AP's Kuhnhenn: Obama Only Promised to Make Signing Statements 'More Transparent'

At the Associated Press on Friday, reporter Jim Kuhnhenn provided yet another reason why characterizing the wire service as The Administration's Press is perfectly appropriate.

In wake of President Obama's use of a "signing statement" objecting on constitutional grounds to congressionally-imposed "restrictions on his ability to transfer detainees from the U.S. military prison at Guantanamo Bay, Cuba, to the United States," Kuhnhenn wrote that presidential candidate Obama "promised to make his application (of) the (signing statement) tool more transparent." No he didn't, Jim; as will be shown, he promised not to use them. Kuhnhenn's first three paragraphs, plus two later ones describing another signing statement matter, ran thusly (also note how the term "signing statement" was kept out of the story's headline):

Obama opposes spending bill's detainee restriction

President Barack Obama told Congress restrictions on his ability to transfer detainees from the U.S. military prison at Guantanamo Bay, Cuba, to the United States might violate the constitutional separation of powers between the legislative and executive branches.

The provision is contained in a massive spending bill that Obama signed Friday. The president, in a statement accompanying his signature, said he will interpret the provisions in a way that "avoids constitutional conflicts."

"Signing statements" allow presidents to raise constitutional objections to circumvent Congress' intent. During his campaign for the White House, Obama criticized President George W. Bush's use of signing statements and promised to make his application (of) the tool more transparent.

... Obama also took issue with the spending bill's ban on funding United Nations peacekeeping missions if they place U.S. military forces under the command of a "foreign national" - unless the president notifies Congress that such a deployment is in the national interest.

Obama said those provisions also could interfere with his constitutional authorities.

This would appear to mean that if the President wants to transfer Gitmo detainees to the U.S., he and good buddy at the Department of Justice, Attorney General Eric Holder, will do it anyway, despite the law's restrictions.

In a video currently up at Hot Air, Obama said that "We’re not going to use signing statements as a way of doing an end run around Congress."

At the beginning of that video statement, Obama's opening answer to the audience member's question as to whether he will use "presidential signage" (the person meant "signing statements") to "get your way" was one word: "Yes."

In April, as covered by Jake Tapper at ABC News, Obama also issued a signing statement in connection with funding of some of his czars:

In a statement issued Friday night, President Obama took issue with some provisions in the budget bill – and in one case simply says he will not abide by it.

Last week the White House and congressional Democrats and Republicans were involved in intense negotiations over not only the size of the budget for the remainder of the FY2011 budget, and spending cuts within that budget, but also several GOP “riders,” or policy provisions attached to the bill.

One rider – Section 2262 — de-funds certain White House adviser positions – or “czars.” The president in his signing statement declares that he will not abide by it.

If that's not "an end run around Congress" (which continues another end run around Congress, namely the original appointments of the czars), I don't know what is.

Back to Kuhnhenn's AP report -- How in the world does any of this relate to being more, or less, "transparent," Jim? What seems quite transparent is Kuhnhenn's need to come up with something -- anything -- to avoid having to say that Dear Leader again broke a core campaign promise not to use a tool the eeeeevil George W. Bush employed. How pathetic.

Whether or not you interpret his BS words as the lies they are hinges simply on what your definition of "an end run around Congress" is. How convenient!

Of course, considering this administrations audacity (and the dependability of the LSM to repeat their lies), the meaning of the word 'NOT' could also come into question. After all, BJ Clinton taught them well.

"end run around Congress" = Unconstitutional

Considering the SCOTUS has found Presidential line-item vetoes to be unconstitutional, how are signing statements not unconstitutional?

Obama is signing bills into law that contain provisions specifically defunding certain of his Czars and then issuing lawless "signing statements" stating that those portions of the law that he doesn't like he will simply disregard.

This goes far beyond refusing to enforce laws that he dislikes. He is actually doing things that the law speficifically forbids him from doing. Its worse than Reagan with Iran-Contra.

Countries with Chief Executives that find they can raise money despite their legislatures refusing to grant those funds quickly find themselves living under totalitarian rule. If the Executive doesn't respect the Legislatures prerogative to control the purse strings, the Executive soon finds it has no need of a Legislature at all.

Heading Towards Constitutional Crisis

What Obama is doing is a line item veto after the fact. Not only is this against current authority a President is empowered with but also it is a shameless naked power grab that highlights Obama's callous tyrannical streak stemming from a morally bankrupt Marxist ideology and narcissistic personality.

For purely politically gainful reasons, ie not giving a damn about the Constitution or The People, Obama signs the bill knowing explicitly about a provision which he couldn't remove. (So much for compromise.) But Obama also couldn't reject the entire bill, as law requires him to if he is unwilling to follow it, for fear his and the Democrats' gambit to turn the tables on the Republicans would fail and create another nail in his re-election coffin. So Obama signs the bill while all the while intending to subvert Congress and the Constitution, hoping the Media will cover his arse, and the American people forgetting this dictatorial lawlessness in short order.

Obama is a danger to liberty and the rule of law. I said before he was elected that Obama would do worse things than Nixon. This would be one of them.

I agree with your assessment entirely but for one thing.... he doesn't just 'hope' the media will cover his arse... he faithfully relies on it. And, what's worse, they never fail to deliver.

He's ridden their remaining shreds of credibility into the ground and all they do is ask for more. They're 'all in'. I hope they get exactly what they deserve... no more and no less.

I felt the same as you about

I felt the same as you about a supplicant Media that does the Left's bidding because, well, they are overwhelmingly Leftists as well (on the national and international level).

However, there comes a point when even typically supportive media types may buy a clue and realize what Obama has purported to have said about this provision of the bill he just signed is poison even for themselves as it opens up a Pandora's box now and in the future. This is why I was resolved to distinguish it as "hope", for it may backfire spectacularly once it reaches national consciousness. This move by Obama is that egregious, that dangerous a gambit, even for the Left - at least until the Left take complete control of the levers of power and flush the Constitution.

The lawlessness and utter contempt Obama displays towards Congress and the Constitution should be hammered into American consciousness from now until election day 2012.

Just wondering: Where are all the moonbat Obamabots and reliable defenders of the Democrats/Obama on this thread?

The funny thing is that we are all so damned jaded that we haven't even attempted to hold The One to account for the actual intent of what he said. What that crowd heard was "We won't use signing statements" ... that's what they applauded and he accepted it readily. If he was really being 'transparent' he would have said then and there... "I'm not saying we won't EVER use them, but we'll make their use more transparent". I would have loved to hear the crowd reaction to THAT inconvenient truth.

Anyway... isn't it sad the depths we've sunk to regarding taking people at their word? Gotta read the fine print, else be duped into believing that "transparent" ACTUALLY MEANS 'easily seen through/ clear' (instead of its OBAMA ADMINISTRATION REVISED DEFINITION, which is obviously 'opaque/ obscure/ impenetrable').

And who the f*** even knows what the definition of the word 'is' is anymore....

I've thought that so many times about so many issues over the past 3 years that I'm now fully jaded. Too many examples to list but the straw that broke the camels back had to be the Fast and Furious rush to obliviousness. So many dots all-in-a-row and nobody interested in connecting any of them. Pathetic and sad and irredeemable.

In other words... as it refers to the media realizing anything except water-carrying for The One... "I'll look for it when I see it coming".

The Fast and Furious charlie foxtrot is being reported by a CBS reporter. It's a wonder she still has a job. While she may be in it to make a name for herself, the fact that she is reporting this Obama/Holder debacle at all is testament that some stories will be reported even though it hurts their side. Sometimes enough is enough.

But, yeah, even when Leftist reporters jab at Obama, in the end, they will double down on stupid and keep supporting Obama.

"I care too much".... I'm too hard on myself".... (and my all-time favorite)... "I work too hard".

Of course, when it comes to the true journOlists, they really HAVE been tough on Obama. They say he's waaaay too moderate and friendly to republicans. Yeah yeah... THAT'S the TICKET!

I'm with you that there are a few who cut against the grain... and let's give them the benefit of the doubt and say that they simply want to be true and proud old-school journalists.... we're still talking about a precious few voices in the wilderness that is the LSM echo chamber (aka The WH Talking Points Machine).

Besides, the left know what the word 'deterrent' really means and they know how to apply it. Too egregious a deviation from the party talking points and Bumpity Bump Bump... under the bus you go. Just ask Joe Lieberman.

That being said, I really do like James Carville. His ideology is wrong wrong wrong but at least he's intellectually honest. Sad to say but, in this climate that puts him head and shoulders above most on the left.
