Krauthammer Urges Prosecution of WikiLeaks’ Journalistic Collaborators

By Brent Baker | November 29, 2010 | 20:58

The U.S. government “ought to speak about the enablers in the American journalistic community” who have cooperated with WikiLeaks, syndicated columnist Charles Krauthammer urged on Monday’s night’s Special Report on FNC, recommending that if you “collaborate” with WikiLeaks, then “we are going to look into possible prosecution.”

Krauthammer, during the panel segment on the Monday, November 29 Special Report with Bret Baier on FNC:

The real problem here is the helpless that it exposes the United States, the superpower, all its information is out there essentially with everybody enjoying impunity. I think what she [Hillary Clinton] should have said is nothing about the leaks themselves, simply say we're going to ask the military justice and the Justice Department to try to prosecute the alleged leaker, the alleged guy who stole this on treason, not just on mishandling –but on treason and to prosecute him to the fullest extent of the law, up to and including execution if tjat is warranted.

Secondly, WikiLeaks. We should not have our Attorney General saying “oh to the extent ‘a’” or “to the extent if we find ‘a,’” This stuff has been leaked months and months earlier. This guy is the leaker. Why haven't we issued arrest warrants for him and extradition requests?

And lastly, I think they ought to speak about the enablers in the American journalistic community. To say that if you are unlike CNN and Wall Street Journal, who apparently turned down collaboration with WikiLeaks, and you collaborate, we are going to look into possible prosecution.

Fox News and/or Rush should get it out pretty soon.  Drudge should get it on his site first since he joined with a couple of others that are against the TSA's antics.

It'll get there soon enough.  I bet by tomorrow.

From Source to Print

Submitted by Gat New York on Mon, 11/29/2010 - 9:17pm.

The response to this from the Administration is incoherent and has been tepid.

Holder and company have done zero about Wikileaks since its first release about a year ago.

This faux outrage has yet to be matched with conviction to act.

They should act against all sources of the information to Wikileaks - against Wikileaks - against all news media who print what they are fed - and the webhost who enables a website like Wikileaks to even have a platform on the Internet.

Sorry Charlie, this

Submitted by bkeyser on Mon, 11/29/2010 - 9:22pm.

Sorry Charlie, this administration is NOT going to threaten the NYT. I certainly agree with you on this -and would add that this is the perfect case to use against repealing DADT given that that sissy, poor-me-my-boyfriend-broke-up-with-me so-I'm-going-to-blame-the-military and-steal-a-bunch-of-classified-material and-give-it-to-Wikileaks Bradly Manning should never have been allowed to wear the uniform in the first place.

And for those of you wanting to call me a h8r, or homophobe, or whatever for saying the truth, go right ahead. I don't care. There's never been anything like this in the history of this country, and many are calling this the largest breach of security ever for a superpower -all because one Nancy-boy couldn't handle his homosexual relationship.

Some people aren't fit for military service. Bradly Manning is example number one. Hang him by the neck until dead. But of course that won't happen, Fat Lip needs the votes.

Seriously though, you're right, and it's ridiculous how things have gotten in the last year, hell the last two years, not just about this wiki-leaky thing either.

I meant what I said in my post above yours about having faith that Holder will handle it just like he's handled the other cases like Ghalani and the Black panthers.

This is why Americans have to rise up against the fat lipped one and tell him "hell no, just go!"  And send the black and blue and purple-lipped one packing.

BKeyser, what makes you think

Submitted by MikeB on Tue, 11/30/2010 - 3:55pm.

BKeyser, what makes you think that hanging this traitor would reduce the number of votes for Ear Leader?  Convicted felons and dead folks (necro-Americans) are two large, dependable voting blocs for the Commucrat Party.  Manning's execution would actually increase the numbers for Obama: one vote as a felon convited for treason, and another vote as a dead person.

Submitted by Chris Norman on Mon, 11/29/2010 - 9:31pm.

Being somewhat busy at work, I have been unable to learn all the details of how these "leaks" (more like gushers) came about. As such, I am unclear on just how a private in the military (he was a private, right?) had access to so many documents. Please help me out here.

As I understand it

Submitted by KC Mulville on Mon, 11/29/2010 - 11:05pm.

The private bragged to a friend that the cables were stored in a database, and he had access to the database. He then downloaded the cables onto a memory stick, and walked out of the building. Being a database guy myself, I know that if you're minimally clever, you can download information -- if you have access to the tables in the first place. What matters, really, is giving individuals access to the database in the first place.

All security systems depend on a level of trust. The security setup for this database very likely is successful in blocking piracy attempts from the outside. How can you prevent piracy from the inside? How can you stop the gatekeepers from selling the secrets? Ultimately, it's always a matter of trust, which this private decided to betray.

When it comes to trust, game theory has a lesson. The rational way to prevent bad actions is to levy an extra cost on the behavior you want to stop. Anyone calculating the costs of behavior then has to gauge two factors: first, the likelihood of getting caught, and second, the size of the penalty.

  • Because someone who's trusted has a lower likelihood of getting caught (after all, to trust someone is to monitor them less), that slides the scale in favor of betrayal.
  • So the only way to compensate is to increase the other factor: penalty.

The more your system depends on trust, the greater the penalty for betrayal must be.

That's why treason, and those who collaborate with traitors, get the harshest penalty. It's the only way to balance the scale against calculating in favor of betrayal. The strategy is called "massive retaliation." I oppose the death penalty on moral grounds, but I don't oppose life in prison without parole. You have to jack up the penalty because it's the only way to threaten people before the fact.

Nail these guys. Make it huge.

Thanks KC. I understand. I also oppose the death penalty on moral, as well as practical grounds (the cost, the appeals, etc.). I prefer life in prison without... In this case I think "hard labor" would be applicable - if they're still doing that. I woulkd think that he - they - thought, in this PC, easy consequences, fun celebrity world we live in, the penalty would be low. It's time - and maybe, just maybe - this is the instance on drawing the line to show that these high profile politically tinged crimes should  have very serious punishments

Youbetcha you can be AG... I would be honored...

Others in the NB world can fill the rest of the cabinet slots... They would do a far better job than the clowns we have... There are several regular posters on this site who may not have the "prahpa" refined Ivy league education as those who "lead" us, but they sure have a whole lot more common sense...

Not too sure I would want to be POTUS, though <GRIN> Thank you for the very kind thought... We can go down that path on an open thread some day...

I love history... Just about any history that is well presented... Even things that jolt us into realizing that sometimes "progress" has serious unintended consequences... Eli Whitney's cotton gin made processing cotton bolls a whole lot more efficient and kept slavery an economically viable strategy for half a century beyond when it should have collapsed...

That's a digression... There are so many things in the news that suggest our duly elected leaders have failed or refused to take appropriate action to protect our interests... Sometimes I think it is their lack of competence... Sometimes I think it is willful... In all cases, it needs to change.

San Francisco was my home for many years... In its long and colorful history, the 1850's saw the rise of the Committee of Vigilance... Their early goal was to fight crime; their later goal was to replace political corruption... In 1856 they succeeded in replacing the corrupt democrat party machine in the City of San Francisco... We need to consider their actions...

Required reading should include: "The Public City: The Political Construction of Urban Life in San Francisco, 1850-1900"  By Philip J. Ethington... People can take back corrupt government and media if they but have the will to do it.

Enough of my soapbox... Again, thanks so very much, Dave...

We must fight to win every battle for liberty... The enemy needs only win once!

I've never had a ferret but I've had 6 pet rats over the years. I LOVE THEM! They have so much personality, (all different) and they love human contact. And I have NEVER been bitten by a rat. Not like the hamsters I had as a kid who would bite all the way through my finger tip just because I guess they didn't want to be held. And talk about jaws of steel! The only problem with rats is that they live only about 2  1/2 years and usually die of pneumonia, or tumors if they're female. It's so hard to lose them.

Obviously your passions are getting the best of your logic.  What aid did the NYT give to our enemies?  Is Iran not out enemy?  Did the articles show that the rest of the Arab world wants to blow that fanatical regime off the face of the planet; just like our friend Israel has been begging us to do?  Maybe the story about China allowing missiles that can reach Europe, to go from North Korea to Iran got you quite flustered, but as an American I find it very important.  Maybe you would like to ignore the fact that the bravest men and women that this country is currently producing are dying for a corrupt drug peddling Afghan government?   You may want to put your head in the sand and allow others to make decisions for you- but do not expect me to do the same.

I do not understand who the right-wing is mad at?  The Journalists who redacted all names except for high profile public figures?  Maybe the anger ought to be directed at the DOD for letting a 22 year old PFC have access to half a million private e-mails.  Actually, until he is proven guilty, let alone charged with anything; then maybe we ought to wait to pass judgment.  Maybe the anger ought to be directed at the imbeciles who put in writing their catty observations about world leaders?

So, in effect, you are blaming them rather than the leaker and poster. You then implied that giving a private so much access to sensitive information was the real crime (I think it's a side issue that should be investigated). Submitted by talkradio55 on Tue, 11/30/2010 - 1:35am.

If I were the Attorney General, this would have already been handled. This Julian Assange twerp would have be executed along with any of his cohorts, media or otherwise. It's about time we started putting treasonists before the firing squad. We put a few of these people on the walls and this problem will go away post haste.

Sounds like a "conspiracy to commit" case at the very least...

There's no way anybody in

Submitted by Bruzilla on Tue, 11/30/2010 - 12:25pm.

There's no way anybody in this mess could be convicted of treason.  In order to make that charge stick, you have to show a clear intent to assist the enemies of the United States during a time of war.  I haven't seen any evidence of that.  Also, media outlets can not be charged with a crime either as they did not enter into any agreements with the government niot to disclose anything they obtain.  Once classified information is released, rightly or wrongly, any media outlet can report it.

PFC Manning is a different story.  One outcome of the Walker case in the 1980s was that there was no death penalty for willingly disclosing classified information and damaging the country.  That all changed as a result of that case, and Manning had to sign that he understood that the penalty for unlawful disclosure of classified material includes a wide range of punishments up to and including death before he was granted his clearance.

I think this situation goes well beyond just wikileaks.  We have had a severe problem with folks at all levels of government leaking classified information, and that must stop.  Until the government starts cracking down hard on violaters, and by hard I mean killing them, this is going to continue causing damage.

Not Treason.  But they could (and should) prosecute them for espionage.
