Buried or Ignored by MSM: Calif. Supreme Ct. Says Illegal Immigrants Must Get In-State Tuition

Yesterday the California Supreme Court ruled "that illegal immigrants are entitled to the same in-state tuition breaks that are offered to citizens who attend public colleges and universities."

The Associated Press reports that "[t]he high court unanimously upheld a state law that says any student, regardless of immigration status, who attended a California high school for at least three years can qualify for in-state tuition that's much less than what out-of-state students pay."

The losing party in the case plans an appeal to the U.S. Supreme Court, so this may not be the final word on the issue.

Given that the Golden State is flat broke and illegal immigration is a hot button issue nationally, this sounds like a story worthy of mainstream media attention.

Yet it appears the story has been largely ignored or buried by the MSM thus far.

Of the three broadcast morning news programs, only "Good Morning America" ran an anchor desk briefing on the development today:

JUJU CHANG: The California Supreme Court has ruled illegal immigrants are entitled to in-state tuition discounts at public universities. A lower court ruling had classified illegal immigrants as non-residents. The case is likely headed to the U.S. Supreme Court.

The Washington Post ran a four-paragraph news brief on page A2 of today's paper while the New York Times buried its November 16 story, entitled "Court Backs Illegal Immigrant Students," on page A20.

What's more, New York Times reporter Ian Lovett seemed to imply that the ruling was one that conservatives should have no trouble with:

"It cannot be the case that states may never give a benefit to unlawful aliens without giving the same benefit to all American citizens,'' wrote Justice Ming W. Chin, one of the court's more conservative justices, in the court's opinion.

For its part, the Los Angeles Times devoted front-page coverage to the story, where it noted in the second paragraph that (emphasis mine):

The ruling is the first of its kind in the nation. California is one of 10 states that permit undocumented immigrants to receive in-state tuition, which can save them $23,000 a year at the University of California.

In his New York Times story, Lovett had a much lower number, perhaps reflecting the average savings from in-state tuition:

Currently, students who attend at least three years of high school in California and graduate are eligible for in-state tuition at public schools, which can save them as much as $12,000 a year compared with students who come from other states.

Either figure is a hefty chunk of change for which California taxpayers and law-abiding out-of-state tuition payers have to pick up the slack.

Is this supposed to be a swipe at my career?  Yes, Toronto does just fine, all 5 months of the year that they can shoot outdoors.  NY as well.  There are many reasons those of us who live in the area can feel secure about our jobs.  Primarily, the actors live here, the professional crews live here, the casting companies, the rental shops, the property shops, endless costume supply, and oh yeah, stages built for making movies and TV shows.

    California Supreme Court justices are appointed by the Governor of California.  5 of the 7 justices  have been seated since before I moved to California and changed residency.  

    So I'm on the hook for one of the seven, Carlos Moreno, who was appointed by Gray Davis in 2001.

    So continue to explain how my vote for Gray Davis a decade ago has direct implications as to the outcome of a California Supreme Court case.  Furthermore, explain how my stance against illegal immigration means anything but what I have previously stated.

    If there had been an obvious drop off location I would have bought more and donated them...at $.39/lb.  Great turkey, though the new convection oven cooked it 30% faster than I had been used to.

    Congrats on the free turkey.  I worked for a company who used to do that as well.  These days I'm on my own, which is why I went out on a limb and went fresh...though I admit I didn't taste much difference.

    There's nothing I enjoy more than seeing the Cowboys lose.  The Pats are a close 2nd.  I'm a Buffalo boy, which means I have a deep seeded hatred of the 'Boys and their fans.  Yesterday was extra special.

    T-giving continued

    Back in the day when I was what is known as Active Duty, I would bake hams - sometimes two - and give them away at meals for the troops.  It was especially morale boosting for the guys and gals who were far from home on Thanksgiving Day - as I typically was.  All of the officers and NCOs would do this - and I was much appreciative of the seasoned NCOs who not only were great at their jobs but could also prepare a mean turkey. 

    I haven't done anything like that on Turkey Day in awhile - I mostly support various causes with canned food items - but my personal charity day is fast approaching. 

    By the way, you cannot imagine how fun it is slamming Cowboy fans here in the heart of Cowboy country, pointing out that it was their alleged offensive "savior", Roy Williams, that coughed up the game by not fighting tooth and nail for the damn ball when he caught it.  I saw this in a bar, of all places.  If I were eating something, it would have been a definite choking hazard as hard as I laughed. :o)

    Ah yes, canned food.  We've been collecting weekly for the past month or so for the Christmas food drives.  It's too bad, especially in a city as large as  LA, that there aren't more food drop off locations.  I'd like to believe more people would help out if more information was given.  

    Roy's game-losing play was pretty special - like you said, if he wasn't supposed to be their savior...

    Of course, I witnessed my Bills, and more specifically, Stevie Johnson drop the game winner in OT against the big bad Steelers.  Still, I'm somewhat content as the team who was supposed to go 0-16 showed the NFL how overrated Pittsburgh really is.

    If not 100% then pretty close to it.  Eisenhower had a good plan - deport illegals deep into Mexican territory, none of the current BS of hand them off at the border where they may more easily slip back in again.

    We don't deport Cubans once they touch American soil, except for the criminal/psych unstable ones I would think.

    There are probably some other reasonable exceptions, such as true, in need asylum seekers, but that wouldn't include Obama's Aunt Patootie.

    No argument from me that illegals shouldn't be considered in-state students (or however you want to phrase it).

    But this story reminds me of something I had forgotten since graduating from college....why is in-state tuition and out-of-state tuition so different to begin with (for US citizens)? When I was choosing my college, I stayed within my state simply because the expense of going to another state made it too costly.

    The difference between the 2 can sometimes be in the tens of $1000's (as the article even demonstrates), but really, what cost is imposed on the school for educating a student from a different state? You can't tell me that food, housing, and the time that teachers spend educating is more expensive just because someone is coming from another state....so what is it? Some tax related oddity? Does anyone know?

    ....is the correct one: since these are state colleges they are subsidized by that state's taxpayers's money. It doesn't really make any sense to be giving discount tuition to the residents of another state. But by the same token, it doesn't make any sense to be giving discount tuition to another COUNTRY's residents

    Public universities are largely (some more than others) supported by the taxpayers of that state. Why should another state's taxpayer's kids get to pay the tuition when the out-of-stater has never paid a dime in taxes to support the university they want to send their kid to? Also, most, perhaps all states, have a percentage limit on how many out-of-staters they can admit to their public university. Some, like the main UNC campus at Chapel Hill, limit it to 5% IIRC. Furthermore, if you live in a state with excellent public universities, like North Carolina, Virginia, California, Texas, etc., why should you have your state's public university wide open for admission competition to states with only average public universities?

    That is where "undocumented" came from.Then, all that remains to solve the "problem" is to document them.This nation already did that kind of  "amnesty" thing. It was a disaster.The political correctness has to go and in its place put personal responsibility and direct accountabiltiy.

    Here is the only "amnesty" we should offer;Set the National Guard, under the control of each Governor,at regular intervals all along the border. And I do mean all the way around.Nobody gets in except via ports of entry. Anyone can leave wherever they please.Make it known that in three months time, interior enforcement will begin wherebyany illegal captured will be removed, via biometrics, from a list of eligible legal immigrants forever.     Furthermore, we RIF at least 50,000 bureaucrats in DC, and use those funds to hire more border guards....put them in planes, Humvees, on horses, whatever....all along the border.  With dogs.

    Enforce the border.  It's not rocket science.  Mexico has traffic stops everywhere, armed with Army or Marines.  They routinely haul everyone off buses (looking for illegal immigrants for Nico & El Salvador).  They require you have your (shocking!) documents in order.  They can, and do, search your vehicle.  I am sick to death of these whiners yelling racism at providing proof of citizenship, here.  I was "profiled" continuously in Latin America, la gringa.  No biggie.  It's their country.  And guess what, this is our country....play by the rules or get out.

    And let me add, while I'm ranting....in Guatemala we met a very nice fellow who was married to an American.  His wife and child were in Nebraska, but he was doing his "two years" waiting for his green card, as required, in his home country. 

    These illegals demanding amnesty are shoving law abiding people out of the way for their own selfish reasons.  Get to the back of the freakin' line already.  I have friends in Costa Rica who have trouble getting tourist visas to come here because of the illegals.  It's ridiculous.

    Sorry, but I don't get all bent out of shape over this. If you've been allowed to live in the state and attend public school in the state as a resident all your life, for all intents and purposes, you are a resident of that state. It's illogical and inconsistent to say you can attend K-12 as a resident, but then you're not a resident when you graduate and go to a college in the same state.

    The problem isn't getting in-state tuition once you get to college, the problem is being allowed to attend public schools here as an illegal to begin with. Solve THAT problem, and this tuition rate issue will be moot.

    And just so there's no misunderstanding, I'm against illegal immigration as much as the next person.

    No, you are not. You just spent an entire post justifying it.

    You present the notion that because a problem wasn't addressed before now, it can't be addressed now.  That means all one has to do is break the law long enough and then iti s ok and unpunishable.

    Patently ridiculous.

    It would be like saying, OK, the only kinds of firearms protected byt he Second Amendment are "those in common use". Ban rifles of a particular type and then tie up such a ban in court for decades, only to say, well the ban can stand because they aren't in common use (when they aren't in common use because they were unjusty banned).

     

    Where I come from, that is called a circle jerk.

    That an individual right exists requires that some policy positions be removed from the table of debate.

    The point I got from ckc is that it is patently stupid to allow illegals to matriculate right up to college level and then get all high and mighty about illegality.

    All that does is make the authorities look like asses; whether incompetent ones or just stupid ones, would be up to conjecture.

    No, ckc, it isn't the same issue at all. K-12 deals with the "immigrant" issue simply because the students are here in this country, and is tied up in partisan wrangling and self-interest. The college tuition issue is both a fairness issue and a legal issue.

    Look at the ruling - "illegal immigrants are entitled to the same in-state tuition breaks that are offered to citizens who attend public colleges and universities". Illegal immigrants aren't entitled to anything, with the limited exception of life-saving medical care and deportation. They aren't supposed to be here at all! How can they get resident tuition when they, by law, aren't residents? And the "same in-state tuition breaks" aren't "offered to citizens who attend public colleges and universities". These breaks are only offered to state residents, not all citizens who attent the school.

    "It cannot be the case that states may never give a benefit to unlawful aliens without giving the same benefit to all American citizens,'' wrote Justice Ming W. Chin. And comparing illegals to US citizens is the crux of the issue. This opinion of a state judge is extremely disturbing, in that is clearly equates illegals with American citizens. It's a backwards argument. There should be no argument about giving any benefit to acknowledged unlawful aliens (one wonders how THAT term even got into the ruling). US citizenship entltles people to the rights and benefits of this nation. The only rights illegals are "entitled" to are basic human rights while they are being deported!

    Most of the arguments for illegals are that they are productive, they pay taxes, they have family here, they've been here for x-amount of years, they were brought here as children, ect. None of this has any bearing on their status as ILLEGAL aliens in this country. And looking deeper into this issue, what it boils down to is that US taxpayers are subsidizing a college education for illegal aliens, when many of said residents can't even afford to sent their own children to the same school. How is that fair or equitable? Further, out-of-state students are actually penalized when out-of-country students suck up the benefits of this ruling. I always thought it was a requirement to be a judge that you actually KNOW THE LAW! What is the legal basis of this ruling? If someone would compile ALL the costs of illegals, to include education, medical, legal issues, "social benefits", etc., so that Americans could actually see the cost of supporting these people, the issue would get resolved quickly.

    I doubt anybody knows how many people are running around in CA with false papers like Meg Whitman's Ex-housemaid and how many of them are voting.  Of course, that is exactly the way the Democrats and RINOs have "re-invented" California.

    California is thoroughly bankrupt in many ways.  A perfect example of Soros's Open Society.
