Frank-ly Control Freaks: Congressional Committee Passes Bill Controlling ALL Pay at US-Involved Companies

And to think we were "only" worried about having a known Tax Cheat overseeing everyone's taxes.

With Barney Frank's help, Treasury Secretary Tim Geithner is trying to expand his power (and by inference that of his Dear Leader boss) well beyond that. The "Pay for Performance Act," which has already gotten out of committee, would give him veto power over salaries at every company into which the government has inserted its intrusive claws.

Besides the utter outrageousness of the news itself, the story leads to the question of how the establishment media will handle it. Whitewash it? Minimize its significance? Ignore it? Given the fact that the news is over a week old, I vote for a continuation of Door Number Three.

Beyond AIG: A Bill to let Big Government Set Your Salary

..... in a little-noticed move, the House Financial Services Committee, led by chairman Barney Frank, has approved a measure that would, in some key ways, go beyond the most draconian features of the original AIG bill. The new legislation, the "Pay for Performance Act of 2009," would impose government controls on the pay of all employees -- not just top executives -- of companies that have received a capital investment from the U.S. government. It would, like the tax measure, be retroactive, changing the terms of compensation agreements already in place. And it would give Treasury Secretary Timothy Geithner extraordinary power to determine the pay of thousands of employees of American companies.

The purpose of the legislation is to "prohibit unreasonable and excessive compensation and compensation not based on performance standards," according to the bill's language. That includes regular pay, bonuses -- everything -- paid to employees of companies in whom the government has a capital stake, including those that have received funds through the Troubled Assets Relief Program, or TARP, as well as Fannie Mae and Freddie Mac.

The measure is not limited just to those firms that received the largest sums of money, or just to the top 25 or 50 executives of those companies. It applies to all employees of all companies involved, for as long as the government is invested. And it would not only apply going forward, but also retroactively to existing contracts and pay arrangements of institutions that have already received funds.

In addition, the bill gives Geithner the authority to decide what pay is "unreasonable" or "excessive." And it directs the Treasury Department to come up with a method to evaluate "the performance of the individual executive or employee to whom the payment relates."

The bill passed the Financial Services Committee last week, 38 to 22, on a nearly party-line vote. (All Democrats voted for it, and all Republicans, with the exception of Reps. Ed Royce of California and Walter Jones of North Carolina, voted against it.)

Geez, it wouldn't be much of a stretch to extend Geithner's reach to:

  • Any company with a Small Business Administration loan.
  • Any university with students who have borrowed money from the government to attend (i.e., almost every institution of higher learning in the US).
  • Any company whose employees use government services (i.e., an interstate highway or a subsidized mass-transit ride) to get to work.

That is, it's not a very far trip to controlling everyone's earnings.

Well, at least the self-employed won't be affected .... Don't count on that either. Tax Cheat Tim will probably want to control hourly rates and prices paid to vendors.

It Has For a Long Time

I posted a much longer comment, part of which applies here, on the "Reduce the population" story form the U.K.

The gist was that we are already and have for a long time been a socialist country, even if the illusion of freedom remains.

I think it is long past time for those who would call themselves "conservatives" to take a long, hard look at how much they have helped, through action or worse, in action, this unchecked movement to the left for the past few generations.

Get ol' Lady liberty out of storage and see what shape she is in.  Remember how much she used to matter?  Was it really worth it to trade her for material comforts, not being called mean names and to not have to be bothered with actually living as a Free People and all the work that takes?

It doesn't matter how shabbily we have treated this wonderful lady, she STILL loves you.  She just needs us to be strong for her and her children now.

If "conservatives" are not ready to face the very real possibility or re-evaluating the Three Boxes of Political Action and Change, then they need to face the fact that "pusillanimous" may be a better label.

Only funny NPR clip I ever caught was a Cookie Monster interview.  When asked if he knew any dirty words, he said "he not know" but that he never liked the sound of the word "pusillanious."

One Party Rule Forever

It is clear from actions like this that the Democrats do not intend on ever willingly giving up power.  They would never allow a conservative administration to wield such power.

So we have socialism with a capitalist veneer and a single unity party with a cult of personality figurehead.  Can I start calling them fascists NOW?  They seem to have met the qualifications.

If memory serves me correctly, about 6 years ago the GOP controlled the white house, senate and congress. And there was a fellow by the name of Karl Rove who spoke of a permanent republican majority. What ever happened to that?

The Republican Majority

Was wishful thinking, just like the Demo one under Clinton was wishful. Remember how long that majority lasted?

The only way to have a permanent majority is the one which Obama is pursuing; make a majority of the people dependent on the government and beholden to the government (tax cut for non-payers), silence the opposition by the power of the government (fairness and local programming and ownership), and run questionable "get out the vote" efforts which target the demographics most likely to vote for you (ACORN).

Where, in the Constitution, does the Legislative branch have the authority to give the Executive branch ANY powers??  Which Article is it?..which Amendment??  Where the hell does this s**t come from??  I thought these guys took an oath to uphold the Constitution..

It doesn't matter any more, does it? Congress has been ignoring the Constitution for nigh 100 years now. For example, where in the Constitution did they get the Authority to create the Social Security System? or any of the other far reaching Administrative Offices that have been set up "to harass our people and to eat out their substance". Congress shall have power to lay and collect direct taxes...how is it that they can now collect income taxes on its Citizens? I hate to be so cynical, but the Constitution has not been followed by our government for a very long time. Viva la Revolucion! Phase II

What really sickens me is the so-called folks on the right who criticize certain aspects of the OSB (Obama Spending Bill) saying, "while some of these programs are good ideas, it's just not the right time for them." Say what! I think there are so very few people in the Congress (and government beauracracy) today who actually know upon what our Country was founded. And what is worse, they no longer care.

Goodness, but Obama and the Democrats have been busy the past few days.  Let' see:

  • They fire Rick Wagoner, the CEO of a private corporation, and handpick a successor;
  • Government Motors announces that it will make car payments for any customers who lose their jobs;
  • John Kerry decides the 2nd Amendment is a piece of crap and announces his desire for increased gun control;
  • Barney (Elmer Fudd) Frank continues to build his fiefdome and decideds to give Treasury control over salaries of employees working at private companies who receive government bailouts.  "Pay for Performance Act of 2009" -the government now controls the pay of all employees of any company receiving capital investment from the government. 
  • Even better, it's all retroactive - the government can wipe out previously settled contracts and impose new rates of compensation;
  • The government reserves the right to remove any senior management from private corporations receiving government capital and handpick the successors

Busy, busy, busy!   Thank you, everyone, who got out and voted Democrat last November.  We can now reap what we sow!

Elmer Fudd

On behalf of Mr. Fudd, I take umbrage at the comparison between Bawny Fwank and Mr. Fudd.  Mr. Fudd has long been a supporter of hunter's rights, self-defense and the 2nd Amendment.  While Mr. Fudd has been known to dress in drag, there is no indication that he is a homosexual, merely eccentric in his personal wardrobe tastes. 

BTW, we were listening last week to the radio, and my 3 year old heard a Bawny Fwank clip.  My oldest son was over, and we both did the "Bawny Fwank" impression when it was played.  The three year old now walks around shouting "Bawny Fwank"....(smiles and laughs)

Socialist to Dictator

In one week BHO has moved from socialist to dictator. There is no freedom in this. This is not the land of the free and home of the brave. This is the seizure of freedom and unlawful in the highest respect. Hugo Chavez would be proud of him.

You know what the giveaway is? Even if we acknowledged that the pay scale is out of whack, a true lover of the Constitution would ask that Congress debate pay levels publicly, instead of allowing the Treasury Secretary do it. I deny that this is a proper function of government anyway, but on the off chance that it is, the task would belong to the legislative branch.

Remember, Congress has the enumerated power to regulate commerce, which would be the only clause that could possibly authorize this. And, under the Constitution, the Congress can't "lend" its powers to different branches (that would desecrate the principle of separation of powers). I can't see any constitutional principle that would support a claim that the Treasury Secretary could manage wages.

Sure, control our pay, whatever

These people think we "ordinary Americans" are a greasespot on the sidewalk of life. My letter to the WSJ today:

In your article titled “In the Boonies, the America Dream is Up for Rent,” witty old Lawrence Summers summed up the fate of neighborhoods going “rental” to displaced homeowners by sniffing: “No one in the history of the world has ever washed a rented car.”
So much for how people live and want their families to live.

This says so much–volumes–about how our new overseers in DC see us. Come to Chandler AZ, Mr Advisor or Whatever You Are, and watch my neighbors cut their lawns, trim their edges, bring in their recycling bins and a dozen other things you probably have never done in person yourself, even though you own your home.

Have you looked closely at the photo attached to this article?  Doesn't it appear that Obama's left hand in gettinng ready to pull a string behind Geithner's back, like one of those old-fashioned pull-string dolls with voice boxes?

I  knew Geithner was just a puppet of Obama.  Now I have photographic proof.  Quick, alert the media!

No you can't call Obama and the gang socialists. The proper term is Fascists. There is a difference. In a Socialist society the government owns and controls the means of production. In a Fascist society the government merely controls the means of production while ownership is in private hands.  Double check with Neal Boortz for a better explanation.

Now I know none of you like Wikipedia, but that was the easiest place to get an explanation of fascism from. So read it and weep. This is where we're heading along our way to Obama's Marxist state.
