Open Thread: Another Childish Slam at SCOTUS

Today's starter topic: President Obama clearly isn't a believer in the phrase speak softly and carry a big stick. He took another angry shot at the Supreme Court yesterday, warning it not to throw out his dreadful health insurance law:

"And I'd just remind conservative commentators that, for years, what we have heard is, the biggest problem on the bench was judicial activism, or a lack of judicial restraint, that an unelected group of people would somehow overturn a duly constituted and passed law," Obama said.

"Well, this is a good example, and I'm pretty confident that this court will recognize that and not take that step," he said.

Once again, however, Barack Obama is peddling a distorted view of what conservatives actually think. Judicial activism refers to judges engaging in striking down laws and then engaging in their own legislating from the bench. A court which avoids judicial activism may indeed strike down all kinds of laws but only if they are unconstitutional.

Today's other topic: The University of Kentucky won its first NCAA championship since 1998, beating the University of Kansas 67-59. While many are giving the Wildcats their due, some are critical of UK coach John Calipari's "one and done" idea of recruiting players and keeping them on the team for a short period of time before they head to the NBA. On the other hand, considering that colleges themselves make hundreds of millions of dollars from their unpaid "student-athletes," isn't this system more fair to people who'd like to capitalize on their skills and bodies being at their top condition?

College Basketball is, and has been for many years, the minor league to the NBA. They are NOT student athletes, they are professional athletes that are auditioning for big money contracts.

I like your notion of "auditioning" for the bigs.

As any big college program knows, the competition for the top high school athletes is fierce, and often the recruiting hinges on things like immediate playing time, and how many players at that program go on to the next level.   Can't blame Calipiari for his "system"....it keeps the money coming in, and the rest of the athletic program at KY funded.  And delivers the swagger, too.  Which is always a good thing when it's your school.

Obama's total misrepresentation of the Supreme Court's Constitutional role and history is beneath the dignity of the office he was elected to. Even some Leftist pundits are conceding that he is completely wrong on this.

If Obama intends to run against the Court should his precious legislation be deemed un-Constitutional, I believe it will cost him votes.

Is it any wonder that so many Leftist lawyers try to reinvent the Constitution when they've been taught by the likes of Obama?

As for college football and basketball, let's drop all the pretense at amateurism. Let the colleges pay the players what they are worth and stop exploiting them.

To get to a socialist dictatorship, the "laws" that are passed by the legislature, and orders issued by the POTUS, must supersede our restrictive constitution.

So, Obama and the left want the court to eliminate the constraints that are the US Constitution, but uphold the laws passed that greatly extend the power of the federal government beyond those constraints.

The get it, they want it.

With the full knowledge of, and a warm welcome for the coming tyranny.

Obama directs Justice not to enforce DOMA

Defense of Marriage Act (DOMA) was PASSED by CLINTON and Obama directs the Justice Dept. not to enforce. The irony here is amazing and the LSM won't see it. He is a (deliberate) lying enemy of the State. Congress should do their job and impeaching the traitor. The Supreme Court, in this case, is doing exactly what it is supposed to do. Judicial activism is when they add, ignore or legislate from the bench even when the people have VOTED otherwise. Like on homosexual marriage and abortion. There is NO right to kill another innocent person because they are inconvenient. Science proves a human life starts at conception. Proven fact.

He didn't seem to have a problem when a federal judge struck down their tough immigration enforcement law.
What about the states that have enacted more stringent voter ID laws only to have some federal judge strike it down.
Then we can take a little trip to California and talk about the ban on gay marriage that once again...is struck down by a judge.

Look to Wisconsin and the shenanigans that the judges in that state have pulled with the recall election.
They are actually tampering with the process with their authority.

Then why don't we examine his early career and look at how many times he had somebody knocked off the ballot by legal maneuvering.
He has no credibility on this.

Striking down state laws is what they want the SCOTUS to do. That just strengthens the central, federal, political bureaucracy. They want power in D.C., in their hands, not at the state legislatures.

This is by far, the most Constitution unfriendly administration in the history of this country. Yes, in that regard, they have surpassed FDR.

...the individual mandate is unconstitutional. Only an idiot would attack the Supreme Court Justices for so-called "activism" if he thought there was a chance that the Court hasn't decided the case when it met last Friday. Would any President make such an ignorant comment about the Court if he thought he might still get the "swing vote" of Justice Kennedy?

Obama once again proves that he's the most arrogant, narcissistic and incompetent President we've had in at least the past 60 years. There's only one explanation that could account for a Constitutional Attorney like Obama for slamming the roll of the Court prior to their decision; again he must already know the individual mandate will ruled unconstitutional.

Regarding the NCAA championship, I don't believe it merits any attention on the same Blog about Obama and the Supreme Court.

you and I are so in agreement that kagan should have recused. I was speaking with a friend of mine (lawyer) who teaches constitutional law and he told me she can recuse right before the vote if she chooses. I didn't know that- I thought it had to be done before arguments started. It will be interesting to see if she goes that route.

That she would be a latina smart enough to view her "historic" appointment to the Supreme Court to become the very best jurist she could be, rather than to blindly follow the ideology that placed her on The Court. If it were me, reaching the pinnacle of my profession that way, I would spend quite a bit of time reviewing how I'd arrived there. What did I do right, what did I do wrong? And then go from there.

What she did "right" that got her to the SCOTUS was to be completely and utterly ideological and dogmatic. She was appointed to the SCOTUS to be a counter-weight against Roberts, Alito and Scalia. The same is true for Sotomajore. It's just that intelectually she is a light-weight when compared to them. She should be assigned to write the dissenting opinion just to show how ideological and unConstitutional she is.

I wouldn't be surprised if Kagan was appointed to the SCOTUS specifically because they knew that it would eventually get there for a decision.

Isn't the vote done already?  How else would she know what the results are to leak it?(I agree, I bet she did leak it too)

Regardless of what happened with the SCOTUS, this is just one more example of why this dictator needs to be dealt with by Congress, but it's infuriating that they just chastise him for his comments.

Rush mentioned in his show that during the Q&A of this thing, that apparently the "wise latina" didn't know that hospitals are required to treat people anyway (she suggested that it should be done before realizing that it already is), and if she has any decency in her, she should add her vote to strike this vile concoction down.  I use that the same way a mad scientist would put some kind of drink together that tastes nasty and says it's good for you, a vile concoction.

This dictator has done SO many things, it's just patently absurd that it's gone on this long, but as many have noted, including myself, the fault lies with Congress for not taking any action at all to stop him.  I also fault the American people for letting this happen as well.

Much was made of obama's magnificence before he had even been elected. Who was he comparable to....JFK?, Lincoln?, Truman?, Reagan?.... well now we know. He's like FDR. FDR also saw the Supreme Court as an impediment to good government and sought to neutralize it through packing of the court with his appointees. If that idea hadn't already been tried and failed you know obama would be contemplating such a devious plan.

I wonder if somebody has leaked the vote SCOTUS took on Friday. If they had that would be an impeachable offense. I would point the finger at Kagan because she has his ear. She helped in writting of the defense of Obamacare. She should have been made to recuse herself. She has no honor as far as I am concerned and she does not merit my respect.

but I heard in the last episode they mocked Romney's father. This is unbelievable. The man is dead, Romney isn't official, but they felt the need to mock him.

Palin is right, the GOP is completely unprepared for what's coming. They blamed her for the firestorm, when the truth was, Obama was to blame. It doesn't matter who the opposition is, they'll be dragged through the mud, including their families and ancestors.

This is from a letter written by a family member to the NAACP dated March 26th:

"You will recall the incident of the beating of the black homeless man Sherman Ware on December 4, 2010 by the son of a Sanford police officer. The beating sparked an outrage in the community but there were very few that stepped up to do anything about it. I would presume the inaction was because of the fact that he was homeless not because he was black. Do you know the individual that stepped up when no one else in the black community would? Do you know who spent tireless hours putting flyers on the cars of persons parked in the churches of the black community? Do you know who waited for the church-goers to get out of church so he could hand them fliers [sic] in an attempt to organize the black community against this horrible miscarriage of justice? Do you know who helped organize the City Hall meeting on January 8, 2011 at Sanford City Hall?? That person was GEORGE ZIMMERMAN. Ironic isn't it?"

Of course, if he's not a racist, that really hurts the "hunted him down like a dog" position taken by the professional race-baiters.

First Obama was trying to run against the "Do-Nothing" Congress. Then he tried to stir up the Class War with the OWies and the 1%. Then he moved on and tried to stir up a mythical "War on Women". When that didn't work, he jumped on the Racist Rhetoric band wagon, joining the race-baiters Sharpton, Jackson, Farrakan, et. al.

Now he's jumped on the Supremes. There is absolutely nothing he is for (well, I take that back, he's for pie-in-the-sky alternative energy).....it's now his "poor me, nobody loves me, everybody hates me"....they won't let me win!!!!

Let's hope so because I'm real concerned after the comments he made the other day, in full view of two other world leaders which wouldn't have or at least shouldn't be done in a professional setting, let alone political. 

I have that nagging fear as well and it got stronger after yesterday.  He's not doing political grandstanding anymore, this was a threat, hell, IS a threat against the country as a whole, not just the different states that he's declared war on like Arizona, Louisiana, Texas, and etc.

People need to be ready to take action before he does.  And he will, not that he might, this was a warning salvo.

Even though I always thought that Diana Ross was kind of a diva beee-yatch with a less-then-unforgettable voice (and quite possibly the 'real' perfect candidate to be Boy Baraka's wife!!), I always liked the Supremes a lot - especially in their earlier days. And the were 'black' - I don't know why Boy Baraka is trying to intimidate them.

And my cat Oreo, who is also black and white (but not RED all over) is as much a 'Constitutional scholar' as Boy Baraka will ever be - the ONLY time I hear him talking about the Constitution is when he's either complaining about the way it was written, or trying to circumnavigate it to achieve a result that would never happen if it was compared with the directive of the Constitution.

Vein Drip probably overdosed on meth after staying up so many days and nights, posting inane, dumb, and moronic responses.

Zimmerman as supposed black community organizer? Interesting. I'm still not sure good deeds erase bad deeds. Or Crimes. But let's see how this plays out.

So far, Zimmerman's defense is that he was getting his a$$ beat, and was left with no choice but to shoot, even though the cops were on their way. Who started the fight, if indeed there was one? We know who ended it...

The more details there are, the more questions we ask.

As for Obama's comments, even Tucker Carlson agrees. Ron Reagan didn't exactly sing the praises of Roe vs. Wade. His comment was addressing that the Court should not rule on politics alone.

I've said all along I'd like to find out what happened. I do feel its unlikely that an unarmed black kid would attack a grown man with a gun. There are tons of questions about the case, and people in the streets want a trial. But there will be no trial if Zimmerman is not arrested.

Come on.....do you think Casey Anthony was guilty? Given the evidence? I do....every member of the jury did too....but they kicked her because there wasn't sufficient evidence to find her guilty beyond a reasonable doubt.

I wasn't talking about cops profiling in my post. I was referring to Zimmerman profiling. There was no suspect when the cops were called, because there was no crime. Zimmerman thought the mere presence of Martin was enough reason to call the cops.

Looking for a suspect doesn't have anything to do with racism.

As I said, Zimmerman didn't go after Martin because of his race. He didn't identify his race until asked, and then he was uncertain. There have been several instances of Zimmerman standing up for black people, including tutoring black children.

You don't do that by letting them do the crime. You run them off by making them uncomfortable enough to move to new turf that is not watched. That is done by reporting people so they get the hint. If innocent the person stopped would be happy the watch and police are doing their job and the homes are safe.

Still haven't answered that one.

We can stop crime by calling police everywhere. When I walk down the street, I see a lot of peole I don't know. They might be plotting to rob and kill me. I should probably contact authorities about them. Everywhere I go, there are people I do not know. Should we have cops everywhere, to stop crimes from happening? How far does that go?

Don't you gun people have guns so you don't have to call the police? What was Martin doing that police had to be called?

He was in a gated community where there had been a number of recent home-invasions and he fit the description of the people committing the crime. If a cop saw him and didn't ascertain why he was in the area, he would have been derelict.

And, had Martin not run and then doubled back to attack Zimmerman, he'd still be alive.

I think it's perfectly fine from a law enforcement standpoint to be cognizant of people in a community who fit the description of known or reported criminals; that's how law enforcement works -when offenders don't turn themselves in. That's why there are sketch artists. That's why the dispatcher asked for a description of the suspicious person. The description is a way of eliminating parts of society from the suspect list.

In the case of Martin, he was described as (in no particular order and from memory, so I could have a detail wrong -but I'm not looking up the transcript again for this point) a young, black male wearing a gray hoodie, jeans or sweatpants, and white tennis shoes. This information was distributed to units en route so they knew who to be looking for. You seem to comprehend this, but only because the subject is black you've determined it's also racism - again, loading you're argument with straw men. Why isn't this sexism? Or some conspiracy to put Nike out of business?

No one is suggesting that every black male is suspected of a crime (except you, of course), but since young black males had been breaking into houses in the area, unknown young black males in the area are "suspicious". And a responsible resident will report them to local authorities who will then question the suspicious person to determine why they are there. No, in some some ways it's not fair. But had Martin been available to police he would have been able to explain that he was visiting his father's fiancee who lived in the community and police would have let him go on his way. No big deal. Nothing more than an incovenience. And if Martin felt that way, he should blame the local young black male community for committing crimes that ultimately make him look suspicious. But Martin made it big deal with his immediate distrust or disrespect toward authority figures (by running) --which added to his suspicious nature-- and then made it worse when he doubled back to confront Zimmerman.

There is a huge difference between reporting to authorities a suspicious person and having authorities check that person out, and "racism." Besides the fact that more information keeps coming out about Zimmerman and by all appearances, he doesn't have a racist bone in his body. The racism angle was fabricated by supporters for financial? or political? gain, and the media to sensationalize the story. The evidence clearly doesn't back up the accusation. And it's why your side is ultimately trivializing actual racism by assigning it to every issue where skin color is diverse. You're doing victims of real racism a disservice.

You even mentioned how police used profiling in the case of the DC Sniper, and in doing so got it completely wrong. Profiling is ineffective. Statisically, most serial killers are whites. Does that mean when a serial killer is on the loose, you will report every white person you don't know as a possible serial killer?

Do you really think its effective law enforcement to answer every call on "unknown black males" in a neighborhood?

Do you even know that every time Zimmerman reported a suspicious male, it was a black male? Do you think its just coincidence? Or something else?

I understand that you may want to call someone to stop a crime from happening. But deciding to call the cops because you see a black man is a decision purely based on race. That is discrimination, and it is racism.

We need to have a trial so that we can ask the questions to find out what happened.

And if there were no white criminals in this particular neighborhood, it makes sense that none would be reported. It is just the particulars of this case. My point was that it is not surprising that criminals would act suspicious by nature of what they ARE doing. So in this case, if the theiving gang was black, blacks would be reported. Simple logic. And this was not reported based on race but on behavior.

Today I heard that in all the calls Z made, he did not mention race at all until asked. And even in this case, he had some doubt as to race by the way he stated it. Z would have been more definitive if he was reporting him JUST because he was black. Not the case at all. The facts clearly support Z.

Don't verbally threaten someone and then attack them (on record). That is being a thug. What is all this talk of bullies, yet T was not trod out as an example of a bully? You don't go around beating up citizens you find annoying. Evidence points to his lack of respect and now he paid the price for something he thought was "positive" in his sad value system.

See, moron, the closest black family from my 'neighborhood" is about 20 miles away, so a young black man, or woman, even, would definitely be suspicious, so yep, the Sheriff would be called. 

And, if I saw them at the foot of my 300 foot driveway, I'd go investigate, and you can bet your next welfare check that I'd be armed when I went.

Whether Zimmerman volunteered the information about Martin being black is irrelevant. He has been shown to consistently call the cops because there are black people in the neighborhood.

Are you reading impaired as well as factually impaired?

Here's what I wrote:

Come on.....do you think Casey Anthony was guilty? Given the evidence? I do....every member of the jury did too....but they kicked her because there wasn't sufficient evidence to find her guilty beyond a reasonable doubt.

Do you not understand the concept of "reasonable doubt"?  There were many many pieces of evidence in the case, Anthony's "Auntie Zetunie" lie, the dead body evidence in her trunk, the shovel and duct tape, her erratic behavior and ever changing story. That evidence leads me to believe that she in fact did kill her daughter (and the jury also felt she had committed the crime).  However, the prosecution was unable to tie the pieces into a whole which proved her guilt, beyond a REASONABLE DOUBT.  That is the legal standard. 

The prosecution more than likely knew this going in, but rolled the dice. 

You "suspect" Zimmerman, yet you can't prove anything at this point, and CERTAINLY not his motive(s), which you claim is RACISM.   The evidence thus far indicates Zimmerman acted in self-defense, yet you continue to deny this.  You are drawing conclusions out of thin air, and you & the rest of the race-baiters want to convict this man without a trial because of your liberal guilt, regardless of what the law concludes.

Too bad for you that's not the way our system of Criminal Justice works.  Why don't you just sit back and relax, the Grand Jury will be empanelled on April 10th.

Now, why don't you comment on those six black kids in Toledo who beat up a 78 year old man saying "This is for Trayvon".  This is what you and the race-baiters have wrought.  And before you whine "source that"....it's on the front page of Drudge.

You said that I "' 'suspect' Zimmerman, yet you can't prove anything at this point". Are you suggesting you don't suspect Casey Anthony? Can you prove that she did that to her daughter?

As humans, we both respond emotionally to tragedy, and do make personal judgements on who we feel to be responsible for those tragedies. I dont judge you for suspecting Anthony, but you are clearly trying to judge me for suspecting Zimmerman.

What evidence, besides Zimmerman's word, says it was self defense? The eyewitness you're going to talk about saw a scuffle, but theres no telling who started the fight, and whether Martin actually was trying to kill Zimmerman. Fights are not usually thought of as attempted murders.

No one wants to convict this man without a trial. They want the man arrested, so a trial can take place. No matter how many times you repeat this lie, it still will not come true.

I've explained several times why I believe what I believe. But you continue to ignore my point.

And you also keep sourcing stories that further highlight the difference between white and black victims of violence:

"The boys on Monday were ordered held in detention at the Lucas County Juvenile Justice Center, prosecutor Lori Olender said."

You're only proving Sharpton and Jackson's and MSNBC's point. When the victim is white and the offender is black, justice moves very quickly.

About "beyond a reasonable doubt"?

The jurors in the Anthony trial believed she was guilty as well, but according to our legal standard, beyond a reasonable doubt, there was not a preponderance of evidence to return a guilty charge, therefore she was aquitted. THAT is our system of jurisprudence.

I believe if the facts of the case on the night of the shooting were found to be such that it was beyond a reasonable doubt that Zimmerman pulled the trigger without fearing for his life (in accordance with the Stand Your Ground Law), he would have been arrested. But of course, you and the rest of the lynch mob want a show trial to assuage your liberal guilt, the facts of the case be damned.

You lose the argument every way from Sunday, and that's the best you can do? Try to make this all about me?

That's just Creepy, creepy, creepy.

Again, I'd urge you to take a remedial reading class, because you read things here that aren't there. I never indicated I thought the outcome of the Anthony trial was wrong, just that I agreed with the members of the jury...that the preponderance of evidence didn't reach the legal barrier to convict her.

The case of Martin was never closed, we'll never know if Zimmerman was going to be arrested. You want him arrested based on what you feel about the case, not the evidence the justice system has to work with.
