Media Welcome OTaxaCare With Open Arms

In the blink of a shocking Supreme Court ruling Thursday, the President's signature piece of legislation went from ObamaCare to OTaxaCare.

Not surprisingly, the Obama-loving media didn't mind that despite promises from their hero his healthcare reform wasn't a tax, according to the highest court in the land, it is.

I guess many of these folks forget that it was imperative to the President and his party that his healthcare reform proposal wasn't a tax, for they knew Americans including many Democrats wouldn't support such a thing.

Such was made infinitely clear in a September 2009 interview the President had with ABC's George Stephanopoulos:

GEORGE STEPHANOPOULOS, ABC: I wanted to check for myself. But your critics say it is a tax increase.

PRESIDENT BARACK OBAMA: My critics say everything is a tax increase. My critics say that I’m taking over every sector of the economy. You know that. Look, we can have a legitimate debate about whether or not we’re going to have an individual mandate or not, but…

STEPHANOPOULOS: But you reject that it’s a tax increase?

OBAMA: I absolutely reject that notion.

On Thursday, the Supreme Court absolutely rejected his rejection.

In so doing, ObamaCare quickly became OTaxaCare, a fact that likely would have been met with far greater consternation from the media before March's oral arguments at the Court.

Prior to that point, much of the Obama-loving media had concluded the individual mandate would be upheld.

Some cocky journalists even predicted as many as eight jurists would move to uphold.

Had Thursday's ruling emerged at that time, the declaration that the penalty for not complying with the mandate was a tax and not constitutional under the commerce clause would have been reported as a huge blow to Obama. Ditto the striking down of the Medicaid extension.

But that didn't happen because oral arguments come first.

There, a fly flew into the ointment: Justice Anthony Kennedy - who the media were convinced would side with the four liberal jurists to uphold -  grilled Obama's solicitor general about the individual mandate in a fashion that left most observers concluding he was clearly opposed to this key part of the bill.

Thus began months of media hand-wringing as the fate of the President's signature accomplishment appeared more dire than originally thought.

The change in sentiment was best exemplified at online trading website Intrade where the probability of the Court ruling the mandate unconstitutional jumped from 35 percent to 65 percent in the days following the oral arguments. It would eventually reach 80 percent.

In a state of utter panic, Obama's press bombarded the print and airwaves with all manner of attacks on the Court as partisan hacks appointed by Republicans with the exclusive goal of championing conservative causes without regard for the Constitution.

The rabid foaming hit a zenith this week with MSNBC's Chris Matthews claiming this "most conservative" Court would have upheld desegregation.

In almost exactly three months, the entire liberal media landscape went from relative certainty ObamaCare would be upheld to almost universal belief it was going down.

So when the news came out the mandate survived, the press got so caught up in their euphoria that they weren't concerned the ruling radically changed the meaning of the individual mandate.

For it to be Constitutional, it had to be considered a tax.

But that's not what the American people or members of Congress were told; it seems a metaphysical certitude key Senate Democrats would never have supported the legislation that way.

Jeff Zeleny of the New York Times said Thursday neither Louisiana's Mary Landrieu nor Nebraska's Ben Nelson would have voted for the bill if the mandate penalty was a tax.

Recall the former had to be bought off with a Louisiana Purchase and the latter a Cornhusker Kickback to support the measure.

That wouldn't have been enough if the mandate penalty was a tax.

How many other Democrats in 2010's mid-term election year would have withdrawn their support if ObamaCare had been more accurately pitched?

And how would that have impacted the public's view of this bill, especially as it's been quite negative since the get-go?

Maybe 70 to 80 percent of Americans would have been against it likely making its passage impossible.

But that's not what happened.

Congress and the public were baited with the notion the individual mandate was constitutional under the commerce clause only to find after the fact that wasn't the case and the only way for the bill to remain intact was for the penalty to be considered a tax.

Did this concern most media members?

Hardly. The broadcast networks gushed over Chief Justice John Roberts calling him "the man of the hour" who "might have saved" the Supreme Court.

ABC's Good Morning America cheered "statesman" Roberts for having "saved" ObamaCare.

NBC's Tonight Show created a mock video of Obama dancing in the White House after the ruling was announced.

Wasn't anyone annoyed about being lied to concerning this being a tax?

Where was the concern that this would also represent a broken campaign promise by Obama to not raise taxes on anyone making less than $250,000 a year?

Or that such a tax would be regressive impacting the middle-class far more than high-income earners?

Such was almost nowhere to be found.

These folks were in full celebration mode because their worst fears - ObamaCare being completely overturned - didn't materialize, and this was clearly a victory for the President they helped get elected and want to see reelected.

But where was the finger-pointing at a President that had been found to have lied to the public to get a bill passed that will impact every American for generations?

And what of the praise for Roberts, a man that had been excoriated by the press since the moment he was nominated by President Bush in 2005?

His ruling was hysterically heralded as being apolitical, and that he had marvelously threaded the needle to re-establish credibility to the Court after such supposedly political decisions as Bush v. Gore and Citizens United.

Yet if these folks had been honest in their assessment, their conclusion would have been that this might be the most political ruling of Roberts' career.

As conservative author and constitutional lawyer Mark Levin said Thursday, this decision was "absolutely lawless."

Declaring it constitutional for citizens to be taxed if they don't make a purchase is preposterous, and someone of Roberts' intellect and background knows this.

However, he clearly either decided and/or was pressured to find a way to uphold the individual mandate irrespective of the Constitution and thereby not only save face for the President but maybe more importantly for the Court he presides over.

Isn't that political? Isn't intentionally behaving in a fashion that might go against your real beliefs in order to appear bipartisan and apolitical actually an act of pure politics that judges shouldn't engage in, especially the highest judge in the land?

But this also didn't concern America's media.

Roberts' clearly political act was to be heralded because they liked the outcome.

So it's not the politics of this Court that bother the press. Oh no.

It's only when the politics don't go their way.

Also interesting is how President Obama (then Sen.) voted against Chief Justice Roberts for the Supreme Court.

Also remember how the libs refered to the 2000 election as the Supreme Court picking our president. In 1973, when the court "passed" the abortion law, it was merely referenced as the right to privacy. They say Roberts did not want to be seen as an activist court when in fact the court just prqacticed judicial activism. never matters when it helps the liberal cause. Its time for oneheck of a Scott Walker size turnout in the November election as we "Turn Out" all these no good Communist liberals in America. In January, we can start putting theses bums, like Eric With-Holder on trial. The new American Revolution is in full swing!

Think on this....suppose we get Romney elected and take the house and senate. Obamacare is repealed. Who doubts that a court challenge follows? SCOTUS has already made the deal! There is nowhere left for us to go.

So, if Congress and the President agree that the tax "penalty" will no longer be applied, it won't exist anymore. There's nothing in the Ruling to prevent that from happening. The Court can not decide policy. It can only uphold or reject it. Someone else must make that policy first. Those people are always free to make new policy.

Both parties are feverishly dreaming up ways to get more out of us...their power corrupts them, even Conservatives who probably had principles before they got sworn in.

The only hope we have is to get more GOP conservatives into Congress..yeah, they'll still take part in screwing us, but gridlock between these two rival gangs may be to our benefit somehow. I've given up on old-fashioned, non-Libtard Democrats ever getting elected again, but perhaps there will be enough at least quasi-Conservatives in the GOP to hold them off.

Unfortunately, I'm losing faith in that happening.

Another "plus" is that the regular posters here lose any sort of personally becoming just another brick in the wall.
Just like all the other THOUSANDS OF SITES.
The teamwork whacking trolls is reduced to a , "don't like" button.
Oh well been nice getting to know most (ha) of you over the years.
Without the tracking feature, the likely hood of me replying to some comment is just about zero, thus saving server space.

I've been using Disqus at the Washington Times for a few years now, and I've seen attempts to "flag" me into non-existence. Those attempts have fail, miserably. I have made something like 1300 comments, and have over 3,600 "likes" and slightly less than 25 "dislikes." (Those "dislikes" are always listed in red font, for some reason) If "like vrs. dislike" is the new ruler, the new measurement of popularity, then I am one of the most loved Conservatives around! Based upon the "likes per comment" ratio, I'm more popular than Obama! Heh.

Roberts voted right

Cad by voting right he has put the ball in the people's court. If you want more taxes (500 million more or less) vote for Obama, if not vote for the other guy. 63 new taxes (and counting) (500 million) stolen from Medicare. Capital Gains tax will go from 15 to 23.8, dividends will go from 15 to 43 they even included a housing tax, sell you home and pay the government 3.5% right off the top. Not only does he get his tax increase on the rich but on everyone else also. When is the media going to wake up, these taxes will affect them also.

His job is to determine the constitutionality of what is laid in front of him. Not to punt the issue back to the people by setting legal precedence that will take a constitutional amendment to overturn.

Thanks to the ruling of this drug-infested "Chief Justice," the federal government can pretty much do any damn thing it wants now, and our recourse will be exaclty jack sh*t - at least through currently accepted legal means.

There is one last hope for the America we once knew, but it ain't coming through the ballot box, as our last chance for that came and went in November of 2008.

Dave - the country really did die yesterday. That's not hyperbole. As I have been trying to tell people on this site, the fundamental relationship between the government and the people has been changed forever. It is an entirely different bond where the government can force its people to do something it would otherwise chose not to do simply because the government believes it is smarter than the people.

Our founding fathers risked their lives to rid this country of tyranny and unjust taxation. This country had victory within its grasp and we blew it. Yesterday I was furious. Today I'm just sad.

The country died in November of 2008 when even Conservatives crossed over to vote for hope and change in order to absolved themselves of the stain of slavery. Their actions were akin to the internet scams that tell you you have a million dollars in Kenya [Interestingly, someone now famous once lived there!] and all you have to do is give them access to your bank account so they can deposit the money. Furthermore, the supposedly principled independents turned this country over to Pelousy and Greid in 2006 starting this painful death. This November we need to go vote with the understanding that RINO's may suck a little but Dems have sucked everything dry. Throw them out of office and into prison!

The "tax", which is in reality a fine or penalty for not having insurance, does NOT provide insurance or anything else to the "tax" payer besides less money in their wallet and somebody else riding for free on your dime.

In addition, a "tax" is supposed to have value attached to it, something that transacted in either services, goods, or money. this is not only the historical definition of a "tax" but is also the historical position of the Courts. As such, the so-called "tax" described by Roberts is a new meaning to the word -- the very definition of activism in the judiciary. BTW, none of the other 8 judges saw his point on this and is at least in part why others in the Majority dissented from Roberts opinion.

The Roberts opinion is seriously flawed and deserves to be litigated out of existence.

There is no product delivered.  You do not get insurance for the exchange of the "tax".There is no value that has been or will be imparted to the individual paying the tax.  Ergo, this is not a "tax" by any current definition, either grammatically or legaly, outside of Roberts whole cloth interpretation.

While I'd like to say this was Robert's intent - to define the Personal Mandate as a tax when it is not as a trojan horse for future reconcilliation - I cannot since he could have voted with the Minority and finished off ObamaCare, part or in whole, now.  Bad, bad, BAD reasoning on Robert's part.

I agree our first line of offense is to obtain majorities in Congress and take the White House.  But we also need to work on additional methods of ridding ObamaCare such as court challenges.

We are both accustomed to every single tax that we ever paid, following the purchase of a product or service.
I'm calling what happened this week a pre-tax...it's really a Robert's decree fee....

I'm aware there is no product, with said tax and I'm also aware there will never be any product or service that will never show up, for my input and loss of wealth....
Here we are sitting on a government bill , that is PAST DUE from the Roberts decree.

Looks like I BETTER PAY IT kuz there are 16,000 new collectors, chomping at the bit, just to let me know how much that is EXACTLY...to the nearest penny.

From Fact Check, if we can believe them:

Refusal to Pay

The law prohibits the IRS from seeking to put anybody in jail or seizing their property for simple refusal to pay the tax. The law says specifically that taxpayers “shall not be subject to any criminal prosecution or penalty” for failure to pay, and also that the IRS cannot file a tax lien (a legal claim against such things as homes, cars, wages and bank accounts) or a “levy” (seizure of property or bank accounts).

The law says that the IRS will collect the tax “in the same manner as an assessable penalty under subchapter B of chapter 68” of the tax code. That part of the tax code provides for imposing an additional penalty “equal to the total amount of the tax evaded, or not collected.” It also requires written notices to the taxpayer, and provides for court proceedings.

So it may turn out that the IRS will be suing those who fail to pay the tax for double the amount. But so far, the IRS has not spelled out exactly how it will enforce the new penalty with the limited power the law gives it.

Who knows, maybe you can qualify for an exemption!

Who’s Exempt?

The law makes a number of exemptions for low-income persons and hardship cases.

“Individuals who cannot afford coverage”: If an employer offers coverage that would cost the employee more than 8 percent of his or her household income (for self-only coverage) that individual is exempt from the tax.

“Taxpayers with income below filing threshold”: Also exempt are those who earn too little to be required to file tax returns. For 2011 — as previously mentioned — those thresholds were $9,500 for a single person under age 65, and $19,000 for a married person filing jointly with a spouse, for example. The thresholds go up each year in line with inflation, so those cut-offs will be higher in 2014, when the tax first takes effect.

“Hardships”: The Secretary of Health and Human Services is empowered to exempt others that she or he determines to “have suffered a hardship with respect to the capability to obtain coverage.”

Other exemptions: Also exempt are members of Indian tribes, persons with only brief gaps in coverage, and members of certain religious groups currently exempt from Social Security taxes (which as we’ve previously reported are chiefly Anabaptist — that is, Mennonite, Amish or Hutterite).

I think we should all declare ourselves American Indian like Elizabeth Warren.

To conservatives who seek comfort in the fact that the SCOTUS found that the mandate is really a TAX - what chance is there that the only partially engaged voters will remember this several months from now? All that they'll remember is that it was found "constitutional". This is a technical decision that only conservative political wonks will appreciate. By the way, can anyone remember just ONE instance when a supposedly liberal judge or politician "surprised" us by voting against a liberal issue and was the deciding vote in a shocking political victory for conservatives? I can't either.

and while the liberals are resting on their faux laurels conservatives get their act together and rally enough votes to replace Obama and gain control of the Senate. 

Maybe 4 months is about the right time for peoples' displeasure with the Roberts ruling to rise to the level where they are agitated enough to make a change.  If the election were much farther away people might have the time to become complacent about Obamacare.

And Roberts' ruling that Obamacare was upheld as a tax instead of  being supported by the Commerce Clause was a big victory.  For one thing, it exposes Obama and the democrats as liars because they are still denying that it's a tax.   Also, it's much easier to go after representatives about something as specific as a tax than it is about something done under a catch-all provision in the Constitution.

Conservatives need to stay angry through October, rally all the supporters they can, and decisively vote the democrats out of power in November.

Problem is, as I see it, that while all politicians lie, Obama, specifically, and the Dems have lied from day one and continue to do so - and  seem to suffer no consequences whatsoever.

Too many gullible fools voted for, and too many idiots will likely vote again for, the worthless grifter - for all the wrong reasons.

I genuinely hope to see the coming election go down in history as THE MOST devastating defeat, ever, for an incumbent politician.

is going to remember this in a few months is if everyone continues to refer to anything having to do with healthcare as the "ObamaTax".

It's short enough and flows off the tongue easily enough(in short it's marketable) so the non-wonks can remember it, and so long as they equate Obama with tax, that's probably the best you can hope for from someone who cares more about "Whos Got Talent" than anything in the political arena.IMO

If it really is a tax, what is the dollar amount or the percentage?
Or is this just some vague 'You owe us, pay up!' kinda tax?
Also, where can I see an insurance card the 30+ million who weren't previously covered will have issued to them?

It's, ahh, complicated

The IRS has a nice, complicated formula used to determine how much "penalty" will be added to your tax bill. It's equivalent to "no more" than what a premium (premium!) policy would cost you on a yearly basis.

In other words, you'll be paying the same amount whether you actually have a health insurance policy or not. The theory being, of course, that the federal government will be forced to pay for your health care if you don't have insurance. A frivolous argument, at best. for it rejects even the notion of county and state assistance, as well as charity.

The federal government doesn't fund everything we do, but you'll never convince Obama of that! He thinks that, not only does the buck stop with the federal government, it also starts there.

The formula phases in over several years and the "tax" is well below premium costs initially. From Fact Check, who use 'penalty' and 'tax' interchangeably, and rightly so after the Roberts decision debacle:

The minimum amount — per person — will be $695 once the tax is fully phased in. But it will be less to start. The minimum penalty per person will start at $95 in 2014, the first year that the law will require individuals to obtain coverage. And it will rise to $325 the following year.

Starting in 2017, the minimum tax per person will rise each year with inflation. And for children 18 and under, the minimum per-person tax is half of that for adults.

However, the minimum amount per family is capped at triple the per-person tax, no matter how many individuals are in the taxpayer’s household.

But the penalty can never exceed the cost of the national average premiums for the lowest-cost “bronze” plans being offered through the new insurance exchanges called for under the law. We have no way of knowing what that average rate might turn out to be in 2014, but there is reason to think it could be quite high. For example, the total cost of a basic Government Employees Health Association plan currently offered through the Federal Employee Health Benefit program (the model for the state insurance exchanges) totals $9,459 per year for a family plan, and $4,159 for individual coverage.

So families of four or more will never pay a tax that approaches insurance premiums.  Of course, it would be moronic to have children. pay the tax, and then have no insurance.  Look for the Left to continue to increase the amount underwhich Federal Poverty Guidelines occur so as to incrementally make sure everyone gets on single payer, Government-run Socialist Medicine.

Here is an ObamaTax calculator to determine at what point and by how much your tax would be.  This uses 100% 2012 Federal Poverty Guidelines and my understanding is it's supposed to 133% of the 2014 Federal Poverty Guidelines.  You still can get an idea of the idiocracy.

Those who have no insurance will be the responsibility of the State first, not the Feds, for the cost of their health care.

ABC News digs up video of Mitt Romney admiting in a January 2008 Republican presidential debate that the individual health care mandate he passed in Massachusetts was indeed a tax.

CHARLIE GIBSON: Governor, you imposed tax penalties in Massachusetts...

MITT ROMNEY: Yes, we said, look, if people can afford to buy it, either buy the insurance or pay your own way; don't be free-riders and pass on the cost to your health care to everybody else...
