Reverse Discrimination? Chrysler Minority Dealers Disproportionately Spared vs. Dealer Group’s 3X Higher Expectations

ClosedAutoDealer0509"Dealergate" is a term referring to a collection of evidence indicating that dealership termination decisions at bankrupt Chrysler may have been based on factors other than maximizing the chances that the company, post-bankruptcy, will be viable and profitable.

Josh Painter at RedState has a roundup focusing on what have been the primary concerns, which continue to be vetted by Doug Ross (here, here, here, and here), Joey Smith, and several others. Those concerns are that dealers with records of supporting Republican candidates and organizations were disproportionately terminated in comparison to those with records of supporting Democratic candidates and causes, and that certain terminated right-leaning dealers have seen their territories gobbled up by Democratic Party-connected business cronies.

A separate but very relevant Dealergate issue should be whether minority-owned dealerships were unfairly spared at the expense of non-minority dealers.

Based on a report that originally appeared on May 25 in the Michigan Chronicle, a Detroit-based African-American weekly newspaper, Sean Parnell at the Center for Competitive Politics (HT Jonathan Adler at Volokh) doesn't think so.

But the Chronicle's report ignores a trade group's early worry expressed in a Wall Street Journal article about what the level of minority-owned dealer terminations might be, as well as the realities of the business situations of many of minority-owned dealers. That worry, and those realities, strongly support a contention that many minority-owned dealerships avoided the ax for reasons that weren't strictly business.

The Chronicle laid out the termination numbers (Parnell actually saw them in the Seattle Medium, which also carried the story):

Of the 789 Chrysler dealers who were notified that their contracts will not be renewed, 38 are minority owned...

At the end of April, there were 154 minority dealers in Chrysler's 3,181 total U.S. dealer body network...

Parnell's conclusion:

According to my trusty calculator, before closings 4.84% of Chrysler's dealers were minority owned. What percentage of auto dealers receiving closure notices are minority owned? 4.82%

At this point, the case for Obama's use of campaign disclosure reports to compile an "enemies list" for use in the closure of auto dealerships pretty much falls apart ....

Parnell and his "trusty calculator" are missing an obvious point: The "enemies list" may or may not exist, but the issue of its existence is separate from the issue of minority vs. non-minority dealer survival.

There's a much bigger problem with Parnell's argument. As noted in a May 15 Wall Street Journal article by Alex P. Kellogg, when the number of dealer closures was known but not the identities of all dealers axed, minority-owned dealers publicly feared a three or more times greater depletion in their ranks:

Chrysler on Thursday said it would drop 789 of its 3,200 dealers as part of its bankruptcy restructuring. GM plans to eliminate 2,600 of its more than 6,000 dealers as it reorganizes.

The National Association of Minority Automobile Dealers (NADAM) estimates that 140 of Chrysler's 170 to 175 minority-owned franchises could be closed, and at least 174 of GM's 300 minority-owned dealers could shut their doors.

My trusty calculator tells me that the feared closure rate was 82% (140 divided by 170; NADAM's dealer count appears to be from early 2008), while the actual closure rate was 25% (38 divided by 154).

The Journal's Kellogg went on to cite several valid business reasons NAMAD itself and other minority dealers cited as to why they would generally be more vulnerable:

The organization said Chrysler's minority-owned dealerships are at risk because many are small stores that offer only one of the company's three brands, Chrysler, Dodge and Jeep. Fewer than half have converted to the company's "Genesis" format that puts all three makes under one roof, NAMAD said. That compares to the approximately 60% of all Chrysler dealerships that have the three-brand format.

Genesis stores are usually more profitable because they sell and service more vehicles than single-brand dealerships. Chrysler plans to emphasize Genesis dealerships under its reorganization.

..... Many minority dealers operate in cramped downtown locations that are less desirable than the spacious suburban auto malls that are now popular, said Mr. (NAMAD President Damon) Lester and other dealers. Urban franchises typically draw fewer shoppers and carry less inventory for customers to choose among. Both factors tend to limit sales.

Minority dealers often don't own the land beneath their showrooms, so the monthly rent adds to their costs, Mr. Lester said. And since many borrowed money to get into the business, they sometimes have more debt than family-run dealerships that have been in business for decades.

All other factors being equal, given NADAM's expressed fears and the general comparative dealer profile it provided the Journal, the minority-owned dealer termination rate should have been higher -- probably much higher than the 25% overall average. In fact, it's clear that NADAM expected that outcome, even if you heavily discount their worry that over 80% of minority-owned Chrysler dealers would be told to go away as overblown hyperbole.

But it would appear that all other factors were far from equal, and that influences other than bottom-line business considerations were prominent.

The last thing a bankrupt, taxpayer-underwritten Chrysler needs as it struggles to emerge from bankruptcy and regain viability is a less than optimal dealer network. Yet it seems that the company deliberately chose exactly that -- or had it chosen for them.

To me all this doesn't matter. I give it 2 years before Dear Leader runs both GM and Chrysler into the ground. They are going to make them build cars and small trucks that nobody wants.  That is OK. Toyota is ready and willing to take over the light duty and medium duty truck market.

I am part owner of a courier/trucking firm in NJ...several of my colleagues/competitors in the industry have decided to boycott the government owneed GM and Chrysler for our new purchases.  We have cancelled a planned buy of 6 HHRs.  These are terrific vehicles and will be hard to replace with Fords but we will find something.  Also missed will be Dodge Sprinter diesel vans which are the cats meow and terrific workhorses but we will NOT buy them.

I reckon our informal group has moved 20-25 vehicle purchases from GM/Chrysler to ford and toyota.  I am pissed at what our government is doing and I am responding in the best fashion I can.

My wife works for a Chevy dealership...worried about here job we are.....even  more now that her owner is a registered Republican. My wife is a Democrat....sais this is hogwash....but I showed her the numbers....and now she just keeps telling herself...they wont do that will they....they cant....oh my.

Don't forget, though, is that this debacle will encourage the adiminstration to continue their onslought by creating new INDUSTRY-WIDE rules that will ensure that all car companies toe the line. Enforced unionization, unrealistic environmental standards, model quotas, and even salaried eployment standards and stock pay options will be mandated. In fact, this WILL be necessary to accomplish if Ford, GM, and Dodge will be mandated to be kept afloat. It is already being done in the banking industry.

The 2010 Congress with a GOP majority will have its hand full in reversing this mess.

This needs to be kept alive. No old media outlets are going to do a proper investigation of this, that is falling on a handful of bloggers. No doubt the majority of dealers were owned by Republicans, so a majority of those closed down will also be Republicans. A complete investigation also requires a look at the dealers that have been retained as well, and comparison of the R/D ratios of both groups. A complete set of data is only a starting point.

Fox News did a very cursory look at this last week, like a half-hour's worth of investigation, and pronounced in a non-story. That was very disappointing. One thing Fox News does poorly or not at all is original investigative journalism. They need an equivalent of CBS '60 Minutes' and some real investigators to put together material for such a show.

This story got started because Chrysler would not share their criteria for closing dealers, and what they did made so little sense in many cases. When asked, Chrysler officials say that the Bamster's car team came up with the list, and the car team says they had nothing to do with it. The fact that they appear to be hiding something indicates that the process is likely corrupted. Here's hoping that a bunch of dealers get together and do a class action, or perhaps get some state A-G's involved. The jobs lost because of dealer closings is going to hit small towns very hard.

Watch for this to be repeated in the case of GM dealers.

Hey do you think he'll do like Iacocca did, and do his own tv ads? We can show him rolling up to the White House in a new Chrysler, with the dog and the kids and all. He can use the shaver-guy line, -'I liked this company so I bought it'. Maybe he'll even use his name for his cars, like the Obamabile, the Barack 300, the new Dodge Bam line of trucks, the new hybrid submini-compact, the Bam-Bam (instead of putt-putt).

Would the adoration that his fans have for him translate into car sales? Will Chryslers become the prestige wheels in the hood, instead of Cadillac SUVs and Mercedes?

Will there be a tiered pricing structure, so minorities get discounts? Double minorities get double discounts? If you are a black hispanic female lesbian disabled, do you get a car for free? So many questions, this is new territory.

 Oh please......Alot of them ride buses, or in used cars because they are "just barley getting by", and the ones who can afford the new cars wouldn't be caught dead in anything smaller than a SUV, because even they know that the safety standards of the crap that Obama wants are not there.  Gotta protect thier kids ya'know.

Chrystler and GM are going to be gone in 2 years because I along with others refuse to buy Government owned cars, and as far as I know, the Government cannot force you to buy one.  (But hey, that might change soon)!!!

I think we're missing the point

1) We should be more concerned that Obama is violating contract law.  Instead of worrying about the possibility of conservative dealerships being targetted, we need to focus on the fact that PRIVATE BUSINESSES were targetted.  They were FRANCHISE businesses that were not owned, operated or expenses to the Chrysler corporation.

2) If Obama can close down those private businesses what's to stop him from taking over McDonalds after his healthcare bill goes through and forcing McDonalds Franchise owners to close their doors to save us from eating too much beef?

Besides 80 - 90% of car dealers are conservative, so chances are if a dealer was closed it was owned by a conservative.

Being a fan of NASCAR I

Being a fan of NASCAR I wonder how long it will be before Dear Leader makes Chevy and Dodge pull out their support. For as long as I can remember racing, whether NASCAR or SCCA i.e., have been testing grounds for better equipment. I know that in NASCAR the only thing that is Ford, Chevy, Dodge, or Toyota is the engine. The bodies used to somewhat resemble the body of the street version but not any more.  I am not going to watch a bunch of sub-compact cars with 4 cylinder engines run around a superspeedway like Talladega at the blinding speed of 80 mph. 

For the past few years Toyota has sunk a lot of money into all of NASCAR's different series. In my opinion it has paid off in sells (sales) of Toyota trucks and Camrys.

Don't forget that he's going to nationalize (destroy) the health care industry, he's appointed an Internet Czar fer' chrissakes, presumably to control content so sites like Newsbusters, Townhall, and Rush Limbaugh will be negated or have to pay serious taxation, he's putting his buddy on the FCC committee to eliminate national programs like Rush, Sean, and Mark Levin, he's working on destroying what's left of the constitution with his federal judgship and supreme court nominees who interpret the constitution without regard to its origins, he's working on driving up the cost of gas by creating environmental standards that do everything but protect the environment (actually making it LESS safe via less technological advances), paying for all college education fees at universities that absolutely prevent anyone who is politically to the right of Ted Kennedy from being on the staff, and essentially eliminate capitalism for private industry as aa whole?

I think worrying about this is a distraction from what we should really be concerned about and that's a President that is lurching so far and fast to the left, that we know have the following:

 1) Several Czars that are only answerable to the President.

 2) As you stated the government now has it's hands in the ENTIRE banking industry and won't let banks give back the "stimulus" money.  (letting the banks get control back of their bank)  They also will soon have control of the auto industry and the Car Czar (who was Obama's campaign fundraising manager) BROKE contract law and handed over a majority stake of Chrysler and GM not to the Bond holders, but to the UNIONS, who helped get Obama elected.  He then put 789 Car dealers on a list that were ONLY franchises.  That would be like the government taking control of New Balance, and then telling all the Famous Footwears they can no longer sell shoes!  It's absolutely insane, regardless of the political leanings of the owners.

3) Related to TWO, why aren't more people talking about the fact that Obama just laid off over 30,000 people?  This goes back to my earlier post; The political leanings of these Dealerships DOES NOT MATTER.  We should be outraged regardless of the idealogy of the owner.
