Retiring New York Times Supreme Court reporter Linda Greenhouse has answered some more questions from readers at nytimes.com. After an earlier revelation that she considers the former ACLU lawyer Justice Ruth Bader Ginsburg a centrist comes details of her deep affection for late ultra-liberal Justice William Brennan, whose decisions favored explicit racial quotas, no limits on abortion, mandatory school busing, opposition to the death penalty, and the strict separation of church and state:
Obviously, not every opinion Justice Brennan put his name to will stand the test of time. But many will. A personal note -- I took some time off from the court beat in the mid-1980's to have a baby and cover Congress for a couple of years. When I came back in 1988, Justice Brennan was 82 and the end of his tenure was in sight. He was one of the first people I ran into, in a court corridor. "I'm glad you're back," he said to me. I replied, "I'm glad you're still here."
By contrast, Greenhouse played it cooler when asked about the judicial philosophy of Justice Anthony Kennedy, who has become an unpredictable swing voter on a closely divided court. In Greenhouse's hothouse of ideology, Kennedy showed his big heart while supporting gay rights, but patronized women with his decision upholding the ban on partial-birth abortion:
I'm considerably less confident that I have a handle on Justice Kennedy's jurisprudence. Speaking personally, it's hard to reconcile his capacious understanding of the human condition in his majority opinion in Lawrence v. Texas, the 2003 gay rights case, with the patronizing and counter-factual attitude toward women that suffuses his majority opinion in Gonzales v. Carhart, last year's so-called partial-birth abortion case.
In April, the Court upheld the Federal Partial-Birth Abortion Act (not the "so-called" act) 5-4, with Kennedy writing the majority opinion. Greenhouse, who marched for abortion rights while covering the court for the Times in 1989, was clearly disheartened by the decision and appalled by Kennedy's sexism in her April 20 story:
But never until Wednesday had the court held that an abortion procedure could be prohibited because the procedure itself, not the pregnancy, threatened a woman's health -- mental health, in this case, and moral health as well. In his majority opinion, Justice Anthony M. Kennedy suggested that a pregnant woman who chooses abortion falls away from true womanhood.

I've had liberal friends who have named their baby and referred to it by it's name while it was still in the womb. So it's Johnny if they want it and a lump of cells if they don't. I just don't get it.
I thought that one state who had the idea of making women see the ultrasound before they made their decision had a great idea. I can't understand how anyone could be against that. These abortion encouragers don't even want the woman to be more informed. They just want her to have an abortion. It's really sick.

I am glad they have ultra-sound now for various reasons...of course it has helped curb abortion in my opinion, but Ultra-Sound wasn't even available for my first baby...all you had to do was feel that flutter of life for the first time and you knew what life was all about...you would and do guard that child with your very life...
I have never ever understood a woman who has carried a child that believes in abortions....and has some even after having her own...in one family unit. (One was a relation of mine..needless to say we had a few talks over the years)

I am late to fatherhood and not carrying a child I so cannot speak to what you wonderful women feel. However, once the child is in the world I can say that I honestly support your every feeling. If anyone thinks about hurting a child, I don't understand it. I have held my child, changed diapers, and fed him. When he was a fat baby I just wanted to eat him up, if you know what I mean. How can anyone want to hurt these people??????

The decisions are reached first, usually by gut instinct or mere emotion, and the exercise is to bend logic near the breaking point to cover their decision. I agreed with the result of the partial-birth ban, but I wish Scalia or Thomas had controlled the legal reasoning. Kennedy left a golf tournament decision ... 72 holes.

When I was attending law school at William & Mary we had a Supreme Court preview conference around September. Linda was there every year and got to act as a judge in the mock trials. I found her to be very arrogant. Her predictions on the way the court would go were always wrong. She would play O'Connor or some other Justice and did what she thought they would do. She instead voted the way she wanted them to vote rather than they way they were likely to vote. (This was in 1999-2001.) Everyone asked her what Justices thought and what would motivate them and I quickly realized she didn't have a clue. Of cource to the liberals in academia, they ate it up. It was left wing porn.
What really struck me was the implicit assumption that the Courts were property of liberals. The arrogance was sufficating.

The inventor, James McMahon of Orange County, California, called it "intrauterine cranial decompression". Not a very catchy name.
Martin Haskell, who popularized the technique among his fellow abortionists, dubbed it "dilation and extraction", or "D&X", which created a nice progession of names for how you kill fetuses as they get bigger and harder to take apart: D&C, D&E, D&X.
After it was dubbed "partial birth abortion" by National Right to Life, it got re-named "intact D&E" by the abortion lobby so they could obfuscate more effectively.
I just refer to it as "the procedure formerly known as Prince".
