Omission Watch: Feminist Fluke Insists Insurers Must Fund Transgender Surgeries

The Drudge Report has linked to MRC TV's Stephen Gutowski, who dug up that the Radical Feminist Heroine of the Week Sandra Fluke thinks insurance policies shouldn't just pay for contraceptives, but for "transgender" amputations and implants.

If the national media thinks this scandal-ette deserves to go for weeks on end, where is this story? Steve reports Fluke makes her view of an amputation entitlement clear in an article she co-edited with Karen Hu in the Georgetown Journal of Gender and the Law:

The title of the article, which can be purchased in full here, is Employment Discrimination Against LGBTQ Persons and was published in the Journal's 2011 Annual Review. I have posted a transcript of the section I will be quoting from here. In a subsection of the article entitled "Employment Discrimination in Provision of Employment Benefits" starting on page 635 of the review Sandra Fluke and her co-editor describe two forms of discrimination in benefits they believe LGBTQ individuals face in the work place:

"Discrimination typically takes two forms: first, direct discrimination limiting access to benefits specifically needed by LGBTQ persons, and secondly, the unavailability of family-related benefits to LGBTQ families."

Their "prime example" of the first form of discrimination? Not covering sex change operations:

"A prime example of direct discrimination is denying insurance coverage for medical needs of transgender persons physically transitioning to the other gender."

This so called "prime example" of discrimination is expounded on in a subsection titled "Gender Reassignment Medical Services" starting on page 636:

"Transgender persons wishing to undergo the gender reassignment process frequently face heterosexist employer health insurance policies that label the surgery as cosmetic or medically unnecessary and therefore uncovered."

To be clear, the argument here is that employers are engaging in discrimination against their employees who want them to pay for their sex changes because their "heterosexist" health insurance policies don't believe sex changes are medically necessary.

Fluke & Co. are dismayed that private insurers aren't sued by transgender activists these types of cases are filed against Medicare, Medicaid, and even the prison system: "The reason for this lack of cases is unclear. Private employee insurance plans do not more frequently cover this need, so it may be a sign that transgender employees do not see the courts as likely to provide any assistance against private employers."

The key word is HEALTH

Submitted by Galvanic on Tue, 03/06/2012 - 12:44pm.

The Left believes that Big Government has a responsibility to guarantee each individual's access to health care, and health is defined broadly enough to include "feeling better about myself." Government is expected to free us from stressful decisions.  And it's about getting someone else to pay for the care that makes us feel better.

That's how they rationalize late term abortions: it's for  the "mental health" of the mother.  Is there a chance the mother may suffer from post-partum depression (and there's always that risk), then abort the baby.

Sandra Fluke expands the feel-good health umbrella further by insisting that sex change operations also be covered. Other elective cosmetic surgery is certainly included under that umbrella.  Need a nose job so you can feel good about yourself?  Get your employer to pay for it.

This is why the language in legislation and court rulings is so critical. If lawyers dig deeply enough into the Obamacare act, they'll probably find the language that covers sex change operations and other transgender procedures.

How far are we down the slippery slope have we gone?  Two Australian 'medical ethicists' have released a paper in which they rationalize the killing of newborns (They prefer the less-provocative term after-birth abortion) by redefining the word person.  Essentially, a newborn is a "potential person' but not yet a person, and therefore it has no right to live.  The parents and the state have a right not to be burdened by the newborn, whether it be healthy or handicapped, and thus can execute (oops, I'm sorry, 'after-abort') the child days or even weeks after it is born.   So, if that new baby causes one to be stressed out or low on cash, these two say 'kill it.'

You’re asking for too much Galvanic!

Submitted by Grumpy in Arizona on Tue, 03/06/2012 - 12:52pm.

“The clear intention of the Legislature?”… Oh no! We can’t have that!

The object is to write laws in ‘clearly ambiguous terms’ so that we don’t really know what the intention of the legislature is until it can be ‘interpreted’ properly by liberals.

I define my personal health as “Being in a state of relaxed indifference.” – So a government grant to pay-off my bar bill would be greatly appreciated.

It keeps their fellow lawyers gainfully employed

Submitted by Galvanic on Tue, 03/06/2012 - 1:32pm.

Unless it is ruled un-Constitutional by the Supreme Court this year, the Affordable Health Care Act (Obamacare) will keep thousands of lawyers employed for decades.

Co-author of the bill Dem. Sen. Max Baucus admitted that he never read his bill because it was written in legal jargon that he doesn't understand.

And I'm sure one of the frequent battles will be over the meaning of the word "health."

a certain president's tranny-nanny in Indonesia. I wonder if that dude is Muslim?

Fluke is also a staunch abortion supporter, as you might imagine. You know, it's one thing to say "it's my body and I can do anything to it that I want", it's an entirely different thing to add, "and I want it paid for by someone else." I don't entirely agree with the first one, but adding the second is amateurish.

Something will soon come crashing down. It'll either be the Republic as we know it, or the Left as a viable political entity. The two cannot cohabit.

homersexual lifstyle, does she REALLY NEED any type of birth control?

She wants her sex change operation paid for as well.

She needs to bring her parents forward and force them to explain why they didn't opt for an abortion instead of forcing her to live in the real world.

I would even be interested in hearing from her parents, and learning their political backgrounds.

.....but I'm skeptical about whether Ms. Fluke is really having the kind of sex that requires birth control, specifically the pill. If she was truly experienced in these matters, she would know that the supposed $3,000 cost to cover the expense during law school is TEN TIMES what it really costs, if you get a generic. I think she's just an ultra-lefty militant "women's studies" graduate who is posing as someone who has sex with men.

Sorry, but gender dysphoria does not require surgical treatment.

Submitted by drsamherman on Tue, 03/06/2012 - 2:20pm.

Gender dysphoria, which is actually an Axis I diagnosis per DSM-IV(TR), does not require gender reassignment surgery for treatment.

At best, the surgery can be described as medically unnecessary, experimental and elective. In reality, it can be more accurately described in a politically incorrect context as selfish, self-indulgent and a trashing of scarce health care resources.

And to you lurking liberals and Democrats in ghost and sleeper accounts, I have treated patients with gender dysphoria to the standard of care and standard of practice required. None of them have elected the surgery.

Q...

Submitted by JPTSO3 on Tue, 03/06/2012 - 8:00pm.

They've added the "Q" for "questioning". Apparently some are questioning, so that elusive gay gene is dormant in the Q crowd - it may or may not decide to erupt? Is the gene questioning, or is the host? So -- some are not [fill in blank] at birth, or they just don't know it, and need to have the Question... Answered and then the gene turns rainbow? What if the Question is answered "No", does that mean the Answer is wrong and the "not-gay" dude needs to be pushed to accept his... true "ornamentation". I'm really confused. By the 22nd century there's going to be so many letters in the LGTBQ (add later) lobby banner, it will need its own zip code...

I have a new theory on Fluke.

Submitted by Newsbubba on Tue, 03/06/2012 - 4:57pm.

I think that she is another of George Soros' and the worldwide left's stable of "sleepers" that they are training to hopefully become high ranking officials in the US government.  One has already risen to the office of president.

I suspect that they are identified early, raised to be ultra liberal, given a good education in the best left wing schools, and groomed to become future politicians who can bull Shiite their way past the American voters and slowly take over this country.

Obama was a great success story for this RBF commie "farm team" concept that Soros is funding. Don't have any idea how many they have in the system, or if many of them even know they are being molded until the moment comes for them to "appear" on the scene, but they already proved that it works.

Now here comes Fluke.  A 30 year old law student attending a school which she obviously wanted to target for its Catholic views, having formerly been a "community organizer" who is extremely active on left wing issues.  She is almost slipped into a House hearing to testify on a subject she has no expertise on, separation of church and state, but Issa keeps her out for good reason.  So the dumbocraps stage their own "hearing," the press falls all over themselves pushing the "lady," and she becomes an instant darling of the MSM and the Democrat party.

I'm betting that she will move to some surefire liberal state after graduation, and shortly thereafter run for the House or the Senate.  With a couple years of that under her belt, she could be the first female president of the USSA!!

Of course this is all assuming that we will still need to have these pesky elections in the future.  Hell Georgie may just appoint her.

Don't think it could happen?  Just take a look at the POS we have as a president now, and ask yourself if 10 or 20 years ago you would have ever believed that such a far left, totally inexperienced, totally unknown and unvetted candidate could EVER win!!!

God help the USA.

on the subject of sex change surgery paid for by TAXPAYERS

Submitted by Willis_Leon_Johnson on Tue, 03/06/2012 - 7:48pm.

I'm 100% in favor of a slightly modified version of the surgery.

A pre-frontal lobotomy would accomplish exactly the same results.

They would still carry the same equipment, but they wouldn't care.

TAXPAYERS save a bundle, lose a moron, and gain a person that is, at minimum, 4 times more intelligent than any living liberal.
