MSNBC Panel: Fast & Furious Scandal Bad for GOP, Good for Obama

Update [12:52 ET]: Former RNC Chairman Michael Steele followed Bernard's lead in MSNBC's noon hour by claiming the Fast & Furious investigation was "not good" for the House GOP. Video below and audio here.

In an attempt to twist the Obama administration's Fast & Furious gun running scandal into bad news for Republicans, on Wednesday's The Daily Rundown on MSNBC supposed Republican pundit Michelle Bernard proclaimed: "...when you think about just the damage that has been done over the last year to the GOP's brand, this is just another – adds more fuel to the fire." Bernard was referring to the possibility of Attorney General Eric Holder being held in contempt of Congress for not providing documents about the failed policy to lawmakers. Instead of questioning the White House, Bernard continued to rant: "...this is just another thing that I think gives the Obama administration and the Obama campaign a little bit more fuel to go to the American public and say, 'Why won't they just do their job? We don't elect members of the Congress to come in and beat up on the Attorney General and be obstructionists. Ask them to do their job and back off of Eric Holder.' It makes no sense."

Prior to Bernard's spin, Politico's Jake Sherman warned: "There are elements, significant elements within House Republican leadership, that think this is a really bad message. The economy is struggling. Obama's numbers are not where he wants them to be. So why get off message? That's what some people, high-ranking aides and even lawmakers in the House Republican conference, are telling us."

Following Bernard, fill-in host Luke Russert concluded that the President even welcomed the congressional confrontation: "It's another dynamic of Obama versus Congress. Which is a fight that he's actually wanted."

LUKE RUSSERT: Another story that's sweeping over the Capitol today is this ongoing fight between Eric Holder and Darrell Issa. Eric holder said this yesterday when he was on the Hill.

ERIC HOLDER: I think the ball is in their court. They rejected what I thought was an extraordinary offer on our part.

DARRELL ISSA: Ultimately, the documents necessary to cause a postponement appear to be in their possession.

RUSSERT: Jake, you've been following this story. What's going on here? And more importantly, how does the leadership feel about all this? Are they worried that it distracts from the economy message?

JAKE SHERMAN [POLITICO]: The freight train is going full speed. Contempt vote's going to happen by noon today, we're told, in committee. Then it will head to the full House floor. Speaker John Boehner and Eric Cantor are very cognizant that their conference, that their 242 members want this vote. They're angry at Eric Holder, they don't trust Eric Holder. The interesting dynamic will be – is whether there are documents that come to the Hill before the vote happens on the floor.

There are elements, significant elements within House Republican leadership, that think this is a really bad message. The economy is struggling. Obama's numbers are not where he wants them to be. So why get off message? That's what some people, high-ranking aides and even lawmakers in the House Republican conference, are telling us.

MICHELLE BERNARD [BERNARD CENTER FOR WOMEN]: You know, Luke, when you – for a different vantage point, when you think about just the damage that has been done over the last year to the GOP's brand, this is just another – adds more fuel to the fire. The economy is in a very, very bad place. We should be talking about job creation. We should be talking about all of the pocketbook issues that matter to Americans. And this is just another thing that I think gives the Obama administration and the Obama campaign a little bit more fuel to go to the American public and say, "Why won't they just do their job? We don't elect members of the Congress to come in and beat up on the Attorney General and be obstructionists. Ask them to do their job and back off of Eric Holder." It makes no sense.

RUSSERT: It's another dynamic of Obama versus Congress.

BERNARD: Exactly.

RUSSERT: Which is a fight that he's actually wanted.

. . . there is not one person in the WH or in the Obama 2012 Campaign HQs that thinks the GOP focus on Fast & Furious is good for Obama and bad for the GOP.

For one thing, neither Romney nor the GOP had anything to do with it, so it's all in Obama's yard.

Secondly, there is absolutely no good news from F&F. The best that Holder can offer is that it was a screwed up operation, still reflects back on him and Obama regardless of what else gets revealed.

And lastly, it ain't going away. The WH knows that other whistleblowers can leak documents over the next 4 months, each of which is a potential political A-bomb. Super PACs are poised to tell the evolving story via TV ads/

"o'bama welcomes the confrontation with Congress". Oh yeah, THAT's why he invoked his "Executive privilege" decree -- because he's so brave. What's he trying to hide? The only reason a President invokes executive privilege is because HE's directly involved. And he wants to protect his involvement.

Besides, just listening to Rush -- since o'bama is blaming the whole thing on Bush, why wouldn't they release the papers to prove that, rather than invoking executive privilege?

Once again, MSNBC proves they are in the tank. And don't know how to ask the pertinent questions.

Boy Baraka is not just complicit, his hands are dirty, just like Tricky Dick.

In fact, the WH, not just Holder, fired the first shot with this executive privilege nonsense, especially for something they said they knew nothing about, and by doing so, they overplayed their hands.

I got a feeling this is gonna get real ugly too, not just real interesting, especially with the race card being bandied about like everything else they've done, except worse.

I know the left is flinging a whole lot of poo against the wall to see what sticks but how in the "H-E-Double Hockey Sticks" can they connect this to the GOP? Stedman is the most corrupt AG evar, and he is just Baracko, the organ grinder's, dancing monkey.

Given this administration's penchant for leaking secrets, the Executive Privilage on F&F might just be the way that Issa can find out the information he is looking for.

He'll hang on til the first week of November, embattled, but then he'll reluctantly, for the good of the country, resign. With a back room pardon in his hip pocket, of course.

And, Baracka will hold a presser, or maybe just a statement in the Rose Garden, so no one can ask questions, expressing his sadness that racism has, yet again, claimed a wonderful son of America.

IOW, he'll fall on his sword for Baracka.  And, the two paragraphs above were all sarcasm, if anyone has to ask. 

To re-elect Obama would be like the Titanic backing up and hitting the iceberg again.

The cesspool that is our Justice department and Obama and Holder playing horse is unimportant. Their smell of rank corruption is perfume to these people but that means that somhow in their little bias minds it is bad for the Republican not further evidence of the incompetence and corruption of their client (Obama).
Is their anyone in the NBC organization (Not a news network) that has any integrety? Intelligence? pride?

The House of Representatives have passed multiple budgets; the Democratic Senate refused to deal with them.

But the Congress also oversees the running of the Federal government.  It comes under checks & balances -- the very system our Constitutional government is based on.

The Attorney General of the United States has steadfastedly refused to comply with the House committee executing its oversight role.  Holder is the obstructionist.

BERNARD: . . .  And this is just another thing that I think gives the Obama administration and the Obama campaign a little bit more fuel to go to the American public and say, "Why won't they just do their job? We don't elect members of the Congress to come in and beat up on the Attorney General and be obstructionists. Ask them to do their job and back off of Eric Holder." It makes no sense.

It makes perfect sense,  How did the Justice Department conduct an international law enforcement operation without the knowledge of our State Department, our Homeland Security Department, or the Government of Mexico?  Holder has been unwillingly to identify who even authorized this operation.  

For over a year, Holder has resisted answering the question:  "How high up did this authorization go?"  Moreover, he has lied at least twice as to the gunwalking nature of F&F, and the previous AG's knowledge of it.  

If Obama wants to put a spotlight on F&F as a Republican embarrassment, have at it.   The more the voters understand what's at stake, the more they will distrust Mr. Hope & Change.

Had Holder not lied about the gun-running to begin with, the investigation would likely be over. Why was Michelle Bernard of the Bernard Center for Women even included on a panel discussing such an issue?

Beating up on holder ? He has to be accountable for his actions while in that position . The committee is only trying to determine what his role in those actions were . If he had no role , then there should not be any reason to stonewall the committee , save one . That is to protect the person who did have a role in the actions . The person being protected is the same one who will do whatever it takes to back up Holders' stonewalling .

Yes, Little 'O', they are clueless. It is Congress' task to advise and consent on many things the President does. They are also required to conduct investigations when appropriate in case there have been misdeeds by the administration (or appear to be), including holding the executive branch members in contempt of Congress.

So, republicans are bad for investigating a wrong and bad if they are being investigated for a wrong. Is this a "don't criticize the black guy" issue? I believe that GWB said something about subtle bigotry because college(s) were giving extra points for minorities on their applications. The same applies here.

"Executive Privelege" is not in the Constitution

Darrell Issa and the House committee members that voted in favor of having the executive branch turn over pertinent files related to "fast and furious" stand on sound constitutional grounds.

But where does the White House stand? Is there a "stonewalling" feature to the Constitution allowing a president to ignore congress? Some presidents have taken the attitude that if there is not such a provision they will invent one. That attitude does not serve the people well even when the committee doing the investigating is not popular among the press and the committee chairman has been demonized by the media.

Article II of the U.S. Constitution requires the executive branch to give information to the Congress, saying of the President that “He shall from time to time give to the Congress Information of the State of the Union.... [and] he shall take Care that the Laws be faithfully executed.”

The Constitution is silent on any question of “executive privilege,” a concept invented by President Eisenhower to stonewall the investigations of communism by Senator Joseph McCarthy in the 1950s.

it's curious that "executive privilege" was also roundly criticized by President Obama when he filled a senate seat.

The "Fast and Furious" cover-up is perhaps the first presidential scandal that smacks of the same issues that destroyed the Nixon presidency. The Nixon administration complained that congressional subpoenas of White House deliberations on the Watergate break-in were private discussions, and used this as a means of hiding misdeeds. The Barack Obama White House is using Nixon's strategy.
