Obama Administration Found in Contempt of Court, Media Silent

Kyle Drennen's picture

On Thursday, Louisiana Federal District Court Judge Martin Feldman found that the Obama Interior Department was in contempt of his ruling that the offshore oil drilling moratorium, imposed by the administration in 2010, was unconstitutional. After Feldman struck down the initial drilling ban, the Interior Department simply established a second ban that was virtually identical.

While the story was reported on Thursday by wire services like the Associated Press and picked up by frequently cited internet news sites like Politico, the television media, including ABC, NBC, CBS, and CNN, all ignored the story.

In his ruling, Judge Feldman forcefully admonished the administration's attempt to circumvent his 2010 decision: "Such dismissive conduct, viewed in tandem with the reimposition of a second blanket and substantively identical moratorium and in light of the national importance of this case, provide this Court with clear and convincing evidence of the government’s contempt of this Court’s preliminary injunction order."

As Politico further explained: "Gulf state lawmakers have criticized the Obama administration for stopping drilling last summer, and accuse Interior of continuing a 'de facto' ban on permits, saying it cost their states thousands of jobs."

Earlier in the week, the media provided scant and dismissive coverage of another court ruling against the Obama Administration, that of a federal judge in Florida who deemed ObamaCare to be unconstitutional.  On Tuesday's Good Morning America, ABC's JuJu Chang downplayed the major challenge to the legislation: "...the Obama administration is expressing confidence that the new health care law will be upheld. It's vowing to appeal."

On Monday's CBS Evening News, fill-in anchor Harry Smith declared: "In the legal battle over President Obama's health care reform law, the score is now two to two. A federal judge in Florida is the latest to weigh in, ruling today the law is unconstitutional...A judge in Virginia issued a similar ruling in December, but two other courts have upheld the insurance mandate."

Good!

This report ties in nicely with some other threads here (i.e. Michelle Malkins blog and the thread about Mark Levins analysis on the dismissive actions by the Obama administrations regarding the ruling on the unconstitutionality of Obama-care.)

The question is… “What is going to happen now?”

"I wish I had an answer to that because I'm tired of answering that question." - Yogi Berra, (Baseball Great and Philosopher)

Lord of the flies..

Hay blow off one Court....

Blow off another...

The Obama administration snubbed top GOP oversight official Rep. Darrell Issa on his first major document deadline as new chairman of the House Oversight and Government Reform Committee, sending a short letter promising to comply in response to a major information request that was due Saturday at noon.

But Issa is hitting back Tuesday with a demand key documents be sent in two days.

The enemy within.

consequences!

When are they going to enact consequences for his actions??  The list is long!  We already know they are in contempt, hell, they are contemptible.

I don't care anymore what it takes, but get those rat bastards the hell out of DC and out of our lives!

Obviously this is a bought

Obviously this is a bought and paid for judge in Louisiana a state who is also bought and paid for.  Big oil is so pervasive in these cases these people cannot be trusted.  So of course Obama knows the best thing for us.  So stop carping and just accept the goodness of his heart.

Nuke em til they glow; then shoot em in the dark

Obviously

If your comment is not meant to be dripping with sarcasm, you must not be living in any part of the united States that is enjoying freezing temperatures and feet of snow.

I live in NW Minnesota.  It's a kick seeing how you people react to getting the weather we enjoy every year.

Yes it is sarcasm, but it is

Yes it is sarcasm, but it is the reality of how the libs and Obama think.  Dang it was in the 20's here in Arlington, Texas and we had a blizzard through here.  Dropped a whole 5" and closed businesses and schools for nearly a week.  Now that part is not sarcastic, its the truth.  We are not equipped for the white powdery stuff or ice storms.

Nuke em til they glow; then shoot em in the dark

Don't mind the snow

I don't mind the snow, or even the ice storms, but what I do mind is this phoney baloney BS extravaganza that we had called "rolling blackouts."  I mean, Whiskey Tango FOXTROT??  And then I hear that 13 power plants were ordered back before 2008 but since 2008, only one or two of them got constructed and the rest were on hold vis a vis the EPA and other forms of BS?

Um, by doing that, you cause, not risk, CAUSE lots of damage and there was damage to be found.  And this stupid ERCOT thing, who the hell let the EPA control them to decide they are going to curb "emissions" and all that rot?  I heard somewhere it was some federal judge that lifted an emergency stay to keep the EPA from trying to enact their malarkey in Texas which is what caused the rolling blackouts.....in other words, THE BLACKOUTS WERE COMPLETELY UNNECESSARY!  THEY DIDN'T HAVE TO HAPPEN AT ALL!!!

How many people got injured or died because of this?

This is a criminal act.  Texas needs to tell the federal government what it needs to do with itself.....which is precisely "GO TO HELL!"

sarcasm or not Dan*

Let me re-assure you that after Judge Feldman's decision to lift the moratorium, every federal agency and liberal media hacks investigated Judge Feldman to the nth degree. How disappointed they were to learn that Judge Feldman is an intelligent, capable,  ethical, very professional, and  honest Judge. Darn!

Badge of honor

obama wears contempt for America as his badge of honor. And now, he and his MSM minions will turn to personal attacks on that judge, so that he can destroy him.

Misnomer

I believe that name of main stream media (MSM) or driveby media, etc., ought to be changed to "State Run Media" (SRM).  From what I have watched over the last few days in Eygpt, I think the name fits for the former MSM.

W acted in the face of a

W acted in the face of a Congress that would not. I speak of creating GITMO. He acted again, for the same reason, in creating miliary tribunals. BDS forced challenge of their creation and the only way they could was on the grounds that Bush wasn't empowred to create these examples. They won, Bush lost. But did he really? Congress then had to legislate, and when it did, the members did the same thing Bush had done.

I would argue that W stood down in the face of the Court not only because it was the right thing to do but because all along that was exactly the plan. He forced congress to do its job. In doing so, he ended the controversy that was GITMO and the military tribunals.

Obama stopped it all cold. Yet he hasn't closed GITMO and no trials are happening. Gee, who is to blame? Obama is just voting "present" as he always has done. He is staling and wasting time. Media doesn't want to report on any of it, uz none of it is able to champion their chosen one.

Obama defies the Constitution at every turn, it is what progressives do best -besides wasting time. And that is wht he will do with Obamacare too. He should be impeached on a number of fronts and that number will only grow.

That an individual right exists requires that some policy positions be removed from the table of debate.

How much arrogance and contempt for our country does

it take before impeachement proceedings begin.....

Heh

When the person in question is black? A hell of a lot.

Racism sucks. Let's bring some more Somali's over to be sure it continues.

I wonder.....

When officials of the federal government are acting in direct violation of a court order declaring their actions to be unconstitutional, are they subject to Citizen's arrest?  If they resist, should we not use sufficient force to secure that arrest?

No.

I wonder

Well, they did in Honduras about a year or so ago, when the military removed the former leader. No bloodshed, no mess, just took him away. Remember PREZBO's reaction?

Kyle, how dare you...

...report the truth about the Obama administration. Everyone knows that Pres. Bush was the unitary executive. He justified executive actions that far exceed past presidents' power.

Aye just kidding, Obama is a dictator in comparison. But you won't find many in the MSM, if any any at all, that would describe the same regarding the Obama administration. Below is an article decrying Bush's authoritarianism.

The talk of impeaching BHO...

while IMO a worthy goal, ignores things.

From Wikipedia:

"The impeachment process is a two-step procedure. The House of Representatives must first pass by a simple majority articles of impeachment, which constitute the formal allegation or allegations. Upon their passage, the defendant has been "impeached". Next, the Senate tries the accused. In the case of the impeachment of a president, the Chief Justice of the United States presides over the proceedings. For the impeachment of any other official, the Constitution is silent on who shall preside, suggesting that this role falls to the Senate's usual presiding officer. This may include the impeachment of the vice president, although legal theories suggest that allowing a defendant to be the judge in his own case would be a blatant conflict of interest. If the Vice President did not preside over an impeachment (of anyone besides the President), the duties would fall to the President pro tempore of the Senate.

To convict the accused, a two-thirds majority of the senators present is required. Conviction automatically removes the defendant from office. Following conviction, the Senate may vote to further punish the individual by barring him from holding future federal office, elected or appointed. Conviction by the Senate does not bar criminal prosecution. Even after an accused has left office, it is possible to impeach to disqualify the person from future office or from certain emoluments of his prior office (such as a pension). If there is no charge for which a two-thirds majority of the senators present vote "guilty", the defendant is acquitted and no punishment is imposed."

Key is that 2/3 of the Senate. The GOP doesn't even have half, and the Maine twins, Grahamnesty, and McCain are questionable at best. The remaining statists in the Senate are sufficently hardcore and doctrinaire as to be unwinnable to convict even the grossest crime. BHO could probably cut a child's throat  in front of a national live feed right in the Oval Office and leave the waif to die, and not have to worry the consequences, thanks to the present majority in the Senate.

ObamaCare will be instrumental, if not shut down, to returning this country to despotism and slavery.. It has been found unconstitutional and void, two states refuse to recognize it, and yet it still trundles its authoritarian way over the country, fueled by our taxes, our children's taxes, and probably for two or three generations beyond that. It is more subtle than someone being bled to death, but is IMO no less a crime.

And regrettably, the ignoring of its voiding will ALSO be ignored by a majority of the Senate.

Grimly, NVCon

One More Time...

Let's move along folks, nothing to see here

Federal District Court Judge Martin Feldman

I guess it's not this Marty Feldman...

(Sorry - couldn't resist.)

Impeach this President!!

After we impeach this President, let's take ABC, CBS, and NBC to court to prohibit them from calling their supposed news broadcasts as news.  It's false and misleading advertising.  They should have to air a disclaimer that says their broadcast is for entertainment purposes only and should not be construed as "real" news.  They're about as valuable a news service as Colbert's show or the 700 Club.

(*Sigh*) You're An Idiot...

You are proving the Dr. Evil axiom "I am surrounded by frickin' idiots!" more and more so with such utter nonsense. If liberals weren't able to get President Bush prosecuted or impeached over things that he and his administration did that were perfectly legal, what makes you think you'll have it easier in regards to President Obama? After all, if he were the so-called malevolent force you keep crying your eyes out over, you'd be in prison camps right now. President Bush didn't even do that to his harshest leftist critics, even though he had plenty of legal alternatives (I.E. the New York Times blabbing about warrant-less wiretaps, Michael Moore, etc.)

For this, I say :  -_-"

Contempt of court... Contempt

Contempt of court... Contempt of Congress...

The Democrats couldn't care less with help from the media...

Contempt

The outlaw regime aka PREZBO, Ried and Pelosi are heck bent on imposing their collectivist wills upon the American people.  While I cannot prove it, it would not suprise me to find out that somewhere in their various offices lies in bold lettering the following words;

Damn the American People, full speed ahead. Impliment the agenda, the agenda is everything.

It's worse than that

This administration is guilty of comtempt of America. The only problem is none of our congress-critters have the nads to do anything about it. If this had been any previous prez, the proverbial "stuff" woulda hit the fan a long time ago. It's time we get a bigger fan.

Contempt*

The Obama administration has redefined contempt.

Prior to Judge Feldmans recent decision, Obama set up a commission to investigate the DeepwaterHorizon accident. When this report was released,it was met with immediate criticizm. They altered the document after the scientific members of the team signed it. And they left out a very significant part of the study. See that story following.

http://www.humanevents.com/article.php?id=41460

After that report, supposedly, BOEM began issuing new permits which as we now know was simply delaying tactics. Judge Feldman rules on "contempt" because we know no "new" permits were issued and only 2 "resume" permits were issued. The Judge was highly critical of the machinations of this administration. He wil be calling them back into court soon. This is also another interesting story.

http://www.politico.com/news/stories/0211/48900.html

Interesting to note, the very issue that this Administration is using to delay permits is the very issue that the committee omitted in its investigation of the BP explosion. With no real effort to understand the cause of the explosion, the govt now feels free to over regulate once again. Contempt for Judge Feldman, contempt for the Judicial process, contempt for science and engineering, and contempt for the families of the 11 dead workers on that rig. This is why the msm does not want to cover this story.

As I have been ranting for months, dont listen to TOTUS, look behind the curtain.

Shredding What?

Back during the Bush administration, we heard the phrase "shredding the Constitution" on an almost hourly basis.

Granted, back then, for the administration to have even bent the Constitution the tiniest amount, the NSA would have had to:

A. Listen in to the phone conversation between a known Islamist terrorist located somewhere abroad, and said terrorist's US citizen relative, where,

B. The conversation was limited to something entirely innocent, birthday wishes for instance, and,

C. Then use said recording to prosecute the above-mentioned US citizen.

That's about as iffy a scenario as possible.

On the other hand, today we have an administration operating in open and admitted defiance of multiple lawful orders from the judicial branch of the federal government, in multiple clear black & white (no pun intended) violations of the Constitution.

Who's doing the shredding?
