NPR’s Totenberg: Sotomayor More Conservative than Scalia

NPR’s Nina Totenberg apparently needs to brush up on her knowledge of judicial philosophy and American jurisprudence. On the July 13 edition of “Charlie Rose,” Totenberg told Charlie Rose that Supreme Court nominee Sonya Sotomayor has “a pretty conservative record.” There are many words and phrases that could be used to accurately describe Sotamayor: intelligent, successful, to name a few. But conservative?

Totenberg went on to tell Rose that Sotomayor’s record is “very much in the mainstream,” and that “you could say that she's more conservative than some members of the Supreme Court, including Justice Scalia, perhaps.” Judge Sotomayor’s decision to uphold the New Haven firefighter case, Ricci v. DeStefano, which was overruled by the High Court this May, and whose majority included all four of the “conservative” justices, clearly illustrates that Sotomayor is in no way, shape, or form a conservative.

During the 2005 confirmation hearings for Chief Justice John Roberts, Totenberg made it a point on multiple occasions to remind everyone that he was a “very, very, conservative man,” in order to paint him as a right-wing enthusiast whose judicial philosophy was out of the mainstream. 

People who know him know that John Roberts is a really conservative guy....Don’t forget his wife was an officer, a high officer of a pro-life organization. He’s got adopted children. I mean, he’s a conservative Catholic....a hardline conservative.

Now in a very weak attempt to assure people that Sotomayor is in the mainstream realm of legal thinking and not a far-left judicial activist, Totenberg labels the Obama nominee “more conservative than Justice Scalia.” Interesting how a Democratic president and a liberal nominee can make Totenberg sing a different tune.   

The following exchange was aired on the July 13 edition of PBS' "Charlie Rose" show:

CHARLIE ROSE, host: Can you get away with that if you've got the kind of judicial record she has? I mean, this is not coming with a clean slate.

NINA TOTENBERG, NPR: You know, for a Democrat, she has a pretty conservative record, a very much in the mainstream record. They don't have -- in fact, on a lot of criminal law issues, you could say that she's more conservative than some members of the Supreme Court, including Justice Scalia, perhaps. So I think that's why they're hooking so much on her speeches, on what they view as racial identity politics. A little bit the firefighters' decision. And the Judiciary Committee, let's face it, it's like a dysfunctional family, they are fighting, last ten fights they had and the rest of the world doesn't know what they're talking about.

Sonia the "righty"?

When Markos Moulitsas appeared on Charlie Rose last year, he said (with a straight face) that Daily Kos was mainstream too ... a statement which at least elicited a grin from host Charlie Rose.

I didn't see this recent show, but I'd expect that Mr. Rose, should he have accepted the argument that Sonia Sonomayor was conservative, would follow up and ask, "Then why are Democrats backing her nomination?"

Doesn't that sound like the obvious follow-up?

Why would LaRaza, which means "the race", have anything at all to do with RACE?? And Sotomayors comment that female latino's are superior to white males is racist??. Come on now. sarc off. Why do liberals insist that minorities that don't earn anything be given everything.? I detect a real loathing, fear and hatred of the people for the Government and this will lead to civil unrest, possibly an armed restoration of the Constitution from it's seizure by the usurper and conspirator Barry Soetoro, aka Barack Obama. Ever notice how the msm won't even pretend to investigate the usurper's nationality or how he traveled on an Indonesian passport? This is a coup led by the Government/Media Complex.

I have listened to her on NPR for many years and recall her praise for Ceaucescu (sp?) of Romania when he was the local dictator. I would attribute her present comments to senile dementia as the charitable person I am. I have no similar explanation for her earlier flights of fancy. 

Sotomayor is unqualified. (and an idiot)

Why?

According to her own statement, she conciders all past Supreme Court decisions as "settled law" and as prescedent. If she were on the bench in history, we would still have the Dredd Scott descision as law (escapred slaves have to be returned to their owners because they are property) and Brown vs the Board of Education would not have been heard because it was already "settled law". Thus, the sperate but equal doctrine for segregated schools would still be in effect.

She apparently has never concidered the fact that just like Congress and the President, the Supreme Court can get it wrong and make a mistake.

The left will never cease

The left will never cease to lie, lie, and lie. If this woman was conservative, why would the left want her on the court? Why woul they want to replace a hard core lefty with a "conservative"?

They are simply lying because they want to decieve the American people, because that is all the let ever does.

Liberals are not bright

Totenberg was only speaking to her base.  Libs only spew talking points...and call conservatives racist.  Once you've been labeled a racist and heard "Bush lied - people died" the discussion is pretty much over.  Liberals are not very smart...that's why they're liberal.
