AP's Shameless Headline As Dem Senators' Opposition Prevents DREAM Act Cloture: 'Republicans Block Youth Immigration Bill'

If you look at the description of yesterday afternoon's U.S. Senate Roll Call Vote Number 278 ("A bill to amend title 28, United States Code, to clarify and improve certain provisions relating to the removal of litigation against Federal officers or agencies to Federal courts, and for other purposes."), you'd never know it had anything to do with illegal immigration.

But it did. It was a cloture vote (60 needed to get the measure to the Senate floor) about about the so-called "DREAM Act," granting de facto amnesty to a vast number of illegal immigrants for entering college or joining the military. It has been a Democratic Party-"inspired" initiative with heavy Republican opposition from the get-go. It could easily have passed if the Democrats had been able to hold their membership together while picking off a couple of squishy Republicans.

They got their squishes: Republicans Murkowski (AK), Lugar (IN), and Bennett (UT) voted yes. That should have given the measure 61 votes. But Democrats Baucus (MT), Hagan (NC), Nelson (NE), Pryor AR), and Tester (MT) voted no, while Manchin (WV) did not vote. The measure's 55-41 support was not enough to move it to the next step.

So whose fault was it that the DREAM Act failed? A bitter, unbylined Associated Press report give us the wire service's "objective" take:

Republicans block youth immigration bill

 

Senate Republicans on Saturday doomed an effort that would have given hundreds of thousands of young illegal immigrants a path to legal status if they enrolled in college or joined the military.

 

Sponsors of the Dream Act fell five votes short of the 60 they needed to break through largely GOP opposition and win its enactment before Republicans take over the House and narrow Democrats' majority in the Senate next month.

 

President Barack Obama called the vote "incredibly disappointing."

 

"A minority of senators prevented the Senate from doing what most Americans understand is best for the country," Obama said. "There was simply no reason not to pass this important legislation."

 

Dozens of immigrants wearing graduation mortarboards watched from the Senate's visitors gallery, disappointment on their faces, as the 55-41 vote was announced.

 

"This is a dark day in America," said Jorge-Mario Cabrera, a spokesman for the Coalition for Humane Immigrant Rights in Los Angeles. "The Senate has ... thrown under the bus the lives and hard work of thousands and thousands of students who love this country like their own home, and, in fact, they have no other home."

 

Hispanic activists and immigrant advocates had looked to the bill as a down payment on what they had hoped would be broader action by Obama and the Democratic-controlled Congress to give the nation's 10 million to 12 million illegal immigrants a chance at legal status.

 

It targeted the most sympathetic of the millions of illegal immigrants - those brought to the United States as children, who in many cases consider themselves American, speak English and have no ties to or family living in their native countries.

 

... Critics called the bill a backdoor grant of amnesty that would encourage more foreigners to sneak into the United States in hopes of being legalized eventually.

There's a great deal of nonsense and misdirection in the AP's characterization of the bill. Posted at Michelle Malkin's blog, Senator Jeff Sessions of Alabama punctures it nicely with ten clear points. Here are a few of them:

1. The DREAM Act Is NOT Limited to Children ... H.R. 6497 includes a requirement that aliens be under the age of 30 on the date of enactment to be eligible for LPR (legal permanent resident) status. ... The bill’s 30 year old age cap on “children” only applies to date of enactment, and the registration window will remain open indefinitely regardless of future age.
3. The DREAM Act PROVIDES SAFE HARBOR FOR ANY ALIEN, Including Criminals, From Being Removed or Deported If They Simply Submit An Application ... , amazingly H.R. 6497 still protects ANY alien who simply submits an application for status no matter how frivolous.
6. Conservative Estimates Suggest That At Least 1.3 Million Illegal Aliens Will Be Eligible For the DREAM Act Amnesty. In Reality, We Have No Idea How Many Illegal Aliens Will Apply ... It is highly likely that the number of illegal aliens receiving amnesty under the DREAM Act will be much higher than estimated due to widespread fraud and our inherent inability to accurately estimate the illegal alien population. Estimates also fail to account for the chain migration which will inevitably occur once these illegal aliens are naturalized, and for children who will be eligible years down the road.
7. The DREAM Act Does Not Require That An Illegal Alien Finish Any Type of Degree (Vocational, Two-Year, or Bachelor’s Degree) As A Condition of Amnesty ... the bill is careful to ensure that illegal alien high school drop-outs will also be put on a pathway to citizenship – they simply have to get a GED and be admitted to “an institution of higher education.”

Points 1 and 6 directly refute the AP item's claim that the DREAM act only involves "hundreds of thousands of young illegal immigrants."

For those who need reminding, the AP's irresponsible take on yesterday's result is what most news readers, listeners and viewers will see, as its local and regional news, TV, and radio subscribers heavily rely on it to deliver content their staffs do not have the time or resources to assemble. The 85% of the population that is relatively disengaged (maybe, thanks to the Tea Party movement, it might be down to 80% ) will likely swallow what they see and hear, making Republicans look like the meanies who killed the bill.

The fact is that in the final analysis, it was six Democrats who appear to be deeply concerned about their political survival -- three of whom must face the voters in 2012 (Manchin, Nelson, Tester) -- who stopped the DREAM Act from becoming a nightmarish reality.

This headline made me stop

This headline made me stop and wonder if they were talking about the actual Dream Act. Was there another bill to stop young people from legally immigrating? The bias in this headline is so bad I was surprised. That takes so much bias from the AP because I assume a certain baseline of bias already.

Kind of amazing the other little sisters didn't cross the aisle....John McCain and Lindsey Grahmnesty. 

I said this on Ken's blog on the same subject, but it bears repeating.  This will be the very rare instance of the AP smearing the GOP that will help in the long run.  The majority of Americans are against amnesty...so AP helping to establish this "faux fact" (Republicans defeated the Dream Act) will help.

2012 can't get here soon enough.  I put up a Forum post right after the election, which has a list of all of the Senators who are up in 2012...twice as many democrats as republicans, many of whom are vulnerable.  A couple of posters made some excellent points about who we can reasonably expect to get rid of, including squish RINO's whom we can try to primary.

I have a friend who.....

Resides in Arizona, she tells me the only reason McCain was re-elected was because he was the best of the worst !! Hopefully when he turn comes again Arizona will finally rid Americans of this old Fossil along with his buddy Mr. Gramesty. How Alaskans ended up voting Murkowski again after voting her out in the primaries is beyond Anyones realm of reality as it's kinda of like a Politican saying they were against it before they were for it !!! I say let the AP run all and any stories that the Republicans stopped the Dream Act, what could be better than to be given credit for stopping illegals from gaining free entry into our Country ahead of those that have gone thru the rigors of doing what is required of them as should be those that were hoping to have anything handed to them on a Silver platter !!!

I don't remember Molochski being this much of a RINO.

Is she voting out of spite, or is she angling to switch parties?  Or is she voting this way as a waring to the Republicans to keep giving her earmarks and good assignments?

I guess since the republicans are getting fairly serious about no earmraks, she's defineitely gone.  Good riddance to the parasitic old battle axe.  She belongs with the Democrats if she just wants to sponge money.

If Jer doesn't get it by now why it failed, he never will.  You really can't blame the Repubs on this one.  5 Democrats plus 55 votes for it would have equaled 60, but those five voted no.  It didn't matter if the repubs were for this or not, except for those 3.  I'm a bit surprised that the usual suspects didn't vote for this.(Collins, Snowe, Graham, Brown, all RINOs)

What made me mad was when Fox News was reporting it on their webpage and they were showing pics of "undocumented students" who were weeping over it, I was thinking "why the hell isn't ICE taking these undocumented people into custoday if Fox News and other news organizations knew where they were?"

So they've raised the age limit for children once again (from 26 to 30).  Meanwhile, the threshold for senior citizen discounts/benefits has been dropping over the years. 

If this keeps up, there'll only be two types of people left:  children and senior citizens.

To the left any kind of immigration is legal. They can't seem to disguish between the two. To common sense people there is a distinction between the two, but when has anyone on the left had any common sense? Especially the so-called elite that run our so-called higher learning institutions. Of course, they want the DREAM ACT. That gives them more butts in chairs, hence more free money.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

The lamers can spin it until the cows come home. But if you look at the states represented by the no voting Dims, they received and understood the message from the Tea Partiers.  Will not be shocked to see that Manchan does not vote as often as Obama voted present as a state senator.

The Latino activist will not run to the tube, but they see this as another Obama failure.

Illegal immigrants already have a path to citizenship.

It is quite simple, really. Go home, apply for a visa, enter the country legally, observe our laws. learn our language, honor our customs, and in a few short years, take the oath and be welcomed as a new citizen.

The American Dream is available to any who want to become Americans. No further legislation needed.

They're NOT "Immigrants"

First argument, whether they came here or were brought here, they're still ILLEGAL ALIENS, violating our laws, NOT "immigrants".

Secondly, if this had passed, exactly HOW were these poor 30-year old aliens going to pay for this college education they enrolled in and how many do you actually think would have enlisted in the armed forces (people get SHOT AT in the military, and they actually have to WORK!!!) when the other option is taking college classes they DON'T EVEN HAVE TO PASS?

I am willing to bend (a bit), and grant that in many cases these people are not at fault for their illegal status. If they were brought to this country at a young age by their parents and have lived here until adulthood, they truly don't have a country. They are not US citizens, yet they likely know virtually nothing about their native lands.

For this concept to be (relatively) fair, and to actually provide some benefit to this nation, it needs to be VERY specific and have strict oversight (extremely high expectations from anything run by the government). For example:

The maximum age for them to have been brought to this country needs to be specified, i.e. UNDER 12 (and how is this going to be verified?).

The maximum age for them to apply should be no higher than 18 (same verification problem).

They should have one year to apply from enactment or forever hold their peace.

Their parents, who dragged them, unwillingly (yeah, I know) to this country MUST be deported before approval for the "child" (let's see if the rhetoric about "we did it for our children" holds water).

College should only be a secondary benefit - military service (full four-year term) should be the only condition (you want to be a citizen of this nation, then you serve it first - same should apply to ANYONE running for elected office). They can then go to college under one of the military programs, or go to school after their term of service and they have been granted citizenship.

Absolutely no criminal record.

Absolutely no relatives along for the ride.
