Sotomayor Backers Urge Press to Attack Fireman, Will Media Comply?

On the eve of Senate hearings on the appointment of Sonia Sotomayor to the Supreme Court, her supporters are urging the media to attack the Connecticut fireman in the middle of a key ruling she made that could impact the proceedings.

The only question is whether or not Obama-loving press will comply with these wishes...or is that really even a question?

While you ponder, the following was reported by McClatchy Friday:

[Sotomayor's] advocates have been urging journalists to scrutinize what one called the "troubled and litigious work history" of firefighter Frank Ricci.

This is opposition research: a constant shadow on Capitol Hill.

"The whole business of getting Supreme Court nominees through the process has become bloodsport," said Gary Rose, a government and politics professor at Sacred Heart University in Fairfield, Conn.

On Friday, citing in an e-mail "Frank Ricci's troubled and litigious work history," the liberal advocacy group People for the American Way drew reporters' attention to Ricci's past. Other advocates for Sotomayor have discreetly urged journalists to pursue similar story lines.

Specifically, the advocates have zeroed in on an earlier 1995 lawsuit Ricci filed claiming the city of New Haven discriminated against him because he's dyslexic. The advocates cite other Hartford Courant stories from the same era recounting how Ricci was fired by a fire department in Middletown, Conn., allegedly, Ricci said at the time, because of safety concerns he raised.

The Middletown-area fire department was subsequently fined for safety violations, but the Connecticut Department of Labor dismissed Ricci's retaliation complaint.

Isn't that special?

The 35-year-old Ricci was the lead plaintiff in the case Ricci v. DeStefano, challenging New Haven's refusal to promote white firefighters after African-American and all but one Hispanic firefighters failed to score high enough on a promotion exam.

Sotomayor and a majority of the 2nd U.S. Circuit Court of Appeals sided with the city's claim that it was justifiably concerned about a potential civil rights suit being filed by the African-American firefighters. [...]

Last month, however, the Supreme Court overturned the 2nd Circuit by 5-4.

As a result, this case may be a big part of the questioning Sotomayor faces from Senate Republicans next week, and her supporters want to defame the man in the middle of the issue.

Good idea, liberals, NOT! Do you REALLY want to start a smear campaign against an American firefighter in a post 9/11 America? I agree with you - go ahead, bash a firefighter.  "People for the American Way" may just be a little panicky that she is supposedly heading into confirmation hearings with "Harriet Miers support numbers" I read yesterday.  Still the spineless conservatives "just don't see how she won't be confirmed".  This may help them, despite themselves.

Some questions

Is there something wrong with Frank Ricci for having filed these
suits, two of which were civil rights lawsuits that came out in his
favor?

Let's flip this matter around -- would we be having this discussion
at all if Frank Ricci were Frank Richards, a black firefighter who was
denied a job due to dyslexia and then denied a promotion because not
enough whites passed the promotion test?

For that matter, would Sonia Sotomayor have ruled against Frank
Richards in the same perfunctory manner she did against Frank Ricci?

Would liberal groups be attacking him if she had -- or would they be attacking Sotomayor as insensitive on civil rights?

Of course, anyone with an ounce of sense knows the answers to these
questions -- which shows how blatant the hypocrisy and racism of the
liberals really is.

The Dark Side of Empathy

If you allow emotion in your legal decisions to promote "empathy," you cannot help but allow other emotions at the same time. Once you go emotional, you can't go back. Emotion in the law is a Pandora's Box. If you let one out, you let them all out.

Looking favorably on one party to a case means, necessarily, that you look unfavorably on the other side. The whole idea of "empathy" is that you try to see how the party felt when they acted. But empathy is the positive side. A judge can equally look into the eyes of a party negatively. It requires the judge to imagine how the party felt at the time. But that means, literally, that the judge is basing her decisions on her own imagination.

We all know, and psychologists can confirm, that the human imagination can be persuaded and manipulated. It can especially be persuaded by political and social beliefs.

This whole episode utterly politicizes the legal process. There is nothing more central to the law than the neutrality of the process. That's why we don't go by emotion. We go by evidence. Once you "deconstruct" the legal process into a competition over emotions, the law loses all credibility.

That's why having political pressure groups like the PAW, Norman Lear's political lobby, digging up ad hominem attacks is so dangerous. They're trying to sway emotions. And once you promote a legal theory that embraces emotions, you invite this kind of vulgar manipulation.

It would hasten the demise of the MSM faster than any other single hit campaign could possibly do, even the one against Sarah Palin.  I just hope they're stupid enough to commit suicide so spectacularly.

It would be particularly fun to watch them implode over this, but I'd hate to see Mr. Ricci harmed in the process.  He is an ordinary guy, who did the right thing.

Of course, having Sotomayor go down too would be icing on the cake.

Sotomayor will be confirmed in the end, but

the point is to use the confirmation hearings as an opportunity to do as much political damage to Obama as possible and keep the pressure on his agenda, assuming judiciary committee Republicans have a set.

FWIW, I don't think the MSM has the guts to go all out on Ricci like they did with Joe the Plumber, since Ricci is being called to testify and they won't have the excuse that he's putting himself in the public eye. Not to mention the PR backlash that would ensue for attacking a firefighter who overcame dyslexia to pass the promotion test, only to have it denied on purely racial grounds. But Joe managed to turn the attacks to his advantage with paid appearances, so I suspect Ricci would be able do much the same in that event.

Well put. Many conservatives don't seem to understand that this is about Sotomayor as much as it is about the next appointment. By coming close to defeating her, we may clue the Bamster into what the limits are on who he can send to the Senate.

Some democratics are warning that Ricci will go through what Anita Hill went through, which is ridiculous. Hill came up with wild stories out of the blue, unsupported and without evidence. What Ricci will recount are the details of the case that are on the record. No comparison. The Joe the Plumber comparison is more accurate.

It continues to amaze me that groups like "People for the American Way" profess in their name that they represent all Americans when in actuality they represent only a small segment of the people, in this case ulta-liberals.

I am disheartened by the American peoples lack of understanding about our rights. People seem to believe that our rights, spelled out in the Bill of Rights are guaranteed by the U.S. Constitution. They are not.

The Bill of Rights tell us what rights our Creator (whomever that may be) gave us. These rights are only guaranteed if “We the People” are willing to protect those rights. “We the People” must be willing to put our lives on the line to ensure that future generations continue to have those rights, the rights that all humans have.

Those of us who served in the military swore an oath to support and defend the Constitution of the United States against all enemies, foreign and domestic; to bear true faith and allegiance to the same; and to obey the orders of the President of the United States (but the orders of the president have to be lawful orders). “We the People” have the same responsibility as do the military with regard to supporting and defending the Constitution of the United States.

The federal government is continuing down the path to take from us what is NOT theirs to take, OUR RIGHTS. And so far, “We the People” aren’t doing a whole lot about it except complaining. We must take back our government by voting out of office those politicians that DO NOT listen to us. Remember, the politicians work for us, we don’t work for them.

We have to act to protect our liberties, our rights, our freedoms.

Reguardless of Ricci's past history of litigation, the fact remains that he got the highest score on racially neutral advancement test as blessed by the human relations comission.  Once again, the liberals resort to personal attacks when the facts don't support thier case.

Leading the "journalists" around by the nose used to be done quietly and somewhat tactfully. I was listening to Laura Ingrahm Thrusday morning when she commented that Goober was leaning toward the Witch. The only place I have seen it in print is at Huff n Puff. That would make it suspect to me. But knowing the RINO that Goober has become it wouldn't surprise me.

We shall see...if this has been put out there, he probably has been getting calls, but I wonder if it would change his vote any.

Heck, we know she will be seated, no matter what, we don't have the power to stop it...part of the reason they picked her, because she is hispanic, they know the weak-kneed repubs think if they vote against her they will lose hispanic votes....

Which makes me furious, because of course they wouldn't lose any of those votes that would have got or not got in the first place by voting against her.
