The Supreme Court has overturned the D.C. handgun ban. The ruling is 5-4 with Justice Antonin Scalia writing the majority opinion. The Court finds that individuals have the right to keep and bear arms.

Nowhere to be found, justice Stevens? How about the simple, basic, fundamental, rudimentary idea that the purpose of the Constitution is to limit the powers of government? Ever hear of that concept?

Good God! If this is the level to which our Supreme Court has sunk, we're fortunate indeed that this particular ruling turned out the way it did.

Obviously this jackass could not read or comprehend the Second Amendment in which the Framers specifically prohibited the state certain tools in the regulation of firearms, namely prohibition of private ownership.  This moron could not locate his own ass much less find and evidence the Framers wanted to presrve private ownership of the means of self defense. 

Stevens is a public enemy. He should be dealt with as such.

 I'm glad it came down this way. But honestly, if it didn't, there is absolutely nothing the Court or anyone else could have done to separate me from my guns, alive. I know this is getting to sound like a cliche but it is a fact. I am an American, no puny men in robes are going to dictate if I can or can not own guns to protect me and my family. It is foolish to think they could. We are free men, to remain so it is necessary that we protect ourselves, mostly from our government it appears.

I am a conservative, always have been.  However, I've never owned a gun.  I've never been hunting and I don't plan to ever do either.  I think guns cause lots of damage all over this country and the world.  I do think though that owning a gun is a right of the individual and politics should stay away from changing that.  If they do outlaw guns, those who will use them for illegal purposes will get the guns they want anyway so it really only hurts those who hunt or those who want to protect themselves.  This is a good sign that we still are thinking about the rights of the people of this great nation.

Kinda like you-- don't own--but I was an NRA member for about 15 years because I believed in the right to own guns. I suppose I could have just sent them a check as a donation, but I felt I was supporting them better by joining. I don't hunt--don't target shoot, but in my twenties, I used to target shoot with a friend who was a gun collector.

I do remember reading when the Nazis entered France in WW2--they went to the police stations, got the lists of gunowners and went and rounded up all the guns. I, somehow, feel safer knowing that a lot of decent law-abiding Americans are armed.

Scalia wrote the majority opinion. That means it will be very straight forward. Very hard for future Justices to take back. That is better than a 9-0 decision writen by any other justice in my opinion. Scalia is the best Justice to ever serve. I can't wait to read the opinion. I may be an uber geek but this will be better reading than any novel.

I am happy for this decision because it reinforces personal responsibility and freedom to make choices.  In this day when the government is trying to tell us what we can eat, what we can listen to on the radio, how much water we can use to flush the toilet, etc., this decision strikes a blow at government interfering in people's lives.

uh, let me point him to the Bill of Rights.  What part of  "restrictive clauses" does he not understand?  Had this ruling failed on that logic it would of course failed the public confidence

I guess JP Stevens missed

I guess JP Stevens missed the point of militia members supplying their own guns.  Now why in the world would you want to limit the fire power of the militia, when the militia stands between you and the enemy?  In order to be in the militia you had to OWN a gun, QED, the right's of gun ownership were understood as a necessary prerequisite.  Hence there was no need to write it, and thus again shows the flawed thinking of JP Stevens.  btw-the same can be said of parenthood, if we have to write every jot and tittle of what rights we as citizens have, it would take a book of the size of the unabridged dictionary to describe them all.  The Constitution exists to define the limitation on government power not the peoples' power.  We the People gave the government just enough power to transact the common business of the People, not the other way around.

And clearly JP also missunderstood or chose to ignore that the framers wanted a series of checks and balances to prevent any one group from staging a power grab and that includes people in government.  Only a suicidal fool would dare to even attempt a coup in the US, with 200 million guns in the hands of 80 million owners it would be open season on anyone who supported such an action.  The only way the public can trust the government is if the government isn't kicking people's doors down or micromanaging their affairs, beneficence is the act of not telling other people what to do even if you have the power to do it.  Beneficence and Liberalism are polar opposites.

 Nancy Pelosi and Harry Reid, starving the poor one gallon of ethanol at a time. Fill your tank with E85 and cull a village.

It's An Individual Right, Stupid

The Bill Of Rights - in fact the entire US Constitution - outlines the individual’s rights, not the government’s rights. Period. The Founding Fathers clearly never singled out the Second Amendment as a "collective right," which would deny individual ownership of a gun.

Regarding future challenges to the Second Amendment, it will take the legislatures of 37 states to ratify an amendment to the Constitution. With over 70% of the American populace favoring the Second Amendment, the political pressure means it ain't gonna happen. 

And remember, the original US militia members were the people themselves, who took their own arms from above their fireplace mantels and went out to fight the oppressive British government, which had positioned itself as outsiders to the colonists.

This ruling is a lock-in now, the same as Roe v. Wade. Go ahead, Dems, try taking away the average citizen's right to gun ownership and demand that all guns be confiscated. Ever hear of the ballot box?

I looked again at the Constitution, and I failed to find  where it sayes "deserve" the right to bear arms, nor do I see where it sayes the public "needs" the right to own guns. I do read that the people "have" the right, inherently, and it is not to be "infringed" upon by the Goverment. You might try reading Madison and Jefferson. Perhaps a few of the others too. You seem to miss the point that if the Goverment can regulate and negate one of the amendments, they can regulate or negate all 10. And what would stop them after that?

It was important during a different time, today's society is a much different story.  It's not that I think it should be gone completely...just more laws, more laws and more laws and more laws...controlling this right...because yes, even that religiously devout grand citizen can let his fire burn a little too hot and someone may get hurt...so screw this society...at least Japan only has to worry about slashings for the most part. So why do we deserve this inherent right.  Times change...and yes society needs to move as well...if we wanted everything the way it was set up in the 18th century...well then we haven't been doing too well...so now it's time to realize this right needs more control.

Your point is pointless. The facts are that guns are used much more to defend ones property and life or the life of others, than they are used, illegally, I might add, to murder. If someone is going to commit a crime, it is already illegal, and I fail to see how adding another law would stop said crime. Your point is short on logic and long on "feelings". Answer me these two questions: First, why have their been so many shootings in "gun-free" zones? Second, is it reasonable to believe a person who intends to break the law by shooting someone will be deterred by breaking the law to obtain a gun? Actually, you can just answer the second question. That's all that's necessary in evaluating any law which would prohibit guns.

The point of guns IS to hurt people; specifically, people who are trying to do you, your family, or even a random stranger harm. The whole fear of being hurt thing tends to make potential criminals think twice, and those who fail that fear check get to experience said pain (usually accompanied by debilitation) first-hand. The rare nutjob who manages to get a gun is more likely to be subdued by an armed populace than an unarmed one.

While you're at it, consider the difference in difficulty between stopping a knife-wielding killer with just your bare hands compared to stopping a gunman with a gun of your own. When you get done with that, consider the likelihood that (I'll be nice and assume that no Japanese guns find their way onto the streets), with the current state of international markets, no guns can be smuggled into the country and the difficulty in stopping a gunman with your bare hands.

I direct you back to the second of the questions I asked starting this post. You want to "control" something that isn't controllable. Making having a gun a crime does not prevent criminals intending to use such guns from obtaining them. Instead, you only ensure that criminals have little to fear from their victims.

Mr. Glock said that he was pleased as we drove to work today.  He told me that he would not leave my side ever, even if I go to DC.

This is a great win for conservatives.  This is a tremendous loss for stupid liberals.  I have come to expect the worst from anything that comes out of Washington..this was an unexpected surprise.

All able and honest Americans should apply for their concealed carry licenses.  Look at the difference it might have made at Virginia Tech is one of the legal, honest students were allowed to carry his weapon.

jquam, coming from you, that means less than nothing

Ask any parent of the murdered students at VT or any of the people who were mercilessly gunned down if they would have preferred a lawful, trained, able person had the means to defend themselves.  Every one would say yes unless they were a lying liberal with an agenda. 

You don't want a gun?  OK, fine.  Who cares?  But I do because I prefer not to be a victim.  Run along now little Jquam, don't you have a war to protest?

Breyer's dissent

Justice Stephen Breyer wrote a separate dissent in which he said, ''In
my view, there simply is no untouchable constitutional right guaranteed
by the Second Amendment to keep loaded handguns in the house in
crime-ridden urban areas.''

Maybe this isn't the dumbest statement ever made by a Supreme Court justice, but Justice Breyer was in there trying all the way

Individual Rights.

In all the commentary on this, do one thing: 

 Interchange the phrase "the right to keep and bear arms" and "the right to freedom of speech" (or variants thereof).... and see what happens.

For example:

Scalia said nothing in Thursday's ruling should "cast doubt on long-standing prohibitions on the possession of firearms by felons or the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings."
