CNN Legal Analyst Pooh-Poohs GOP Accusations Against Holder
Dismissing Republican accusations against Eric Holder as "politics," CNN legal analyst Jeff Toobin claimed that allegations of corruption against the Attorney General have "not been proven at all, at least as far as I can tell."
Exasperated anchor Carol Costello teed him up by wondering why Republicans in Congress won't believe the Attorney General's admitted ignorance of tactics used in the infamous "Fast and Furious" operation. "Eric Holder has testified before the House Judiciary Committee nine times. Each time he has admitted 'Fast and Furious' was a dreadful mistake, and each time Holder says he was unaware of the tactics of the operation," she insisted. [Video below the break. Audio here.]
Has Holder really acknowledged the scandal and admitted ignorance during all nine testimonies before Congress? In February, when Holder was asked if the operation was a "mistake," he did not say that it was, but rather that he would have "modified" it.
And when offered a chance to apologize to the family of murdered border patrol agent Brian Terry, at whose scene of death the guns appeared that were involved in the operation, Holder would not apologize. He expressed "regret" and insisted that the operation may not have led directly to Terry's death.
"I think this is mostly show business one way or another," Toobin said of Republican threats to hold the Attorney General in contempt.
A transcript of the segment, which aired on June 13 on CNN Newsroom at 10:09 a.m. EDT, is as follows:
CAROL COSTELLO: So what I'd like you to do is douse us with reality, because this has become very partisan, this argument over Eric Holder. Eric Holder has testified before the House Judiciary Committee nine times. Each time he has admitted "Fast and Furious" was a dreadful mistake, and each time Holder says he was unaware of the tactics of the operation. Why don't Republicans believe him?
JEFFREY TOOBIN, CNN senior legal analyst: Well, this is really much more to be filed in the category of politics than law. I think, you know, this was a terribly conceived plan. It is worth pointing out, as you just did, it started in 2006 in the Bush administration, but it was continued in the Obama administration, and it was a bad idea. The heart of the complaint by the Republicans against Holder is that he is somehow covering up his role in it and there's a big dispute over documents. Has the Justice Department produced all the documents that the congressional Republicans want?
Now, this is really a traditional fight between the legislative branch and the executive branch. They are often fighting over which documents can be made available to Congress. But the idea that there is some sort of corruption here that there is something sinister has not been proven at all, at least as far as I can tell.
COSTELLO: So then why doesn't Holder just turn over the documents?
TOOBIN: Well, he has turned over a great many documents. One of the ways that the Justice Department and the Congress always fights is, Justice Department says, look, there are certain internal documents that are not Congress' business. That are not subject to congressional investigation. That came up in the Bush administration. It's coming up now. That is the heart of the dispute that's going on now.
COSTELLO: So Republican lawmakers are threatening to hold Holder in contempt. Holder says that would create a constitutional crisis. So would it?
TOOBIN: I don't think so. I think this is mostly show business one way or another. I think it would be embarrassing for Holder. It would be unpleasant. And I think that's really the goal of what's going on here. Eric Holder, despite the wishes of apparently some in Congress is not going to be hauled off in handcuffs. This is likely to peter along until the end of President Obama's term, or his first term. And then presumably Eric Holder will leave at the end of this term. He has more or less given a signal he's not going to stay on, but I don't think there's going to be any sort of constitutional crisis, or for better or worse any resolution, until the election.

Toobin hates Mexicans, or else he'd be interested in how involved Eric Holder is in the facilitation of the deaths of more than 150 of them.
Toobin hates law enforcement officers for the same reason.
If this were a break-in at a psychiatrist's office, Toobin would be all up in arms trying to win a Pull-it-surprise, but since it's simply a bunch of dead Mexicans and a Border agent, Toobin supports the President.
What an ignorant little man.

Toobin's comments that Fast and Furious is "just politics" just confirms what we already know about him: he's a squashed road apple with zero morals, zero honor and zero ethics.
Breaking this down as a psychiatrist (good example, Cool!), Holder displays the same characteristics as his boss. Holder is pathologically incapable of telling the truth. He refuses to accept responsibility for what his department has done. He refuses to acknowledge Congress' authority in the oversight of executive function and hisses and threatens at a "constitutional crisis", believing somehow that's the equivalent of the same hollow threat we have heard from other administrations that have tried vainly to dodge accountability for their malfeasance.
If it were a Republican AG in this kind of trouble, Toobin would be wetting his pants and screaming like a four year old girl getting her first Barbie. The longstanding principle of being in charge of a department means you accept ALL responsibility for what happens under your management, even if you don't know all the details. It happened on your watch and you failed to stop it or you failed to punish those responsible. Sacrificing the US Attorney for Arizona and some ATFE agents was deplorable, because it is obvious that an operation of that magnitude would not have been run without White House or DOJ knowledge consistent with the micromanagement pattern we have seen in them.
Then comes Toobin's spittle-drenched support of the "executive privilege" asserted by Holder and the DOJ. Funny how the hypocritical SOB certainly didn't think that was the case during the Bush years. I don't give a good Goddam what the political fallout might be for Republicans if they vote to have Holder in contempt of Congress. It's time the Republicans showed some spine and then use Holder's refusal to account for *150 plus* dead Mexicans at his hands due to gross incompetence and criminal mismanagement of a program that existed solely to influence US domestic policy. This should be shown to every Latino community on the border states and they should be told that this is what Obama and Holder really think of Latinos.
Executive Privilege and Criminal Activity

Executive privilege cannot be invoked to shield the executive from criminal wrong doing. I do not believe that the President has invoked "executive privilege" as part of the refusal to turn over documents to Congress.

This scumbag is either guilty of criminal conduct (knowingly running F&F) or gross incompetance, either of which TOTALLY disqualifies him for his office.
If the former, he should be tried, convicted, and put in prison (general population).
If the latter, at the very least, he should be fired. Either way, he has no leg to stand on for keeping his job. Any politics injected into this issue are solely due to Holder and Obambi.
Issa needs to keep doggedly pursuing this to its conclusion, and the Republicans better start jumping up and down to get a pair to finally drop. Spinal fortitude and plain old BALLS is all it will take. When will they realize Americans like and respect courage, and when Americans hear what actually went on and why, they will be behind this investigation. Political rhetoric and whining from the Obamaites will not save them.

Sorry Jeffrey. The Willful refusal to comply with a lawful subpeona is a corrupt act. Futhermore, the numerous "corrections" that Holder had to make to his testimony after documentary evidence to the contrary emerged may form a basis for prosecution, if the evasion was knowing and willful.
