Obama Administration is Openly and Serially Flouting the Law - and the Media Says...

We really shouldn’t get angry with the media for being obstinately silent and/or willfully ignorant when it comes to - amongst many, MANY other things - Democrats and Leftists breaking the law.

It’s like getting upset with a six-month old for behaving badly in public.  It’s what we get - we should not be vexed when we get it.

After all, one is immature and childish, existing only for itself and behaving accordingly.

And the other is a baby.

There are times, however, when the media is so bad that even the most patient among us grows... un-patient.   

So it is with the Barack Obama Administration’s Federal Communications Commission (FCC) - and its rampant, recurrent breaking of all sorts of laws in their manic push to commandeer control of the Internet, so as to then impose the patently absurd Network Neutrality. 

On all of this illegality - which myriad people have repeatedly pointed out all along the way - the media has for the most part said:

“__________.”

For starters, the FCC has zero authority over the Internet - something FCC Chairman (and Obama law school basketball buddy) Julius Genachowski readily admits. 

A fact reinforced by the D.C. Circuit Court - which in April 2010 unanimously demolished as unauthorized the FCC’s first attempt to impose Net Neutrality. 

So when the FCC on December 21st voted themselves Internet Overlords in 3-2 Democrat Party-line fashion - they and everyone else knew it was illegal.

But the media for the most part said:

“__________.”

We have just passed the six month anniversary of this power grab - and the FCC still has not yet filed the order with the Federal Register, which is where all new rules and regulations must go to begin their imposition.

What’s the holdup? There are several possibilities, some or all of which may be why the FCC is so thoroughly slow-playing it. (Please note that it took the FCC less than a month - April 7 to May 6 - to file their wireless data roaming Internet seizure - so they can get it done when they want to.

One possibility for the delay: Two wireless providers - Verizon and MetroPCS - had filed suit to undo FCC Chairman Julius Genachowski’s Net Neutrality order. Verizon had sought relief in the same U.S. Court of Appeals for the District of Columbia Circuit that unanimously ruled in April 2010 that the FCC has no net neutrality authority.

The court dismissed the suit, saying the company couldn’t contest the rules until the agency published them. But the court’s docket is moving along, and the clock ticking. The longer the chairman drags his feet on the net neutrality order, the less likely it becomes that the court will be able to hear the case. By stalling, the chairman is callously venue-shopping - and ducking a court in which he knows he most likely will lose.

This is a rather obnoxious abuse of both the regulatory and legal processes.

About which the media has for the most part said:

“__________.”

When pressed on what was taking so long - by me, first in writing and then in person - the FCC stated the delay was a result of its now going through the Paperwork Reduction Act (PRA) process.  But:

There’s (at least) one huge problem with this assertion: The FCC - and every federal department, agency and commission - is supposed to comply with the PRA before it votes to impose a new order, not after. To do so afterward defeats the point of the law....

The Act states: “With respect to the collection of information and the control of paperwork, each agency shall … assess the information collection burden of proposed legislation affecting the agency … for any proposed collection of information contained in a proposed rule (to be reviewed by the Director under section 3507(d)), provide notice and comment through the notice of proposed rule-making for the proposed rule.

In one sentence, the word “proposed” - not “passed” - is used four times with respect to the rule being examined.

But, yet again, the media has for the most part said:

“__________.”

So here we have the Obama Administration’s FCC in chronic violation of major federal laws. 

In fact there is a very real possibility that - with the Paperwork Reduction Act - a great many Obama Administration commissions, agencies and departments are incessant lawbreakers. 

And, in conjuring up their non-existent authority over the Web, the FCC is making up law out of whole cloth - executive branch (as opposed to judicial) activism.

All so as to expropriate regulatory control of 1/6th of our national economy - the World Wide Web.  The policy ends they want “justifying” all the unlawful means necessary to get there.  

But the media through it all says... nothing.  No examination, no analysis - no curiosity whatsoever.  

They are, instead, myopically fixated on complete irrelevancies like the email heaps of Republican ex-governors who aren’t running for anything. 

Which for the most part have all the journalistic payoff of a Geraldo Rivera Al Capone’s Vault special.

Proving once again one of life’s maxims:

Being Liberal means never having to say you’re sorry.

The media’s silent complicity with the FCC’s Net Neutrality power grab is at once annoying, offensive - and utterly predictable.

. . . attemtpts to control cable TV and the Internet, which have taken considerable market-share away from them. I wouldn't expect any help from them.

The Obama WH is taking deliberate action to circumvent the Congress by encourgaging Federal acitivites such as the EPA, FCC, and others to impose even more regulations on businesses. They Federal courts are working for them, and a Republican House will never pass their Big Government legislation. To they're taking the last route: Executive branch fiat.

If I were a GOP strategist, I would emphasize the Dems clear but quiet way of achieving "Change" without Congressional consent.

Sit back and take it. Like we have with health care, our eroding gun rights, increasing taxation of every facet of our lives, not being able to buy a light bulb of our choice, not being able to use seasoning we choose (NYC), and virtually every other freedom we have.

Meanwhile roaming mobs of people intent on robbery and violence are in Chicago, Peoria, and Philadelphia (possibly other places). Where is our government in helping keep us safe in these cases?

When indeed?  Because if they haven't stopped him from continuing Libya, they won't stop him at anything else.  I don't exect this Congress to do the right thing anymore.  In fact, I don't expect much from them because they are apparently a cowardly lot.

How do I know this?  Well, the dictator is still there.

Too many people are waiting for 2012.  By the time it gets here, the damage done to this country is going to be so extensive, there won't be anything left.

There is no indication that this man has any interest in actually doing the job the American people hired him to do (to borrow a political phrase).

Unless that "job" is fundraising, travelling, and playing golf.  Not necessarily in that order.

The question is, why won't they?

My theory is there are a lot of people in congress with "Rs" after their name that secretly support Obama's mad power grab for the federal government, as they have done next to nothing to defund any of it.

There is absolutely no possible way they cannot clearly see what this "president" is doing.

As for the sheeple, my guess is they will send the bulk of these useless congress critters right back to Washington in November of 2012 so they can sit around on their asses and watch the Comrade Chairman, should he be reelected (and I think that is a very real possibilty) deliver the coup de gras to our once great America.

We are quite literally watching this country die right before our very eyes.

past despair

It doesn't really fit entirely, but the 7 stages of grief could apply in this case.  I'm past despair, once I saw the end result of Libya in Congress.  I had been holding onto hope and figured that like many other things, they were taking it one step at a time.  I think it's pretty obvious that unless they really do take action, it's pretty much a done deal.

Not all of the 7 stages would apply when it comes to the death of this country.  Like the last stage is acceptance and hope.  Got none of that.  I don't accept what's happening, but I don't have any hope either.  So I move on and go day by day and see what happens.

Take the most recent news today about the TSA making a 95 year old woman who was a cancer patient remove her adult diaper for screening.  If that's not the biggest case of idiocy, I don't know what it is.  Do I expect Congress to do something about it?  At one time I had, not anymore.

Will the TEA party make waves about all this crap happening?  Why aren't they already?  Oh well, c'est la vie.

It's like that thing about Vargas, the recently admitted illegal immigrant with forged documents.  I haven't seen any news about him being arrested.  It's obvious that the government and Congress do not care one whit about the law anymore.  Or what's right.

So I won't waste any more emotion over it, except maybe anger and contempt to Congress and to the American people that voted for this dictator into office.  Maybe.

So that's done.

Congress and depression

While agreeing with lack of action in Congress it should be remembered that only the House has a majority of Republicans and the Senate has pretty much shut down since the beginning of this year.  Have you heard a thing the Senate has done since their last second push during the lame duck period?

My disappointment lays, as usual, with the inner core of Republican "leadership" if I may be so bold as to use a term which in no way applies to those who head the party.  There mouths are shut and they are sitting on their hands while letting young Congressmen/women take the brunt of the media attack with no public signs of support.

Mentioned this earlier today to a die-hard democrat who insisted that Obama had nothing to do with this, - that the FCC action was a "leftover from the Bush administration's Patriot Act".

Another said it was "Republicans in congress" working hard to limit internet freedom. They just make shit up as they go along!
