"If the majority [of the U.S. Supreme Court] agrees with [Judge Roger] Vinson, President Obama would find not only his health care bill undone, but also face the most significant scaling back of the government's power to use legislation to solve its problems in decades," Time's Michael Lindenberger warned in a February 2 post at the magazine's website.

To reach such a conclusion, however, Lindenberger must have misunderstood Vinson's ruling on Monday in State of Florida v. U.S. Dept. of Health and Human Services, which sought not to "turn back the clock" on commerce clause interpretation but merely prevent its overextension into an unprecedented and dangerous arena: forcing Americans to buy private health insurance under the flimsy illogic that such economic inactivity actually amounts to commercial activity.

"I am required to interpret this law as the Supreme Court presently defines it. Only the Supreme Court can redefine or expand it further," Vinson noted on page 43 of his 78 page opinion. The Reagan appointee noted that no less legislative authorities than the Congressional Research Service and the Congressional Budget Office have found Congress requiring Americans to purchase private health insurance under penalty of law to be "novel" and "unprecedented"

Less than 24 hours after Mainers rejected a state law allowing same-sex marriage, Time magazine rushed to comfort gay activists with Michael Lindenberger's sloppy, transparently biased article titled "Gay-Marriage Activists Look Ahead After Defeat in Maine."

With condescension reminiscent of Peter Jennings - in 1994 the ABC anchor characterized the Republican takeover of Congress as the electorate having a "temper tantrum" - Lindenberger portrayed same-sex marriage opponents as stubborn children, saying, "Maine voters insisted on having their say on an issue that simply will not go away." Rather than just report and analyze the outcome, the article simultaneously sympathized with gay activists and emphasized, by way of many pro-gay quotes, the futility of fighting against an "incredible campaign" that simply wants justice.

Maine defenders of traditional marriage only had one quote in the nearly 1,200-word article: "What's the hurry [for gay marriage]?" That's six words, if you count the brackets.

The article also reassured same-sex marriage proponents that this rejection will leave no lasting scars:

Michael Lindenberger of Time.com, in a April 20 article titled “Ten Years After Columbine, It’s Easier to Bear Arms,” found it “odd” that “whatever momentum the Columbine killings gave to gun control has long since petered out,” despite the “massacres perpetrated by deranged gunmen” in the following decade. He also quoted extensively from a young gun control advocate in the online article, without including any arguments from the opposing viewpoint.

Lindenberger first gave his reflection on the anniversary: “Monday April 20 marks 10 years since Eric Harris and Dylan Klebold permanently etched the words Columbine High School into this nation’s collective memory. What happened that day in 1999 also seemed to wake America up to the reality that it had become a nation of gun owners — and too often a nation of shooters. The carnage in Littleton, Colorado...seemed to usher in a new era of, well if not gun control, then at least gun awareness.”

The Time.com writer continued with a seeming lamentation: “In the decade since, massacres perpetrated by deranged gunmen have continued — including the 2007 Virginia Tech massacre in which Cho Seung-Hui killed 32 people and wounded many others. But something odd has occurred. Whatever momentum the Columbine killings gave to gun control has long since petered out.”

If only elderly voters in California would die off in large enough numbers before November 4, then the final nail could be hammered in the coffin of California Proposition 8, a ballot initiative that would define marriage as between a man and a woman. That according to liberal activist Kristina Wilfore, the executive director of the Ballot Initiative Strategy Center, "an advocacy organization that specializes in using ballot initiatives to further liberal causes." Her comments were buried deep inside Michael Lindenberger's October 21 item at Time.com:

Wilfore says she's prepared to take the long view in California. "I am not going to be discouraged if we lose," she says. Victory will come over time in the courts, as demographics works its influence on the nation's voting patterns, she says, noting that young people support gay marriage far more than their parents and grandparents do. "A lot of people are going to have to die" before Election Day is an easy day for gay marriage, she says.

While Wilfore was not wishing for the deaths of thousands of elderly conservative voters per se, one can imagine the ire the media would focus on such a statement of say a conservative activist annoyed with elderly voters blocking Social Security reforms.

Time magazine writer Michael Lindenberger's dispatch "From Gay Marriage's Ground Zero," read more like puffy campaign literature for the liberal Democratic mayor of San Francisco than an objective news piece.

Here's how Lindenberger opened his paean to the thoroughly heterosexual Gavin Newsom.:

Same-sex couples began marrying late Monday night in courthouse ceremonies across California, putting triumphantly happy human faces on a debate that is nevertheless far from over. Crowds turned out to welcome - and, for some, to protest - weddings in Beverly Hills, Oakland and the wine country north of San Francisco.

Later in his piece, Lindenberger took at face value Newsom's recollection of how he decided in 2004 to challenge state law and grant marriage licenses to gay couples. Those "marriages" were later invalidated of course, but the recent decision by California's highest court paved the way for gay weddings, at least between now and November when a ballot initiative may outlaw same-sex marriage.
