The unencumbered ability to sway voters is great for the news media, but journalists are outraged others could re-acquire the same First Amendment rights. Instead of painting a victory for free speech in the Supreme Court's ruling that corporations, non-profit groups and unions can spend money to influence elections, the Thursday broadcast network evening newscasts feared a ruinous future:

“Opening floodgates” to “big money” with “corporate interests having even more of a say” by “attacking political candidates,” resulting in “the real danger...that the candidates are just going to get drowned out” as “special interests” may “take over political campaign advertising.”

“On that subject of big money and power,” ABC anchor Diane Sawyer intoned, “a blockbuster decision from the Supreme Court today opening floodgates for companies and unions to spend all the money they want attacking political candidates.” On NBC, anchor Brian Williams previewed “the news today that will result in big companies and corporate interests having even more of a say in American politics and campaigns.”

Following up on Monday’s Supreme Court ruling in favor of New Haven firefighters who were denied promotion after no black applicants passed a written exam, ABC’s Bob Woodruff on Tuesday’s Good Morning America approached the decision from a liberal perspective, wondering if “the ruling really make future workplace discrimination harder to prove” — as opposed to wondering whether the ruling will protect workers from discriminatory tactics from employers seeking to achieve nebulous goals such as workplace “diversity.”

Woodruff also asked correspondent Jan Crawford Greenburg whether the ruling could “tarnish” the Supreme Court nomination of Judge Sonia Sotomayor, who was part of a three-judge panel that ruled against the firefighters.

Greenburg stressed the arguments of Sotomayor’s supporters: “Oh, Bob, right away we saw critics say this was a clear rebuke to Judge Sotomayor, since she had ruled against those white firefighters. But, her supporters said, ‘Look, she was just following the law,’ and they pointed out that the Court, the Court itself, was deeply divided. The four liberal justices would have agreed with her, including that justice she’s been nominated to replace, David Souter.”

ABC News didn’t use any labels such as liberal or progressive to describe Judge Sonia Sotomayor during its Tuesday morning coverage of her nomination to the Supreme Court. On the other hand, when President Bush nominated Justice Samuel Alito to the high court in 2005, the network’s correspondents repeatedly used the conservative label to describe the nominee.

During the first segment of the 7 am hour of Good Morning America, before Sotomayor’s name emerged, This Week anchor George Stephanopoulos summarized who was on President Obama’s short list for the court nomination, including Sotomayor, describing the former or current occupations they have, but no ideological descriptions. When anchor Diane Sawyer asked about “what kind of fight is the White House anticipating” from Republicans in the Senate and “how do they plan to deal with it,” Stephanopoulos further explained that “Republicans and conservatives have already prepared dossiers on all three of the top candidates....I’ve talked to several Republicans in the Senate about this -- that the chances they’re going to defeat President Obama’s nominee are very, very low. The bar they’re trying to set -- they’re trying to have a debate over the future of the court, over the ideological direction of the court.” But he never mentioned Sotomayor’s judicial philosophy or political leaning.
