Law, but merely provided a set of international protocols.

A more aggressive approach would be to say that the US Constitution provides that the Supreme Court is the supreme judicial authority in the United States.  That means neither a treaty or a Federal Law can abrogate the plenary power of the Court.

Of course the Court only seems to want to grab power when it seizes power from the President under political cover from Democrats in cases such as Boumedine v Bush.

I'm seriously thinking of going to the October shoot with my 15 year old granddaughter and spending some serious money. For enough cash they let you shoot ANYTHING at this range. There is one guy that brings a tank for each shoot and I'm hoping to blow the crap out of a car or two. I will probably come home broke.

that would be!  And a great trip for you and your granddaughter.  I am taking my three kids to the range this week for practice.  I have an 18 year old daughter who is very capable with the Glock .40 and she wants to get her CC when she turns 21.  My 66 year old mother just got her CC.

Screw the Hague and the so-called World Court.  This is the United States and we should not let any other country dictate to how we prosecute and punish criminals.

Our government never agreed to accept the ICJ's jurisdiction, and we the people certainly didn't get to vote for it.

I've had all I can take of Mexico trying to dictate their will to us.  Would that we had a President who would stand up to this crap and tell them to shut up.

New Civil War

Our forefathers, and countless generations since, have fought and died for the sole belief of an independent country. That means self rule. We have lived with this great experiment for the past 232 years and it seems to be working. We have our our laws that we follow and expect anyone within our boundary's to conform to.

We are not part of the European Community and do not wish to become one with them. At what point will liberals force the issue of closer ties and suspend our laws and Constitution in favor of the ICJ. That said, at what time will true American's take up arms against their own countrymen to protect the very freedoms others take for granted.

I mentioned the phrase "true American's" for a valid point. If you believe we must suspend our laws and constitution for European acceptance, then you ARE NOT a true American. No matter what you say, your actions suggest that the patriots who gave their life for this country was for naught. You want to give up your rights for what, acceptance by the EC? How dare you disgrace us. May I suggest that you move to another country first.

Unfortunately, liberals (or as they like to call themselves progressives) are growing in this country and may eventually dominate our political system.  For the most part, I believe this is due to our poor educational system in the grade school and high school levels with the resultant abysmal high dropout rates. If you can’t read , write, or do basic math you will find it difficult to obtain a good-paying job so that you can take care of yourself and your family; hence, you will come to rely on and vote for the liberal party, with their belief in Big Government to take care of you for all the days of your life.

With liberalism comes the embrace of a worldview rather than a national perspective. That is why the liberals care so much about how we are perceived by other nations.

Its time we take up the challenge and ensure we teach our kids. Not only about the three "R's", but real history and its cause and effects. Make sure they know their right and at what cost it was passed to them. I'm having fun during this election year. Every time the libs have a "gathering" I make sure I'm there to voice my opinion and question their stance against the Constitution. It's even better now that Congress voted against Pres. Bush on off-shore drilling. Even Dim's are getting mad at paying high gas prices. My best phrase is from a blogger here on NB "calling an illegal alien an undocumented worker is like calling a dope dealer a street corner pharmacist."

During my last such visit, I called a few liberal un-American when they began their montage of "social" benefits. It's time we stand up for ourselves and let the lib's know that the we uphold the Constitution and our laws.

ICJ, International Court of Jesters?

Do not get me wrong, the rule of law is important and I agree that our Constitution and our Supreme Court tells us what our limits are based on our Constitution and that means we do follow the rule of law, something Reuters seems to be rather ignorant about. I mean if they are not ignorant, why did they not provide those details too?

But there is a higher issue here. You see, there is a "one world" frenzy going on these days, where elitist types are out to turn all sovereign countries into "states" under a one world government, which then imposes unbearable dictates upon its member states. The EU is a perfect example of this, and this is why several countries have rejected this tyranny by refusing to join the EU, most recently Ireland.

These "one world" elitists are under the delusion that a "one world government" would bring an end to war, for example. But of course they forget to recognize or mention that hundreds of civil wars within countries have not been stopped simply by a federal government "over all." And they believe a lot of other jiberish there is not time to go into.

I suspect Reuters has its own lack of respect for International Law, as the UN charter assures its member states that each country's laws are not be tampered with by other countries, even via the ICJ, and that International Law trully only applies to international situations, for example, when a business in country A sells defective products in country B or in areas such as international drug deals, human trafficking, crime in international waters, etc.

Simply put, the ICJ does not have jurisdiction. Reuters thinks it does, but only to "bad mouth" the USA while President Bush is still in office, because it is a "sworn enemy" of President Bush, IMHO. In fact, it seems that "bad mouthing" President Bush these days is pretty much "smear tactics" based on total lies or worthless BS.

 

 

The US is NOT a member of the ICJ system

We (Congress) specifically did not ratify the treaty that would have made the US subject to the ICJ. Therefore the ICJ has NO jurisdiction in the US or over any of our legal decisions.

President Bush oversteped his authority and Constitutional ability when he requested that the various State courts review the sentences.

This is a perfect example of why the US should pull out of the UN and give them 12 months to find a new HQ.

The day that "politician" became a career choice is the day we started losing the Republic. Let's get it back! Alan Keyes '08.
