Imus can defend on the public figure argument. Second, if that doesn't work, the cool thing about defamation cases like this is that the woman's sexuality is a key issue to the trier of fact. Therefore, the defense has every right to dig into Ms. Vaughn's sexual history and relay that information to the jury. I am stereotyping; however, I am willing to bet that being a hotshot basketball player, Ms. Vaughn has had sex either with a man or a woman. I am also willing to bet Ms. Vaughn has acted like a "ho" atleast once in her life. Again, just a gut feeling. Tie into that argument all of the 1st Amendment arguments, the inflation of the controversy by Sharpton and the common usage of the term "ho", I think Imus has a strong case.
Ms. Vaughn has the burden of proving that she isn't a ho to the trier of fact. Considering she is acting on this frivolous claim, the trier of fact will most likely find her to be one. As well as an uppity bee-otch!

They must prove that actual malice occurred: i.e. the information was published with theknowledge that it is false or if you publish with reckless disregard.Why do you think liberals get away with calling President Bush anything and everything?? Public figure rule.
Plus, think about this, Imus never singled anyone out by name. He was talking about the "group" as a whole. Her chances of winning this case are almost non-existant because of this. It's like a Muslim saying "American's Are Killers!!!!" and me, being an American, taking offense and suing the guy for defaming me.
The bottom line is that her attorney's KNOW this but are keeping their fingers crossed that Imus will cave into pressure and settle. I hope he doesn't.

I would wager, Ms. Vaughn has heard the Imus phrasing, and much much worse, hurled at her sisters in the female black population. While Imus's comment was directed at her team, he did NOT single her out by name. And neither do the rap and hip-hop artists who consider females (black females, if you go by the music videos) much worse than Imus's fast and loose and harsh jab at a sports team he was NOT cheering for in the tournament.
We have a rival high school whose team mascot is a bulldog. When referring to that high school ladies sports teams it is not uncommon to hear them called "bitches" ... a la female "Bulldogs".
You can watch any sports channel and hear the TV anchors rambling on calling different sports figures just about anything under the Sun. Which is why Keith Olbermann is more suited for that area of the broadcasting world, than trying to pass-off what he is shoveling as objective news reporting ...
It's sports. Get tough skinned and get over it, or get out. And don't run for POTUS. You'll never survive what Pres. Bush has to deal with on a daily basis.
