Entrapment n. In criminal law, the act of law enforcement officers or government agents inducing or encouraging a person to commit a crime when the potential criminal expresses a desire not to go ahead. The key to entrapment is whether the idea for the commission or encouragement of the criminal act originated with the police or government agents instead of with the "criminal."
It's turning into quite the morning for NBCers to defend the left on Morning Joe . . .
First, Chuck Todd flatly rejected the notion that the MSM failed to adequately report on Van Jones, suggesting coverage would have been a waste of time. Later, Norah O'Donnell came on and suggested that the video of the ACORN employees giving advice on how to evade the tax laws in setting up a brothel with young illegal aliens "might be viewed as entrapment." [H/t FReeper mimaw.]

O'Donnell was careful to disassociate herself from ACORN's actions, saying her comments were "in no way defending what was indefensible, what these particular ACORN employees were doing." But O'Donnell didn't report that others were alleging entrapment: she offered it as her own possible analysis of the situation.
Let's leave aside the fact that, as per the definition, only government employees and not private citizens can engage in entrapment. Even applying the spirit of the definition to the facts at hand, it is clear that no entrapment occurred. Readers are encouraged to view any of the videos, as here. The people shooting the video didn't have to twist the ACORNites' arms. Nor did they propose to them any particular tax scheme that the ACORN employees reluctantly endorsed. To the contrary, they presented their situation, and the ACORN tax expert eagerly suggested how they might set up their criminal enterprise.
As with Todd, Joe and Mika were clearly skeptical . . .
NORAH O'DONNELL: I think it should be noted to be fair, though, that this might be viewed as entrapment. That some conservative activists used hidden cameras to get this stuff on camera.

JOE SCARBOROUGH: They can talk about entrapment all they want. Three different offices: Baltimore, Washington, New York, specifically Mika, were giving these people advice, telling them how to break laws, how to lie to the IRS, how to set up prostitution rings. I mean, I don't know that that's entrapment.

For example, if the police have a car parked somewhere with a camera hidden in it waiting for a car thief (which is a common occurance), and they then encourage some kid to go steal the car even though he is expressing no desire to do so, yet they continue to push him into doing it and he does it. If the police car is visible then I call it stupidty on the part of teh drunk. I say the drunk was going to commit the action so the police know this happens. To me it is not entrapment. So do the police arrest the clown on public intoxication when he stumbles from the bar?
The police in my estimation do not have the resources to stand by the bars and trap people anyways much less arrest drunks on the sidewalk. So the logical step would be to see if they are resposible drunks by ordering a cab or alternate means of getting home. If the step into teh car and drive then they step over the boundary.

Real entrapment is convincing someone questionable into doing something that they wouldn't do otherwise.
What was done was videotaping what was considered a matter of course, something that was apparently standard operating procedure depending on the situation. According to Hannah, she and her "pimp" were taken ahead of others in the waiting area, "fast-tracked" if you will, to have the discussion of tax evasions and re-defining what it is that a prostitute would do. (entertainment!)
It wasn't something that they expected to work to get(like trying to con someone into doing something), they got it because it was normal for that to happen and it happened at 4 different places the same way!
Nope, no entrapment needed. Nice try, liberals, sauce for the goose!

It is my sincere hope that the IRS is pulling every return prepared by the "tax expert" in the ACORN Baltimore office and going over it with a fine toothed comb. Let's see how deep this thing goes. Baltimore action is doomed to fail

Can anyone believe that either woman or ACORN would allow this to happen? Just imagine the can of ACORN worms and maggots that would be opened by a great defense attorney if this action went forward. The first thing I'd call for would be an opening of their financials for investigation to see if these women had covered up other federal crimes and no way ACORN is going to allow lawyers and accountants to pour through their books.
