Bozell to CNN, MSNBC: I Hope You Have Good Lawyers

"CNN and MSNBC were given ample opportunity to come clean, but both are continuing to masquerade malicious lies [against Rush Limbaugh] as credible," Media Research Center President and NewsBusters Publisher Brent Bozell said in a statement today.

Yesterday, Bozell promised to report back publicly with how CNN and MSNBC responded to his challenge to put up – or shut up – proof that Rush Limbaugh actually stated the racist quote that both cable networks attributed to him as fact, or to immediately retract and apologize for their participation in spreading an outlandish lie. 

Talk show giant Limbaugh denied having ever stated, “Slavery built the South. I’m not saying we should bring it back. I’m just saying it had its merits. For one thing, the streets were safer after dark.” Further, it has been established that this was a fabrication pushed through the Internet, intentionally designed to destroy Mr. Limbaugh’s reputation at a time he is attempting to purchase a professional football team.

In addition to this public call to action, Mr. Bozell overnighted letters to CNN President Jonathan Klein and MSNBC President Phil Griffin to ensure both took the matter seriously. Both CNN and MSNBC failed to respond appropriately.

CNN’s Rick Sanchez, who was responsible for pushing this lie initially, had the gall to repeat the lie but this time also attaching Mr. Limbaugh’s denial, suggesting the truth was unclear when the truth is absolutely crystal clear. CNN neither apologized nor retracted.

MSNBC was even worse.  This disgraceful network continued to repeat this smear on MSNBC Live.

Neither showed any initiative to source the fabricated quote, nor did either network retract or apologize for spreading the false propaganda on their broadcast airwaves.  Instead, both CNN and MSNBC repeated the fictitious statement that was created to smear Rush Limbaugh and his character.

MRC President Brent Bozell issued the following statement: 

The CNN and MSNBC ‘news’ networks are guilty of promoting outright falsehoods and purposely using fabricated disinformation created by left-wing radicals to destroy a conservative leader.  There is no grey area here. CNN and MSNBC were given ample opportunity to come clean, but both are continuing to masquerade malicious lies as credible.  

Perhaps if they spent less time fact-checking SNL comedy skits and more time fact-checking what they laughably call ‘news,’ they would have a chance to salvage their tattered reputations, sinking even faster with this intentional character assassination.

We are tabulating exactly who has engaged in this smear campaign and will reveal a complete list of willful participants at a press conference next week.  Everyone now knows that these statements attributed to Rush are lies. Those who have repeated them have 24 hours to retract and publicly apologize – or you will be named among those intentionally engaged in character assassination.

I understand Mr. Limbaugh has threatened legal action. I hope you all have good lawyers.

Okay, now I just have to tell my little story:

Today I picked up an oversized plastic ball for our nearly 4-month-old pup (because he keeps chewing the smaller ones). Oh, and he's a digger. So he's dug one nice, muddy hole in our backyard -- remember, it's been raining a ton here. So today, Eager Pup runs after this huge plastic ball we throw out into the yard for him -- and when he catches up to it, he pounces on it with impressive enthusiasm and rolls over on top of it -- and straight through the little mud pit he's constructed -- somersalting all the way through it. My son said: "Wow! I can't believe it! Right through the muddy hole!"

Yeah, exactly. But I couldn't stop laughing. He's the cutest puppy, and he looked even cuter all covered in mud. However, getting him inside and bathed was not quite so cute...why did I get that darn ball?

His goal is accountability, not litigation.  

Mr. Limbaugh, similarly, would no doubt prefer admissions of wrongdoing to verdicts in his favor.  You think Rush needs the money?  When reading for comprehension, one notes that Mr. Bozell "understand[s] Mr. Limbaugh has threatened  legal action" already, not that he expects Rush to do so in the future.

This follows the Biblical teaching that "a good name is rather to be chosen than great riches."

To further your point, Limbaugh has all the money he needs.  But his reputation can still be damaged.

nwahs, consider this.  Do you really believe that, if Rush wons in court, the media would report it as vigorously as they reported the lies in the first place?  What Limbaugh wants more than winning a suit is to have the media retract the statements openly and publicly to prove that he was wronged.  

Liable and slander are usually hard to prove in court, but not in this case.  You see, the difficulty isn't in proving there was a lie, but in proving there were damages.  Rush being dropped from the Rams bid is about as damaging as it gets.  and if 1% of his audience stops listening, Rush has then lost 200,000 listeners, which is more than a minor sum.  Rush has an easily winnable case.  The question becomes what matters more to him: Money or his reputation?

I do anticipate Limbaugh

I do anticipate Limbaugh filing lawsuits against various media outlets and specific media figures for slander/libel/defamation of character in due time. Rushing into any such lawsuit would be foolish. It is wise to allow time for the potential purchase of the Rams to play out and also time to allow the various media outlets to correct their errors (using that term VERY loosely) or, if they refuse to retract, to futher hang themselves with their own ropes (via their own words). Once all of that plays out, then I anticipate lawsuits will be filed and I anticipate that even though the arrogance of the media outlets and media figures will denounce the suits and predict victory, the Limbaugh will have an excellent chance of winning in a very big way. There is legal precedent on this in support of such lawsuits. Furthermore, successful legal lawsuits of a large scale might force media to go back at least somewhat to journalistic ethics and integrity. Not all the way back to basics, but away from the irresponsible journalism that plagues us now. Perhaps it may force the national media as a whole to actually fact-check properly BEFORE airing their reports. The national media has abandoned basic, proper journalistic procedures and are now not only brazen about it but in many instances proud of that unarguable fact. The Constitution of the United States does not nor was it ever intended to protect the media from slander/libel/defamation of character with such malicious intent.

 

Regardless, Limbaugh wins. His ratings will increase and public opinion will continue to deteriorate against the national media.

Financial harm to Rush

The fact that Rush was harmed financially by willful slander entitles him to be awarded monetary damages.

 Earlier this year  model Liskula Cohen got a judge to order Google to reveal the name and email address of the blogger who defamed her on the now shuttered "Skanks in NYC" website.

Perhaps Rush should seek out Liskula's attorney,Steven Wagner,for information on his experience in dealing with this type of suit.

Financial Harm To Rush?

Unfortunately (from the financial viewpoint), Rush's ratings will probably increase, and unless the NFL turns down Rush's offer and admits publicly it was because of CNN/MSNBC charges, Rush would not have suffered financial harm, but an increase in revenue instead.

Think about when the idiot Harry Reid attacked Rush after his comment about the phony soldier (who was indeed a phony soldier).  After attacking Rush on the floor of the Senate, Reid sent Rush a letter demanding Rush apologize.  Instead, Rush auctioned the letter off, got a $2 million offer for it, matched the $2 million with money of his own, and opened a fund for the children of fallen soldiers (Marines, airmen, seamen, etc) and police.  And his ratings jumped up and haven't come back down since then.

I have subsequently heard Reid take some amount of credit for the establishment of that fund, but he did not even have the decency to say it in a "tongue-in-cheek" fashion. Someone who didn't know the true situation would have thougt that Reid was a supporter of the fund from the beginning.

 

Consider this liberals

There are several attorneys in Rush's family including his brother, so he knows the law and has several resources available to him, so if you numbnuts at CNN and PMSNBC don't do some serious retracting and backpedaling soon, your financial woes will enter a whole new level.

Of course bankrupting both your worthless networks and draining the swamp of all your political hacks and putting them in the unemployment line would a good step forward, in that case keep it up.

Rush Limbaugh could have sued these jokers a million times over, for being quoted out of context or mis-quoted, but outright fabrications of slander and libel are another situation entirely. I hope he sues them into bankruptcy (it wouldn't take much, given their ratings).

Quite the reverse, at least in the Canadian system which I learned in journalism school.  (Yours is probably the same, since they have the same roots in the British system.) 

If a libel/slander case goes to court, the defendant is required to prove that the statement(s) they made are true, in which case the "libel/slander" is in fact fair comment.  The plaintiff has only to prove the statements were made; they do not have to prove the statement is false.

This stuck in my mind because it is one of the few situations in the legal system where the defense is required to prove anything; in most other cases the burden of proof lies with the accuser (the state or the plaintiff), but not in the case of libel/slander.

I doubt that they have good lawyers, if how they run their business is any indication. Their lawyers are probably as good as CNN's A/V department -- you know, the one with such a horrible Q/A process that they let out an ad that totally exposed themselves as liberals?

Not only can he sue the two networks, but he can sue the CEOs espeically Jeffrey Imelt since he has personally pushed the careers of the individuals who are maintaining those lies.

I am certainly no Rush (L) fan, but I find myself rooting for him nonetheless. I would love to see these BS network(s) publicly humiliated once again.

I'm old enough to remember when, after several failed attempts to illustrate how a certain Detroit-made pickup truck would explode on impact, NBC News put a couple of explosive charges on the undercarriage to help bolster their argument.  

They got caught, yet the public STILL regards -- even to this day -- NBC News as a legitimate news source. Maybe now, with the internet shining the inescapable light of truth on their shenanigans, these shamless big-government shills will be shown for what they really are, and it will stick!

Listened to Rushbo today

Was impressed with his journalistic integrity (despite the fact that he's NOT a journalist) on his reporting of Jesse Jackson, Al Sharpton, and Rick Sanchez's "indescretions" over the years, with specific references and fact checks.

If he keeps this up, MSNBC, ESPN, CNN and other networks will be asking him to stop butchering their "reporting" techniques.

This morning Scarborough, surprisingly, debunked (with graphics) the "Limbaugh is a Racist" comments by his own and other so-called news agencies.

It was a milquetoast effort at best, but for MSNBC, any effort made to correct the countless fallacies they broadcast as their "version" of The Truth, is worthy of comment.

I honestly hope he sues and wins big time. This would be a big one for all conservatives and when he wins (as he would in any fair court) it will make the media think twice about smearing all other conservatives like they did McCain, Palin, Beck, etc.

This issue was never about fact checking. This lib tactic of labeling people racist and fear mongers is an attempt to silence all opposition to the corruption in DC. The libs have attacked Palin, Beck, Rush, and others not to clarify information, but to gag the speaker.  It is never about issues. As they become more empowered, they intimidate sponsors and associates of the opposition. This will continue until, we the people, tell them we had enough.Destroy credibility of the opposition is the goal. This is, to me, an effort to control the media when the true agenda of this administration becomes "open" and "transparent". Then there will be no one around to report the truth. Hopefully, NB and Bozell and friends will always be there.

Does Rush go after the leftist/libelers/liars on principle?  Forty-six plus years in Civil Service proved to me that Affirmative Action, the favoring of minorities, much like a parolee released after many years of confinement, has become institutionalized.

Noting the racial charges thrown at Rush, whether as snarky asides or in the hopes the charge would stick like napalm, seem to me to be symptomatic, and unfortunately, emblematic, of our times.

If he sues, if he wins; does life change for the average citizen trying to carefully pick his or her way through the mine field of politically correct conversation?  I doubt it.

It appears to me that Rush has been wronged, and I truly hope he becomes litigious and kicks some butt.  I also hope that if and when he wins, it does not turn out to be a Pyrrhic victory.

In an attempt to finish on a more positive note, (sort of), I do believe in the saying " It is better to die on your feet than live on your knees."

          Personally, I hope they have bad lawyers. I have listened to Rush for a long time. He NEVER said these things. The left has said worse, calling the citizens stupid, swastika wearing, terrorists. Yet nobody on the left seems to care about that. Two faced, double standard.
