As Dem pundits go, I normally find Kirsten Powers among the more reasonable. But on this afternoon's Fox News Watch, Powers propounded an incendiary theory of the Gates/Crowley incident: that the sergeant "lured" and "tricked" Gates into coming outside so he could arrest him.
Panelist Jim Pinkerton had just made the point that it was only the conservative media, by focusing attention on the matter, that saved Sgt. Crowley from a "miserable life in Cambridge" at the hands of Prof. Gates, Harvard, the NAACP et. al, when Powers jumped in . . .
KIRSTEN POWERS: It was an absolute abuse of power. He was in his house, and he's being rude to a cop. And so he lures him outside so he can then arrest him for domestic disturbance. I mean, that is an abuse of power . . . Arresting a man in his own home and tricking him into—a man with a cane.As I understand the situation and police procedure, all that Sgt. Crowley knew was that there were two potential suspects in the house. Rather than entering the house and subjecting himself to a potential ambush, Sgt. Crowley asked the unknown person, who turned out to be Prof. Gates, to come outside. Would Kirsten have gone charging in?
Note: as an example of the reasonableness that Powers normally displays, just before this exchange she made an eminently sensible observation. Discussing the way in which the 911 caller was widely considered to have been vindicated of accusations of racism when it turned out she didn't identify the possible suspects as African-American, Powers observed: "what if she had? This is what I thought was so strange about it. He is an African-American, so what would be wrong with reporting that you saw an African-American?" Too true, mate.

On the Cambridge episode, she is strictly party line. The Dem spinmasters know that they must continue to paint the cop as a racist abusing his authority at least til the story dies down, because Gates' own slurs -- two weeks ago and years ago -- expose the good professor as yet another racist friend of Obama.
For example, on the Roundtable portion of the Stephanopoulus show this morning, liberal Al Hunt -- parroting the party line -- stated that the Cambridge episode was racial profiling. When Michelle Malkin replied that it was not a case of racial profiling, Hunt responded that we don't know that it isn't because we don't have all the facts (Sound familiar?).
They will all repeat that it was an unwarranted arrest and/or racial profiling so that their faithful lemmings will beleive it.

And typical for a good-looking liberal female TV personality. Most of them have empty heads. That's a bit of profiling you can take to the bank.
As it turns out, a police officer doesn't need to "lure a suspect outside" in order to arrest them. They can be arrested where thay stand, duh. And it's absurd to suppose the officer would have to "lure" the suspect in any case. Anyone that refuses to cooperate with the police is asking to be arrested.
Gates acted like an asshole and deserved his arrest. I'm just disappointed that the charges were dropped.

Crowley's police report suggests there could have been police power abuse. Radio transmissions could certainly clear that up, and not just one. Crowley said his reason for bringing Gates outside was to communicate with ECC. Those transcripts are important. Did he tell ECC he was having trouble communicating? Why is the Cambridge PD hiding the transmissions?

That's not what happened at all. That's a made up story. What happened according to Crowley is he invited Gate outside because he couldn't hear his radio. It had nothing to do with safety.Crowley was already inside the residence and discerned there was no danger when he invited Gates outside.
Crowley: My reason for wanting to leave the residence was that Gates was yelling very loud and the acoustics of the kitchen and foyer were making it difficult for me to transmit pertinent information to ECC or other responding units.
Opinions are like elbows but lets not make stuff up.
Some people are comfortable with policemen abusing their powers. They figure if they bend the rules for basically good reasons, it makes them more effective as they are hamstrung by all that ACLU and personal liberty nonsense. These people believe policemen bending the rules for good will outweigh the policemen bending the rules for bad. Besides, crackheads 'don't need no personal liberty. If a cop screws you, its probably your fault for looking like a crackhead.
Others don't like to see police bending the rules at all. There is that question in this case. That's why I'd like to hear all of the radio transmissions. How else can you tell if Crowley had urgent transmission he had to send, or if he just wanted to move the confrontation outside where he had the power to arrest Gates? Where are the rest of the radio tapes? We get one line.

Crowley was on his way out and said to Gates that if he wanted him to tell him again then it would be outside. Those details are germaine to the conversation.
Crowley most likely decided the Gates was in fact the owner. He also was out of radio touch and Gates was abusive and antimated; in short an unknown in a situation. The type that might get out of hand and compromise the officers safety.

The radio transmissions are conspicuous by their absence. If they were released with the 911 call, we wouldn't be having this discussion. We have the 911 call, and 1 sentence of radio transmissions. Yet we have this police report mentioning radio communications were an issue. OK. Where are they?
Radio transmissions could clearly show Crowley's motives for asking Gates outside were completely innocent and not a lure. The transmissions don't even have to mention notr being able to hear over Gates. All they have to do is infer Crowley was getting ready to leave. Now if Crowley was saying he was in a conflict with Gates, he wasn't asking Gates outside to hear, he was asking him outside to arrest him.
If he was in a conflict with Gate's his job was to warn Gates to stay inside, because coming outside would result in his arrest.
Why aren't the radio transcripts being released when the 911 call was?
And here is another pesky detail. Does Crowley carry business cards as many law enforcement agents do ( policemen, civil sheriffs, marshals, ATF, Border Police, FBI etc.) ? See thats an extremely important question as most agencies pay for the cards.
It would seem unlikely to have someone asking you multiple times for name and badge number and not give them a card if you have a pocket full of them .

Crowley does not have to hand Gates any cards, they cost money in these hard times. I have run out at my government job and they say tough when I ask for more. Besides Gates was most likely an anoying creep and Crowley had had enough of the insults.
If some yahoo at my work gets out of hand or wornt leave we call security. Since Gates could not do this he left as he recognized the law of diminishing returns.

The actual tapes could provide a time line, but the transcript does reveal Crowley wasn't responding to a few calls to him, indicating trouble communicating. Rights right and this seems to back up Crowley's story. Bold notes time Crowley wasn't responding to radio transmissions.

August 2, 2009 - 14:34 ET by nwahsIn New Orleans, the Times Picayune edits the police description to remove race from the description. They will tell you what color car they are driving, and what color clothes they are wearing, but they will not give the race of the suspect at large.
I commented on the fact they were editing police descriptions, on their online site ( www.nola.com) and their response was to ban my account and refuse any of my telephone calls :)
I think Powers is right on target. This was never a question of profiling. In fact one of my first comments after hearing about this was "God forbid you profile someone kicking in a front door."
Then I read Crowley's report. I don't know how any reasonable person can read that report and not have it send up red flags about possible police power abuse. All I can figure is some people think Gate's deserved police power abuse for being so belligerent.
IMO this is more of a libertarian issue than a racial profiling or democratic talking point.

This question is apparently framed as a rhetorical question, implying that there should be nothing wrong with stating factual information correctly.
Though I practically never watch Fox News Watch, I would have thought that asking such a rhetorical question with such an implied answer, in this particular case, would have been, and indeed should have been, so calamitous as to cause the show to be shut down prematurely. The whole Gatesgate episode was all about the tumultuous categorical intolerance to facts that run counter to the stereotyping profiling from the President to Gov Duval Patrick and the liberal Media blabbingheads, all the way down to the rabid liberal base at DailyKos, MoveOn, etc. This incident revealed not only their intolerance and stereotyping, in spite of the facts, but also their obstinate intolerance at having their stereotyping revealed.

Gates v Crowley, SCOTUS rules 5-4, Sotomayor swing vote
In an expected 5-4 ruling today, the Supreme Court decided that Sgt. Crowley was not discriminated against after being fired from his position on the Cambridge Police Force in 2010.
The swing vote Justice Sotomayor, issued the ruling which she read from the bench, in which she said that:
"While the actual facts of the case do not support our ruling in any way shape or form, the Empathy Factor, recently ratified in the 45th Amendment, left the court with no option but to rule in favor of the minority party, Mr Henry Louis Gates Jr.
Given the justifiable grievences from Mr Gates ancestors, who were subject to slavery, most likely by Mr Crawley's ancestors, it is clear that in any confrontation between a caucasion and a person of diverse colors, the court must always get empathy on with said person of diverse colors.
Lo -- from now unto the end of time. Amen. Praise the Lord. Yada yada yada."
