John 'Junior' Feinstein in the Washington Post - Abolish the 2nd Amendment


I've been a fan of John Feinstein's sports writing for years.  Not so much of his political writing. Today's Washington Post carries a sterling example of the latter, masquerading as the former.

As some of you may have heard, New York Giants wide receiver Plaxico Burress carried an unlicensed handgun into a New York nightclub (is there any other kind of handgun for a private citizen in New York?), and put himself on the disabled list by shooting himself in the leg.

This is the latest in a series of gun-related, ah, fumbles by NFL players in recent months, and Feinstein uses it as an excuse to call for repeal of the 2nd Amendment, and to launch a broadside at those who might disagree.

Now, let's not start screaming about the Second Amendment. To begin with, the amendment should be abolished -- a sensible interpretation of the amendment is that it was written to allow the people to raise a militia for protection and to hunt for food. Clearly no one needs to raise a militia these days, and those who hunt for a living can be licensed to do so.

It would be nice if President-elect Obama had the time to focus his energies on repeal of the Second Amendment, but he first has to deal with a broken economy and the incredibly wrong-headed war started by his predecessor. What's more, the issue of gun rights causes almost as much screaming from the right as abortion rights, the irony being that those yelling the loudest about the right to life are usually those yelling almost as loud about their right to carry weapons that kill.

Barring that, he says, the NFL should make it a condition of employment that no player can own a handgun.  This, because protection even in their own homes is something that NFL players apparently can't be trusted with.  To get there, he has to revisit the death of Sean Taylor, who had gotten himself on the straight and narrow just in time to be killed in his own house by what I would presume to be former...associates.

It's not worth arguing the 2nd Amendment with someone who lives near DC but who evidently hasn't bothered to read or understand the Heller case.  But the juvenalia on display in the second paragraph could have appeared, word for word, in the Cavalier Daily 25 years ago when I was in school.  And probably did.

Imagine a conservative sportswriter writing a column about the evils of McCain-Feingold, the abuses of Title IX (coming to a physics department near you), or the joys of limited government, and in the bargain, questioning man-made climate change and accusing Obama of socialist tendencies.  I'm sure it happens every once in a long while, and when politics creeps into sports talk radio, it does tend to be from both sides.  But for some reason, the print guys tend to think their columns are a license to shill for the Left.

This is a perfect example of one of those "argument" that seems to have such a great "gotcha" quality to it that those inclined to agree with its general sentiment often fail to actually think about just how stupid it is.

The Bill of Rights was a package deal. I am wondering though, considering who is now in power, if any of the Amendments comprising the Bill of Rights can be repealed or are they inviolate. It is a moot point though, as we in Maryland can attest, the state has abrogated our rights and decided who may carry and these backdoor efforts to deny our 2nd amendment rights through specious legislation continues in this state (serialisation of ammunition is the latest attempt).

As much as I like the Second Amendment, I am a bigger fan of Section 24 of the South Dakota State Constitution where I live, as it spells things out just a bit more clearly:

"The right of citizens to bear arms in defense of  themselves

I can tell you from experience their is no other country I would rather live in then the USA. YOU HAVE NO RIGHTS in most of the countries I have been to. In most of the countries I have listed 3 or more people together can be constituted as a mob and be thrown in prison and held without counsel for 3 to six months before you get to a court date.

Since I live here in DC, I've known John is a diehard liberal married to a Catholic.  He's a great writer. tells a great story, but he should stick with sports.

I am not a gun owner, but I do feel when the government takes away our right to bear arms, it will then erode our other rights, to free speech, assembly, etc.  This we cannot tolerate.

Burress had an illegal firearm.  Burress shot himself.  Burress probably never took a gun safety class in his life.  The fault here is not the Second Amendment, Feinstein, but Burress.  Take a gun safety class before you handle a firearm.

Sean Taylor was the victim of a crime in his own home defending his family.  The people who perpetrated it knew a relative of his.  It's a shame what happened to him.  As a Redskins fan, I was heartbroken when he was murdered.  But life goes on and his child will grow up without their father.

But for Feinstein to further exploit his senseless murder for gun control is odious.

The irony is that he doesn't get it. The right to bear arms is consistent with protecting innocent lives just as being pro-life is. His "weapons that kill" comment shows just what a wimp he is. Do you mean to tell me if someone breaks into his home he wouldn't defend his life and his family to the death? I find it interesting the libs are floating the idea when they control the Whitehouse, the Senate and House.  They will introduce more destructive anti-gun legislation under the guise of security that actually reduces everyone's personal security.  The libs usually raise some silly idea that the incompetence (dufus football player) or abuse (criminal behavior) of one person is justification to take the rights of the whole.  More children die by drowning in swimming pools than are killed with a gun, so by their logic we must ban swimming pools.  The right of gun ownership has little to do with hunting but the civil right of common defense in arming the militia, again another excuse by libs to ban certain types of guns using a specious argument that you don't need an AK47 to hunt deer.  The militia will find using an AK47 more helpful than a shotgun in defending the country.  It is illogical to limit the fire power of the militia when its intended purpose is a backstop for both law enforcement and the military.

BTW- if you are over 15, you are in the militia. The militia can be formed by a law enforcement official (Sheriff) in the effort to enforce the law (the old western movies of the sheriff and posse going after the bad guy) The failure of the States to run a well regulated militia is their own incompetence and does not abrogate the rights and responsibilities of the citizen to protect the country against all enemies both foreign and DOMESTIC.  It should be noted that Posse Comitatus does NOT apply to the militia, ONLY the military under certain circumstances.  The militia has police powers (State run National Guard being a form of the militia using military reservists) to arrest (detain, i.e. not transport).  That power to arrest is based on the "citizen's arrest" in common law.  The Citizens Army (Militia) has all police powers as authorized by the Sheriff or Governor, the military does not.

Repealing an Amendment

I can only think of two ways that the 2nd Amendment could be repealed; 1) By mandate of THE PEOPLE via state-by-state (de?)ratification, and 2) By declaration of martial law and suspension of the Constitution.

 

...One of these two would and could never happen, the other? I almost expect it...

However I believe that any 'crisis' and/or so called 'emergency' manufactured or otherwise could give the the government and the president, who I deem to be a socialist fascist regime, 'emergency' powers (a la Hitler) I am waiting for our version of the Reichstag fire to begin the process of rights suspension.

Actually, if you read then entire 2nd Amendment, the word militia is in there. This does not negate the right of Americans to own guns for general purposes. The actual Amendment reads "A well regulated Militia, being necessary to the security of a free
State, the right of the people to keep and bear Arms, shall not be
infringed.” I haven't been a hunter for over a decade, but I still own a number of guns, including pistols for home defense. If Liberals are so worried about people having guns, why don't they support more firearms education to prevent some of the stupid accidents that tend to occur from people who have them in their home. Too many people decide that they need a gun but have no idea how to properly handle it or how to keep it safe in case a child in the home gets their hands on it. Always handle any gun as if it is loaded and never keep a loaded firearm in your home. Trigger locks are always a good idea when children are in the home. If you don't have children and have a home security gun, you don't need locks, since they will prevent you from quick access in case of an intruder in your home.

It seems to me that Hollywood types and the sports media often wade into political issues to avoid having their professions deemed frivolous.  Ironically, these people tend to reinforce the dim actor/dim sportswriter stereotype when they speak, because it's apparent that they cannot discuss issues outside the protection of their professional bubbles. 

John Feinstein is good at what he does: writing self-absorbed books about college basketball coaches and traditional college football rivalries.  That he has to seek the finest of fine points in attempts to make baseball and golf seem remotely interesting is another story.  But Feinstein effectively laid the groundwork for conventional opinion at ESPN...Michael Jordan: Good, Bobby Knight: Bad, Coach K: Good, Duke Lacrosse Team: Bad, Title IX: Revolutionary (in the "good" sense), talented players skipping college for the pros: Bad.  John Feinstein has never emerged from the comfort of the sports/academia shelter.  He's a Duke graduate and has made himself an uncritical apologist for "higher education".  And it's frankly easy to become a mouthpiece for academia and the collegiate athletics bureaucracy when that is the primary circle you've frequented for the last 30-plus years. 

It's a phenomenon similar to that which happens to erstwhile Conservative Republicans that get elected to the Senate.  They become intoxicated with their status and their access to those regarded as "elite", and they lose touch with those who were responsible for getting them to the Senate in the first place.  They legislate to impress their peers when they should be legislating to represent their constituents.  John Feinstein writes for the approval of his professional peers, who in turn tell the public how bright he is and how good his work is (and how, if we are to truly educate ourselves, we might consider picking up a copy).

So this Plaxico Burress nightclub incident occurs.  A professional athlete carries an unregistered firearm into a public establishment and manages to accidentally shoot himself.  Because the story is about a football player, Feinstein treats it as an invitation to lecture readers on the merits of the Second Ammendment.  From his "In a Perfect World" soapbox, he trots out the tired academic interpretation of framer's intent...he calls this interpretation "sensible".  Sure, the Constitution can't possibly enumerate the right of citizens to keep and bear arms, the framer's simply intended to allow for a militia (which we apparently don't need anymore) and to permit hunting for food (and who needs an antiquated firearm when there is perfectly good tofu to be eaten).  Then, ignoring the fact that there is no popular movement behind the repeal of the Second Ammendment (not to mention the Constitutional hurdles required to enact such a repeal), Feinstein wishes Obama could focus his energies on scrapping part of the Bill of Rights.  But he acknowledges that Obama can't because he has to "deal with" the economy and the war.  I find it particularly interesting that he feels compelled to use such a throw-away expression as "deal with", as it is clearly designed to highlight problems without committing to any specific "solutions". 

This article is obviously the work of someone who was seeking affirmation beyond the traditional sports media peer base.  That he needed a sports-related incident as an excuse to climb on his soapbox illustrates that he still needs the protection of "what he knows" to pontificate on what he doesn't know.

The problem I always have had with the Liberal arguments

about the 2nd amendment.

1) Why would the Framers place one 'collective' right among nine other individual rights. That is why it is called the "Bill of Rights". These are all rights each individual possesses by the ratification and adoption of the Constitution of the US.

2) The Bill of Rights is a package deal. You not only get the right to bear arms but also the right to free speech, assembly, and religion, the right not to have your person, and possessions seized without due process of law etc. etc. All these rights are secured by this document and the laws, regulations and procedures that stem from this document. (Habeus Corpus, Self incrimination, hearsay, confidentiality of Counsel, Priest, Wife and Doctor, presumption of innocence, Miranda to name a few). These are all individual rights, often detrimental to the community and state. The courts almost always rule in favor of an individual over the state when these rights or their derivatives have been violated by the state. You can't just pick and choose which right you like you get em all whether you like it or not.

An important point I think should be closely scrutinized is another aspect of the Burress case: New York has a MANDATORY 3.5 year jail sentence for the crime Burress was charged with. The idiot Mayor has already made the unbelieveably stupid comment that (paraphrased) "This law was not meant to apply to cases like this"...I'm sorry, cases like what? The priviledged class?

It will be interesting to see whether Burress spends even a night in jail, much less the mandatory sentence meant for the peasantry.
